Peran dan kesiapan Kanwil Kementerian Hukum dan HAM Jawa Timur dalam implementasi Peraturan Presiden Nomor 60 Tahun 2023 tentang Strategi Bisnis dan HAM

ABSTRAK

Pemerintah mengeluarkan kebijakan terbaru untuk menegakkan prinsip-prinsip HAM dikarenakan masih banyak nya permasalahan pelanggaran HAM terutama mengenai Bisnis dan HAM dengan dikeluarkannya Perpres Nomor 60 Tahun 2023 Tentang Stranas BHAM. Di dalam pasal tersebut Kanwil Kemenkumham berperan untuk menjalankan Aksi BHAM di tingkat daerah yaitu GTD BHAM.

Penelitian ini berfokus pada dua aspek yaitu membahas peran Kanwil Kemenkumham dan kesiapan Kanwil Kemenkumham dalam implementasi Perpres ini. Tujuan dari penelitian ini adalah mengidentifikasi kendala-kendala yang dihadapi dan memberikan rekomendasi untuk meningkatkan efektivitas implementasi kebijakan serta membantu Kanwil Kemenkumham Jawa Timur dalam meningkatkan peran dan kesiapan mereka dalam mengimplementasikan Perpres Nomor 60 Tahun 2023.

Metode penelitian yang digunakan adalah yuridis empiris yaitu penelitian yang dilakukan dengan menganalisis dan mengkaji bekerjanya hukum dalam masyarakat. Adapun pendekatan penelitian yang digunakan dalam penelitian ini adalah pendekatan yuridis sosiologis yang kemudian diuraikan secara deskriptif .

Hasil penelitian menunjukkan bahwa peran dan kesiapan Kanwil Kemenkumham Jawa Timur belum bisa terlaksana dengan maksimal dikarenakan terjadi kendala yaitu belum adanya pengesahan Surat Keterangan GTD BHAM, Sehingga Kanwil Kemenkumham Jawa Timur belum mempunyai dasar yang kuat untuk menjalankan peran tersebut.

ABSTRACT

The government has issued a new policy to uphold human rights principles because there are still many problems with human rights violations, especially regarding business and human rights, with the issuance of Presidential Decree Number 60 of 2023 concerning the National Strategy for Human Rights and Human Rights. In this article, the Regional Office of the Ministry of Law and Human Rights plays a role in carrying out the BHAM Action at the regional level, namely GTD BHAM.

This research focuses on two aspects, namely discussing the role of the Regional Office of the Ministry of Law and Human Rights and the readiness of the Regional Office of the Ministry of Law and Human Rights in implementing this Presidential Decree. The aim of this research is to identify the obstacles faced and provide recommendations to increase the effectiveness of policy implementation and assist the East Java Regional Office of the Ministry of Law and Human Rights in increasing their role and readiness in implementing Presidential Decree Number 60 of 2023.

The research method used is empirical juridical, namely research carried out by analyzing and studying the operation of law in society. The research approach used in this research is a sociological juridical approach which is then described descriptively.

The results of the research show that the role and readiness of the East Java Regional Office of the Ministry of Law and Human Rights cannot be carried out optimally due to obstacles, namely the absence of ratification of the BHAM GTD Certificate, so that the East Java Regional Office of the Ministry of Law and Human Rights does not yet have a strong basis to carry out this role.

أصدرت الحكومة سياسة جديدة لدعم مبادئ حقوق الإنسان لأنه لا تزال هناك مشاكل كثيرة تتعلق بانتهاكات حقوق الإنسان، خاصة فيما يتعلق بقطاع الأعمال وحقوق الإنسان، مع صدور القرار الجمهوري رقم ٦٠ لسنة ٢٠٢٣ بشأن الاستراتيجية الوطنية لحقوق الإنسان وحقوق الإنسان . في هذا المقال يلعب المكتب الإقليمي لوزارة القانون وحقوق الإنسان دورا في تنفيذ إجراءات BHAM على المستوى الإقليمي، وهي GTD BHAM.

ويركز هذا البحث على جانبين، وهما مناقشة دور المكتب الإقليمي لوزارة القانون وحقوق الإنسان، ومدى جاهزية المكتب الإقليمي لوزارة القانون وحقوق الإنسان في تنفيذ هذا المرسوم الرئاسي. الهدف من هذا البحث هو تحديد العقبات التي تواجهها وتقديم توصيات لزيادة فعالية تنفيذ السياسات ومساعدة مكتب جاوة الشرقية الإقليمي التابع لوزارة القانون وحقوق الإنسان في زيادة دوره واستعداده لتنفيذ المرسوم الرئاسي رقم ٦٠ لعام ٢٠٢٣.

طريقة البحث المستخدمة هي الطريقة القانونية التجريبية، أي البحث الذي يتم من خلال تحليل ودراسة عمل القانون في المجتمع. منهج البحث المستخدم في هذا البحث هو منهج قانوني اجتماعي ثم يتم وصفه بعد ذلك.

تظهر نتائج البحث أن دور واستعداد المكتب الإقليمي لجاوى الشرقية التابع لوزارة القانون وحقوق الإنسان لا يمكن القيام به على النحو الأمثل بسبب العقبات، وهي عدم التصديق على شهادة BHAM GTD، بحيث تكون جاوة الشرقية ولا يملك المكتب الإقليمي لوزارة القانون وحقوق الإنسان حتى الآن أساساً قوياً للقيام بهذا الدور.
