Profil psikologis pembunuhan berencana di Polda NTT

ABSTRAK

Pembunuhan berencana merupakan salah satu jenis kejahatan yang paling serius dan kejam dalam hukum pidana di banyak sistem hukum di seluruh dunia, termasuk dalam konteks hukum Islam. Pembunuhan berencana merujuk pada Tindakan seseorang yang dengan sengaja merencanakan dan melaksanakan pembunuhan terhadap individu lain dengan niat jelas untuk mengakhiri nyawa korban. Penelitian ini dilakukan dengan tujuan untuk mengetahui bagaimana proses penegakan hukum terkait tindak pidana pembunuhan berencana di Polda NTT. Selain itu, penelitian ini bertujuan untuk mengetahui pembuktian unsur-unsur tindak pidana pembunuhan berencana dan juga untuk mengetahui pertanggung jawaban pelaku tindak pidana pembunuhan berencana.
Penelitian ini memakai metode kualitatif dan studi kasus, sehingga hal ini dapat lebih terfokus pembahasan dengan mengumpulkan informasi dari pihak-pihak yang terkait secara langsung, yakni terdakwa Randy Suhardy Badjideh. Selain itu, digunakan dengan teknik pengambilan data berupa wawancara, observasi dan dokumentasi. Pemilihan subjek yaitu terdakwa Randy Badjideh dan istri sah nya yaitu Ira Ua sebagai kasus pembunuhan berencana terhadap ibu dan anak yaitu Astri dan Lael Maccabee.
Hasil temuan lapangan menyatakan berdasarkan hasil putusan Nomor (80/Pid.B/2022/PN.Kpg), Majelis Hakim menjelaskan bahwa Randy Badjideh adalah orang yang sehat jasmani dan Rohani. Dan dapat diminta pertanggung jawaban atas perbuatannya dan kesalahannya pada tindak pidana yang ia lakukan. Terdakwa di jatuhkan pidana pada Pasal 340 KUHP secara sah dengan terbukti terdakwa memenuhi unsur-unsur pada pasal tersebut dan di dukung dengan alat bukti yang di hadirkan pada saat proses persidangan.

ABSTRACT

Premeditated murder is one of the most serious and violent crimes in criminal law in many legal systems around the world, including in the context of Islamic law. Premeditated murder refers to the act of a person who deliberately plans and carries out the murder of another individual with the clear intention of ending the victim's life. This research was conducted with the aim of knowing how the law enforcement process related to the crime of premeditated murder at the NTT Regional Police. In addition, this study aims to determine the proof of the elements of the crime of premeditated murder and also to determine the responsibility of the perpetrators of premeditated murder.
This research used qualitative methods and case studies, so that it could be more focused on the discussion by collecting information from the parties directly involved, namely the defendant Randy Suhardy Badjideh. In addition, data collection techniques were used in the form of interviews, observation and documentation. The selection of the subject, namely the defendant Randy Badjideh and his legal wife, Ira Ua, as a case of premeditated murder of mother and child, Astri and Lael Maccabee.
The results of the field findings state that based on the results of decision Number (80/Pid.B/2022/PN.Kpg), the Panel of Judges explained that Randy Badjideh is a person who is physically and mentally healthy. And can be held accountable for his actions and his guilt in the criminal offense he committed. The defendant was sentenced under Article 340 of the Criminal Code legally as it was proven that the defendant fulfilled the elements of the article and was supported by evidence presented during the trial process.

عتبر القتل العمد من أخطر الجرائم وأعنفها في القانون الجنائي في العديد من النظم القانونية حول العالم، بما في ذلك في سياق الشريعة الإسلامية. ويشير القتل مع سبق الإصرار والترصد إلى الفعل الذي يقوم به شخص يخطط وينفذ عمداً قتل شخص آخر بنية واضحة لإنهاء حياة الضحية. وقد أُجري هذا البحث بهدف معرفة كيفية إنفاذ القانون فيما يتعلق بجريمة القتل العمد في شرطة إقليم نوسا تنجارا الشرقية. وبالإضافة إلى ذلك، تهدف هذه الدراسة إلى تحديد إثبات أركان جريمة القتل العمد مع سبق الإصرار والترصد، وكذلك تحديد مسؤولية مرتكبي جريمة القتل العمد.
استخدم هذا البحث الأساليب النوعية ودراسات الحالة، بحيث يمكن أن يكون أكثر تركيزاً على المناقشة من خلال جمع المعلومات من الأطراف المعنية مباشرة، أي المدعى عليه راندي سهردي بادجيده. بالإضافة إلى ذلك، تم استخدام تقنيات جمع البيانات في شكل مقابلات وملاحظة وتوثيق. وقد تم اختيار موضوع الدراسة، أي المتهم راندي بادجيده وزوجته الشرعية إيرا أوه، كقضية قتل عمد للأم والطفلة أستري وطفلها آستري وليل مكابي.
تشير نتائج النتائج الميدانية إلى أنه بناءً على نتائج رقم القرار ) ٠٨/بيد ب/٢٢٠٢/محكمة مقاطعة كوبانغ( أوضحت لجنة الحكام أن راندي بادجيده شخص يتمتع بصحة بدنية وعقلية جيدة. ويمكن محاسبته على أفعاله وذنبه في الجريمة الجنائية التي ارتكبها. تم الحكم على المتهم بموجب المادة ٠٤٣ من القانون الجنائي قانوناً حيث ثبت استيفاء المتهم لأركان المادة ودعمت بالأدلة المقدمة أثناء عملية المحاكمة.
