Upaya perlindungan hukum Istri sebagai korban Tindak Pidana perdagangan orang perspektif Maqāṣid Al-Syarī’ah Jasser Auda: Studi di Unit Pelayanan Perempuan dan Anak Kepolisian Resor Mojokerto Kota

ABSTRAK

Tindak Pidana Perdagangan orang dengan suami sebagai pelaku dan istri sebagai korban terjadi di Kota Mojokerto pada setiap tahunnya dalam kurun waktu 2021-2024. Upaya perlindungan hukum pada istri sebagai korban tindak pidana perdagangan orang merupakan hal yang penting. Penelitian ini dilakukan di Unit Pelayanan Perempuan dan Anak Polres Mojokerto Kota sebagai salah satu instansi di wilayah Kota Mojokerto yang memberikan perlindungan hukum pada istri sebagai korban. Tujuan penelitian ini untuk mengetahui upaya yang dilakukan Unit Pelayanan Perempuan dan Anak serta menganalisis dengan konsep maqāṣid al-syarīʻah Jasser Auda untuk mengetahui kemaslahatannya.

Penelitian ini merupakan jenis penelitian yuridis empiris yakni mengkaji berlakunya suatu hukum ditengah-tengah kehidupan masyarakat. Penelitian ini menggunakan pendekatan yuridis sosiologis dengan hasil yang diharapkan yaitu menjelaskan dan menghubungkan bekerjanya hukum formal di masyarakat. Penelitian ini melakukan wawancara secara langsung dengan informan untuk mengetahui upaya yang dilakukan.

Hasil penelitian ini memaparkan bahwa upaya perlindungan hukum yang diberikan oleh Unit Pelayanan Perempuan dan Anak Polres Mojokerto Kota terdapat dua penanganan yaitu preventif dengan melakukan sosialisasi dan represif dengan memberikan perlindungan kesehatan, layanan psikologi, bantuan hukum, perlindungan sosial dan pemberdayaan korban dengan memberikan lapangan pekerjaan. Upaya perlindungan yang diberikan setelah dianalisis menggunakan enam fitur diantaranya fitur kognitif, kemenyeluruhan, keterbukaan, hirarki, multidimensi dan kebermaksudan yang ditawarkan Jasser Auda telah sesuai dengan tujuan maqāṣid al-syarīʻah, yaitu terpenuhinya perlindungan agama, perlindungan jiwa atau HAM, perlindungan akal atau psikis, perlindungan harta dan perlindungan keturunan atau keluarga korban.

ABSTRACT

Trafficking in persons with husbands as perpetrators and wives as victims occurs in Mojokerto City every year in the period 2021-2024. Legal protection efforts for wives as victims of human trafficking crimes are important. This research was conducted at the Women and Children Service Unit of Mojokerto City Police as one of the agencies in the Mojokerto City area that provides legal protection to wives as victims. The purpose of this research is to find out the efforts made by the Women and Children Service Unit and analyze with the concept of maqāṣid al-syarīʻah Jasser Auda to find out the benefits.

This research is a type of empirical juridical research that examines the enactment of a law in the midst of community life. This research uses a sociological juridical approach with the desired result of explaining and connecting the operation of formal law in society. This research conducts direct interviews with sources to find out the efforts made.

The results of this study explain that the legal protection efforts provided by the Mojokerto City Police Women and Children Service Unit have two treatments, namely preventive by conducting socialization and repressive by providing health protection, psychological services, legal assistance, social protection and empowering victims by providing employment. The protection efforts provided after being analyzed using six features including cognitive features, wholeness, openness, hierarchy, multidimensionality and meaningfulness offered by Jasser Auda are in accordance with the objectives of maqāṣid al-syarīʻah, namely the fulfillment of religious protection, protection of the soul or human rights, protection of the mind or psychic, protection of property and protection of offspring or the victim's family.

تحدث جريمة الاتجار بالأشخاص حيث يكون الزوج هو مرتكب الجريمة والزوجة باعتبارها الضحية، في مدينة موجوكيرتو كل عام في الفترة 2021-2024. تعتبر جهود الحماية القانونية للزوجات ضحايا الأعمال الإجرامية للاتجار بالبشر مهمة. تم إجراء هذا البحث في وحدة خدمات النساء والأطفال بشرطة مدينة موجوكيرتو باعتبارها إحدى الوكالات في منطقة مدينة موجوكيرتو التي توفر الحماية القانونية للزوجات كضحايا. يهدف هذا البحث إلى تحديد الجهود التي تقوم بها وحدة خدمة المرأة والطفل وتحليلها باستخدام مفهوم مقاصد الشريعة لجاسر عودة لتحديد فوائدها.

هذا البحث هو نوع من الأبحاث القضائية التجريبية، وهو دراسة سن القانون في خضم حياة الناس. يستخدم هذا البحث منهجًا قانونيًا اجتماعيًا لتحقيق النتيجة المرجوة، وهي شرح وربط أعمال القانون الرسمي في المجتمع. وقد أجرى هذا البحث مقابلات مباشرة مع المصادر لمعرفة الجهود المبذولة.

تظهر نتائج هذا البحث أن جهود الحماية القانونية التي تقدمها وحدة خدمات المرأة والطفل بشرطة مدينة موجوكيرتو تتكون من نوعين من العلاج، هما الوقائي من خلال إجراء التنشئة الاجتماعية والقمعي من خلال توفير الحماية الصحية والخدمات النفسية والمساعدة القانونية والحماية الاجتماعية والحماية الاجتماعية. تمكين الضحايا من خلال توفير فرص العمل. إن جهود الحماية المقدمة بعد تحليلها باستخدام ستة سمات هي السمات المعرفية، والشمولية، والانفتاح، والتسلسل الهرمي، وتعدد الأبعاد، والهدف الذي قدمه جاسر عودة، تتوافق مع أهداف مقاصد الشريعة، وهي تحقيق الحماية الدينية، وحماية الحياة أو حقوق الإنسان، وحماية العقل أو النفس، وحماية الأصول وحماية أحفاد أو أسر الضحايا
