ABSTRAK

Indonesia mengolah kedelai menjadi produk seperti tahu dan susu kedelai, dengan Desa Pojok, Kabupaten Kediri, menjadi sentra produksinya. Namun, banyak UMKM di sektor ini belum memiliki legalitas usaha, meski legalitas penting untuk keamanan produk, kredibilitas, dan kemitraan.
PP Nomor 5 Tahun 2021 melalui OSS mempermudah perizinan berbasis risiko, di mana usaha tahu dan susu kedelai tergolong risiko rendah. Namun, kendala seperti kurangnya pengetahuan dan persepsi bahwa izin hanya penting bagi usaha besar masih menghambat pelaku UMKM.
Penelitian ini bertujuan menganalisis kepatuhan produsen tahu dan susu kedelai di Desa Pojok terhadap peraturan tersebut dan mencari solusi atas hambatan legalitas usaha mereka. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif untuk menganalisis kepatuhan UMKM tahu dan susu kedelai di Desa Pojok, Kecamatan Wates, Kabupaten Kediri terhadap peraturan. Data primer diperoleh melalui wawancara dengan pelaku UMKM, DPMPTSP, dan Dinas Koperasi, sedangkan data sekunder berupa literatur dan dokumen hukum. Pengumpulan data dilakukan melalui wawancara, observasi, dan analisis dokumen, kemudian diolah secara deskriptif kualitatif melalui tahap editing, klasifikasi, dan penarikan kesimpulan untuk menjawab rumusan masalah penelitian.
Berdasarkan hasil penelitian ini menunjukkan bahwa tingkat kepatuhan UMKM produsen tahu dan susu kedelai di Desa Pojok, Kecamatan Wates, Kabupaten Kediri terhadap Pasal 4 PP Nomor 5 Tahun 2021 masih belum optimal. Sebagian besar UMKM belum sepenuhnya memahami dan memenuhi kewajiban terkait perizinan berusaha berbasis risiko. Hal ini disebabkan oleh kurangnya sosialisasi dari pemerintah DPMPTSP dan Dinas Koperasi dan UMKM, keterbatasan sumber daya yang dimiliki UMKM, serta prosedur perizinan yang dianggap rumit.

Indonesia processes soybeans into products such as tofu and soy milk, with Pojok Village, Kediri Regency, being the center of production. However, many MSMEs in this sector do not yet have business legality, although legality is important for product safety, credibility, and partnerships.
Government Regulation Number 5 of 2021 through OSS simplifies risk- based licensing, where tofu and soy milk businesses are classified as low-risk. However, obstacles such as lack of knowledge and perception that permits are only important for large businesses still hinder MSME actors.
This study aims to analyze the compliance of tofu and soy milk producers in Pojok Village with these regulations and find solutions to the barriers to the legality of their business. This study uses an empirical juridical method with a qualitative approach to analyze the compliance of tofu and soy milk MSMEs in Pojok Village, Wates District, Kediri Regency with regulations. Primary data was obtained through interviews with MSME actors, DPMPTSP, and the Cooperative Office, while secondary data was in the form of literature and legal documents. Data collection was carried out through interviews, observations, and document analysis, then processed in a qualitative descriptive manner through the stages of editing, classification, and drawing conclusions to answer the formulation of the research problem.
Based on the results of this study, it shows that the level of compliance of MSMEs producing tofu and soy milk in Pojok Village, Wates District, Kediri Regency to Article 4 of Government Regulation Number 5 of 2021 is still not optimal. Most MSMEs have not fully understood and fulfilled their obligations related to risk-based business licensing. This is due to the lack of socialization from the DPMPTSP government and the Cooperatives and MSME Office, the limited resources owned by MSMEs, and licensing procedures that are considered complicated.

استخدمت الدراسة منھ ًجا قانونیًا تجریبیًا مع أسلوب نوعي لتحلیل امتثال المشروعات الصغیرة والمتوسطة لصناعة التوفو وحلیب الصویا في قریة بوجوك، منطقة واتس، محافظة كیدیري لھذه اللوائح. تم جمع البیانات الأولیة من خلال مقابلات مع أصحاب المشروعات الصغیرة والمتوسطة، ھیئة الاستثمار والترخیص )دي بي إم بي تي أس بي(، ودائرة التعاونیات، بینما تم الحصول على البیانات الثانویة من الأدبیات والوثائق القانونیة. تم جمع البیانات عبر المقابلات والملاحظات وتحلیل الوثائق، ثم معالجتھا .وصفیًا نوعیًا من خلال مراحل التحریر والتصنیف واستخلاص الاستنتاجات للإجابة على إشكالیات البحث
وأظھرت نتائج البحث أن مستوى امتثال المشروعات الصغیرة والمتوسطة المنتجة للتوفو وحلیب الصویا في قریة بوجوك، منطقة واتس، محافظة كیدیري للمادة ٤ من اللائحة الحكومیة رقم ٥ لعام ٢٠٢١ لا یزال غیر مثالي. حیث إن معظم ھذه المشروعات لم تفھم تما ًما أو تلتزم بالمتطلبات المتعلقة بالتصاریح التجاریة المبنیة على المخاطر. ویرجع ذلك إلى نقص التوعیة من الحكومة، ھیئة دي بي إم بي تي أس بي ودائرة التعاونیات والمشروعات الصغیرة والمتوسطة، بالإضافة إلى محدودیة الموارد لدى ھذه المشروعات، .فض ًلا عن الإجراءات التي تُعتبر معقدة
