Pandangan mediator terhadap implementasi Kaukus dalam upaya maksimalisasi hasil mediasi: Studi di Pengadilan Agama Kabupaten Malang

ABSTRAK

Pelaksanaan mediasi di Pengadilan dilaksanakan oleh mediator dengan berpedoman Perma No. 1 Tahun 2016. Dalam melaksanakan mediasi, mediator akan melaksanakan tahapan-tahapan mediasi salah satunya yaitu kaukus yang merupakan salah satu alternatif cara yang dapat digunakan oleh mediator ketika menghadapi kondisi-kondisi tertentu yang menghambat jalannya mediasi. Adapun untuk pelaksanaanya diserahkan kepada pertimbangan masing-masing mediator.

Dalam penelitian ini, rumusan masalah yang ditentukan adalah bagaimana implementasi kaukus di Pengadilan Agama Kabupaten Malang terhadap maksimalisasi hasil mediasi dan bagaimana pandangan mediator terhadap implementasi kaukus dalam upaya maksimalisasi hasil mediasi. Penelitian ini bertujuan menjelaskan implementasi kaukus di Pengadilan Agama Kabupaten Malang dan menjelaskan pandangan mediator terhadap kaukus dalam upaya maksimalisasi hasil mediasi.

Penelitian ini merupakan penelitian yuridis empiris atau yang dikenal pula dengan penelitian lapangan, sedangkan pendekatan yang digunakan adalah pendekatan yuridis sosiologis. Adapun sumber data yang didapat peneliti yaitu berupa sumber data primer berupa hasil wawancara dengan mediator dan sumber data sekunder. Peneliti mengumpulkan data-data dengan melakukan wawancara dan dokumentasi. Selanjutnya peneliti mengolah data dengan pemeriksaan data, klasifikasi, verifikasi, analisis, dan kesimpulan.

Dalam penelitian ini dapat dikemukakan bahwa implementasi kaukus di Pengadilan Agama Kabupaten Malang bersifat insidentil yang didasarkan pada kondisi para pihak dan kondisi perkara. Sementara itu, berkaitan dengan implementasi kaukus dalam upaya maksimalisasi hasil mediasi para mediator memiliki pendapat yang berbeda. Ada yang menyatakan bahwa kaukus tidak mempengaruhi hasil mediasi, ada yang menyatakan kaukus sangat mempengaruhi hasil mediasi yang memungkinkan para pihak mencabut perkaranya, dan ada juga yang menyatakan menyatakan bahwa kaukus mempengaruhi hasil mediasi namun rata-rata berhasil sebagian.

ABSTRACT

The mediation in the court is carried out by the mediator based on the 2016 Minister of Religion Regulation Number 1. In the mediation process, the mediator will carry out the stages of mediation, one of which is the caucus which is an alternative way that can be used by the mediator when dealing with certain conditions that hinder the course of mediation. As for the implementation, it is left to the consideration of each mediator.

In this research, the formulation of the problem determined are how the implementation of caucuses in the Malang District Religious Court towards the maximization of mediation results and how the mediator views the implementation of the caucus in an effort to maximize the results of mediation. This research aims to explain the implementation of caucuses in the Malang District Religious Court and explain the views of mediators about caucuses in an effort to maximize the results of mediation.

This research is an empirical juridical research or also known as field research, while the approach used is a sociological juridical approach. The source of the data is obtained by researchers in the form of primary data sources in the form of interviews with mediators and secondary data sources. Researchers collect data by conducting interviews and documentation. Furthermore, researchers process data by examining data, classification, verification, analysis, and conclusions.

In this research, it can be stated that the implementation of caucuses in the Malang District Religious Court is incidental based on the condition of the parties and the condition of the case. Meanwhile, related to the implementation of caucuses in an effort to maximize the results of mediation the mediators have different opinions. Some stated that the caucus did not affect the results of mediation, some stated the caucus greatly influenced the results of mediation which allowed the parties to withdraw their case, and there are those who claim that caucuses influence mediation results, but on average partially successful.

عقد الوساطة في المحكمة تعقد بالوسيط على أساس نظام محكمة العليا نمرة 1 سنة 2016. عقد الوسيط في عقده خطوات الوساطة احدى منهم تعني المؤتمرات الحزبية وهي احدى الخطوة تستخدم الوسيط في مواجهة الأحوال المعينة تثبت الوسيط.توضع التعقيد حسب الوسيط.

أسئلة البحث المقرر لهذا البحث يعني عن كيفية تطبيق المؤتمرات الحزبية في المحكمة الدينية لمنطقة مالانج على تعظيم تحصيل الوساطة وكيف . نظرية الوسيط على تطبيق المؤتمرات الحزبية الحزبية في محاولة تعظيم عن تحصيل الوساطة. تهدف هذا البحث لوصف نظرية الوسيط على تطبيق المؤتمرات الحزبية في محاولة تعظيم عن تحصيل الوساطة.

تكون هذا البحث بحث القانوني التجريبي أو يقال بالبحث الميداني، والمنهج المستخدم يعني منهج القانوني الإجتماعي. مصادر البحث المحصولة يعني مصادر البحث الأساسي بكل تحصيل المقابلة بالوسيط ومصادر البحث الثانوي. جمع البيانات المعقدة بعقد المقابلة والوثيقة، وتحويل البيانات المعقدة بتفتيش البيانات والتصنيفية والتحقق والتحليل والتلخيص.

تطرح هذا البحث أن تطبيق المؤتمرات الحزبية في المحكمة الدينية لمنطقة مالانج تكن عرضيا تؤسس بأحوال بنفر والمقتضي. في الغضون العلاقة من تطبيق المؤتمرات الحزبية في محاولة تعظيم عن تحصيل الوساطة أن لدي الوسائط آراء مختلفة. هناك من يقول أن المؤتمرات الحزبية لا يؤثر تحصيل الوساطة، وفي رأي آخر أنها تؤثر تماما ويمكن الأفراد بإلغاء قضيته، ومن يقول أنها تؤثر تحصيل الوساطة ولكن بنصف النجاح.
