Praktik Fake GPS pada Ojek Online di Kota Malang perspektif undang-undang perlindungan konsumen dan etika bisnis Islam

ABSTRAK

Praktik fake gps yang dilakukan oleh beberapa driver ojek online di Kota Malang ini sangat merugikan banyak driver ojek online yang tidak menggunakan aplikasi tersebut. Sedikit gambaran mengenai penggunaan aplikasi fake GPS yaitu driver dari ojek online ini menginstal sebuah aplikasi yang disebut aplikasi fake GPS di smartphone mereka kemudian mereka memalsukan GPS atau keberadaan mereka. Sehingga ojek online yang tidak menggunakan fake GPS lebih susah mendapatkan orderan. Selain itu, penggunaan aplikasi fake GPS pada ojek online juga merugikan para penumpang atau customer karena waktu pengantaran makanan atau penjemputan penumpang menjadi lebih lama dari estimasi waktu yang ditentukan.

Tujuan dari penelitian ini adalah untuk mengetahui bagaimana penggunaan aplikasi fake GPS pada ojek online perspektif Undang-Undang Perlindungan Konsumen dan Etika Bisnis Islam. Penelitian ini menggunakan jenis penelitian yuridis empiris, dengan pendekatan yuridis sosiologis. Teknik pengumpulan data menggunakan metode wawancara dan dokumentasi.

Hasil penelitian menunjukan bahwa praktik fake GPS pada ojek online sangat merugikan bagi driver lain yang tidak menggunakan aplikasi fake GPS tersebut. Selain itu, ada beberapa potensi yang dialami oleh para customer atau penumpang ketika mendapatkan driver yang menggunakan aplikasi fake GPS tersebut yaitu : waktu penjemputan penumpang atau pengantaran makanan terlalu lama dari estimasi waktu yang ditentukan, customer tidak dapat memantau keberadaan driver tersebut karena maps diaplikasi tidak berjalan (titik maps tetap berada dititik pengambilan makanan atau resto) meskipun driver sudah klik antar pesanan, Dapat mengamcam keselamatan driver maupun penumpang karna driver sangat terburu-buru saat berkendara.

ABSTRACT

The practice of the fake GPS application carried out by several online motorcycle taxi drivers in Malang City is very detrimental to many online motorcycle taxi drivers who do not use the application. A little insight into the use of the fake GPS application, namely that the drivers of these online motorcycle taxis install an application called the fake GPS application on their smartphones, then they fake their GPS or whereabouts. So online motorcycle taxis that don't use tuyul have a harder time getting orders. Apart from that, using the fake GPS application on online motorcycle taxis is also detrimental to passengers or customers because food delivery or passenger pick-up times are longer than the estimated time specified.

The aim of this research is to find out how the fake GPS application is used in online motorcycle taxis from the perspective of the Consumer Protection Law and Islamic Business Ethics. This research uses empirical juridical research, with a sociological juridical approach. Data collection techniques use interview and documentation methods.

The research results show that of the fake GPS application on online motorcycle taxis is very detrimental to other drivers who do not use the fake GPS application. Apart from that, there are several potential experiences experienced by customers or passengers when they get a driver who uses the fake GPS application, namely: the time for picking up passengers or delivering food is too long than the estimated time specified, customers cannot monitor the whereabouts of the driver because the maps applied are not working ( the map point remains at the food or restaurant pick-up point) even though the driver has clicked on the order. This can threaten the safety of the driver and passengers because the driver is in a hurry when driving.

تستخدم هذه الدراسة نوع البحث القانوني التجريبي، مع منهجية قانونية اجتماعية. يتم جمع البيانات باستخدام أساليب المقابلات والتوثيق.
