Pengangkatan anak menurut peraturan Menteri Sosial no. 110 tahun 2009 perspektif Mashlahah Mursalah: Studi di Dinas Sosial Kabupaten Malang

ABSTRAK

Pemerintah bekerjasama dengan Dinas Sosial Kabupaten Malang dalam penyelenggaraan pengangkatan anak. Prosedur pengangkatan anak yang ada di Dinas Sosial Kabupaten Malang dilakukan berdasarkan Peraturan Menteri Sosial No.110 tahun 2009. Sehingga Dinas Sosial Kabupaten Malang dapat sejalan dengan Pemerintah dalam penanggulangan penelantaran anak di Kabupaten Malang. Banyaknya orang yang telah mengadopsi anak tetapi tidak mengurus secara resmi di sebabkan karena prosedur yang ada terlalu sulit. Sehingga banyak yang mengangkat anak tanpa melalui prosedur resmi yang telah tercantum dalam Peraturan Menteri Sosial No.110 Tahun 2009 yang mana prosedur pengangkatan anak tersebut dilaksanakan di Dinas Sosial Kabupaten Malang. Yang mengakibatkan pengangkatan anak tersebut tidak memiliki dokumen yang di akui Negara dan tidak memiliki kekuatan hukum yang mengikat.

Peneliti melakukan penelitian ini dengan rumusan masalah bagaimana penerapan pengangkatan anak menurut Peraturan Menteri Sosial No. 110 tahun 2009 di Dinas Sosial Kabupaten Malang, bagaimana penerapan pengangkatan anak menurut Mashlahah Mursalah di Dinas Sosial Kabupaten Malang.

Penelitian ini menggunakan jenis penelitian yuridis empiris dengan pendekatan deskriptif kualitatif. Sedangkan sumber data yang di gunakan yaitu sumber data primer dan sumber data sekunder. Metode pengumpulan data menggunakan wawancara dan dokumentasi. Sedangkan dalam proses pengolahan data menggunakan pemeriksaan data, pengelompokan data, pemeriksaan data, analisis dan kesimpulan.

Hasil penelitian ini menunjukkan bahwa: 1) Penerapan pengangkatan anak di Dinas Sosial Kabupaten Malang sudah sesuai dengan prosedur yang berlaku di dalam Peraturan Menteri Sosial No.110 tahun 2009, akan tetapi masih banyak proses adopsi yang tidak dilaksanakan secara resmi di Dinas Sosial Kabupaten Malang disebabkan karena prosedur yang ada terlalu sulit. 2) Penerapan pengangkatan anak yang di lakukan di Dinas Sosial Kabupaten Malang sudah memenuhi 3 syarat mashlahah mursalah, yaitu tidak mengada-ngada, umum dan menyuluruh, dan sesuai hukum yang dituju syara’. Akan tetapi dalam penerapannya tersebut belum sepenuhnya memenuhi unsur mashlahah, dikarenakan prosedur yang ada terbilang cukup sulit dan membutuhkan waktu yang cukup lama.

ABSTRACT

The government cooperates with the Malang Regency Social Service in the organization of adoption. Procedures for adoption of children in Malang Regency Social Service are carried out based on Ministry of Social Affairs Regulation No.110 of 2009. So that Malang Social Services can be in line with the Government in overcoming child neglect in Malang Regency. Many people have adopted children but have not officially taken care of them because the procedures are too difficult. So that many adopted children without going through the official procedures that have been listed in the Minister of Social Affairs Regulation No.110 of 2009 in which the appointment of these children was carried out at the Malang District Social Service. Which resulted in the adoption of the child does not have documents that are recognized by the State and does not have binding legal force.

The researcher carries out this research by the research question of how the implementation of children adoption according to Social Minister Regulation number 110 of 2009 and how the implementation of children adoption according to mashlahah mursalah in Social Services of Malang District.

This research is juridical empirical research with qualitative approach. However, the data source is primary and secondary data. The method of data collection is by interview and documentation. However, in analysing the data, the researcher analyses the data by investigating, grouping, investigating, analyzing the data, and concluding.

The result of this research shows that: 1) The adoption of adoption of children in Malang Regency Social Service is in accordance with the procedures in the Ministry of Social Affairs Regulation No.110 of 2009, but there are still many adoption processes that are not officially implemented in Malang Social Services because the existing procedures are too difficult . 2) The adoption of adoption carried out in Malang Regency Social Service has fulfilled 3 mashlahah mursalah requirements, namely not making it up, general and thorough, and in accordance with the laws intended syara'. However, in its application it has not fully met the element of maslahah, because the existing procedures are quite difficult and require a long time.

تتعاون الحكومة مع الخدمة الاجتماعية منطقة مالانج في تنظيم تبني الأطفال. يتم تنفيذ الإجراءات الحالية لتبني الأطفال في الخدمة الاجتماعية منطقة مالانج بناءً على تنظيم وزير الاجتماعي رقم ١١٠ لعام ٢٠٠٩. بحيث يمكن أن تتماشى الخدمة الاجتماعية مع الحكومة في التغلب على إهمال الأطفال في منطقة مالانج. لقد كثير من تتبني الأطفال لكنهم لم يعتنوا بهم رسميًا لأن الإجراءات صعبة للغاية. حتى الكثير من المتبنين الأطفال دون المرور بالإجراءات الرسمية التي تم إدراجها في تنظيم وزير الاجتماعي رقم ١١٠ لعام ٢٠٠٩ والتي تم تنفيذها الاجراءات لتبني الأطفال في الخدمة الاجتماعية منطقة مالانج. مما أدى إلى تبني الطفل ليس لديه وثائق معترف به من قبل الدولة وليس لديه قوة قانونية ملزمة.

أجرت الباحثة هذه الدراسة بمشكلة البحث عن كيفية تطبيق تبني الأطفال وفقًا لتنظيم وزير الاجتماعي رقم ١١٠ لعام ٢٠٠٩ في الخدمة الاجتماعية منطقة مالانج، وكيفية تطبيق تبني الأطفال وفقًا للمصلحة المرسلة في الخدمة الاجتماعية منطقة مالانج.

استخدم هذا البحث نوع من البحث القانوني التجريبي بالنهج الوصفي النوعي. أما مصادر البيانات المستخدمة هي مصادر البيانات الرئيسية والثانوية. تستخدم الباحثة طريقة جمع البيانات بطريقة المقابلة والوثائق. أما عمليات معالجة البيانات من خلال مراحل التنقيح والتصنيف والتحقق وتحليل البيانات والاستنتاجات.

ظهرت نتائج هذا البحث، ١) أن تطبيق تبني الأطفال في الخدمة الاجتماعية منطقة مالانج قد تتوفق بالإجراءات الرسمية التي تم إدراجها في تنظيم وزير الاجتماعي رقم ١١٠ لعا ٢٠٠٩ ، لاكن لا يزال هناك الكثير من عمليات التبني التي لا يتم تنفيذها رسميًا في الخدمة الاجتماعية منطقة مالانج لأن الإجراءات صعبة للغاية. ٢) تطبيق تبني الأطفال المنفَّذ في الخدمة الاجتماعية منطقة مالانج قد استوفى ٣ متطلبات المصلحة المرسلة، وهي لا تجعل الأمر، عامة وشاملة ووفقًا للشريعة المقصودة. مع ذلك، فإن في تطبيقه لم يتحقق بالكامل مع عنصر المصلحة، لأن الإجراءات الحالية صعبة للغاية وتتطلب وقتًا طويلاً.
