Implementasi peraturan menteri perhubungan nomor 45 tahun 2023 terkait sertifikasi bengkel dan teknisi kustomisasi kendaraan bermotor: Studi di bengkel motor Kustom Kediri

ABSTRAK

Penelitian ini bertujuan untuk menganalisis implementasi Peraturan Menteri Perhubungan tentang kustomisasi kendaraan bermotor di bengkel motor kustom di Kediri dengan fokus pada kendala yang dihadapi oleh pelaku usaha dalam mematuhi regulasi terkait sertifikasi.
Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus dan wawancara terhadap pemilik bengkel dan teknisi. Hasil penelitian menunjukkan bahwa sebagian besar bengkel di Kediri belum sepenuhnya menerapkan sertifikasi sesuai dengan peraturan yang ada. Kendala utama yang ditemukan meliputi batasan fasilitas, pengetahuan mengenai peraturan, serta akses untuk mendapatkan sertifikasi. Meskipun regulasi ini diharapkan dapat meningkatkan standar keselamatan dan kualitas kustomisasi kendaraan, implementasinya terhambat oleh kondisi lokal yang berbeda dengan bengkel di kota besar. Sebagai perbandingan, bengkel di kota besar cenderung lebih mematuhi regulasi dan memiliki fasilitas yang memadai untuk menjalankan kewajiban sertifikasi.
Oleh karena itu, penelitian ini menyarankan perlunya kolaborasi yang lebih erat antara pemerintah dan pelaku usaha untuk meningkatkan pemahaman tentang regulasi dan membantu bengkel kecil menyesuaikan diri dengan persyaratan sertifikasi. Dengan demikian, diharapkan pelaksanaan peraturan dapat lebih efektif dan membawa dampak positif bagi industri kustomisasi kendaraan bermotor di Indonesia.

ABSTRACT

This study aims to analyze the implementation of the Regulation of the Minister of Transportation regarding the customization of motor vehicles in custom motorcycle workshops in Kediri by focusing on the obstacles faced by business actors in complying with regulations related to certification.
This study uses a qualitative approach with case study methods and interviews with workshop owners and technicians. The results of the study show that most workshops in Kediri have not fully implemented certification in accordance with existing regulations. The main obstacles found include facility limitations, knowledge of regulations, and access to certification. Although these regulations are expected to improve the safety standards and quality of vehicle customization, their implementation is hampered by local conditions that differ from workshops in big cities. In comparison, workshops in big cities tend to be more compliant with regulations and have adequate facilities to carry out certification obligations.
Therefore, this study suggests the need for closer collaboration between the government and business actors to improve understanding of regulations and help small workshops adjust to certification requirements. Thus, it is hoped that the implementation of regulations can be more effective and bring a positive impact on the motor vehicle customization industry in Indonesia.

تستخدم هذه الدراسة نهجا نوعيا مع طرق دراسة الحالة والمقابلات مع أصحاب ورش العمل والفنيين. تظهر نتائج الدراسة أن معظم ورش العمل في كديري لم تنفذ الشهادات بالكامل وفقا للوائح القائمة. تشمل العقبات الرئيسية التي تم العثور عليها قيود المرافق ومعرفة اللوائح والوصول إلى الشهادات. على الرغم من أنه من المتوقع أن تؤدي هذه اللوائح إلى تحسين معايير السلامة وجودة تخصيص المركبات ، إلا أن تنفيذها يعيقه الظروف المحلية التي تختلف عن ورش العمل في المدن الكبرى. وبالمقارنة ، تميل ورش العمل في المدن الكبرى إلى أن تكون أكثر امتثالا للوائح ولديها مرافق كافية لتنفيذ التزامات إصدار الشهادات.
لذلك ، تقترح هذه الدراسة الحاجة إلى تعاون أوثق بين الحكومة والجهات الفاعلة في مجال الأعمال لتحسين فهم اللوائح ومساعدة ورش العمل الصغيرة على التكيف مع متطلبات الشهادات. وبالتالي ، من المأمول أن يكون تنفيذ اللوائح أكثر فعالية وأن يكون له تأثير إيجابي على صناعة تخصيص السيارات في إندونيسيا.
