Penerapan bimbingan perkawinan di Kantor Urusan Agama Lowokwaru perspektif teori sistem hukum Lawrence M. Friedman

ABSTRAK

Bimbingan perkawinan calon pengantin konsepnya tertulis disurat edaran direktur jenderal bimas nomor 2 tahun 2024. Beberapa penelitian mengetengahkan bahwa pihak penyelenggaranya belum dapat menerapkan bimbingan perkawinan yang sesuai dengan ketentuan aturan bimbingan perkawinan calon pengantin, persoalan ini mendasari peneliti melakukan analisa tentang pelaksanaan atas peraturan direktur jenderal bimbingan masyarakat Islam No. 189 tahun 2021 tentang petunjuk pelaksanaan binwin catin di KUA kota Lowokwaru analisa pula ditinjau dari sudut pandang teori sistem hukum, Lawrence M. Friedman.
Ada dua rumusan masalah yang pertama adalah bagaimana penerapan bimbingan perkawinan calon pengantin di KUA Lowokwaru dan kedua bagaimana penerapan bimbingan perkawinan calon pengantin di KUA Lowokwaruberdasarkan sudut pandang dari konsep sistem hukum Lawrence M. Friedman.
Metode penelitian pada tesis ini yang berdasarkan jenisnya adalah penelitian empiris, pendekatannya sosiologis empiris, dituliskan dalam narasi deskriptif, perolehan data dari pengamatan, interview sekaligus dokumentasi lalu data diolah melalui tahapan reduction, displaying dan veryfication setelahnya data-data ini dianalisa menggunakan teori sistem hukum dari Lawrence M. Friedman.
Hasil penelitian bahwa pelaksanaan bimbingan perkawinan di KUA Lowokwaru belum sepenuhnya ideal sesuai konsep peraturan direktur jenderal bimbingan masyarakat Islam No. 189 tahun 2021. kendati begitu semua substansi berupa bekal keilmuan untuk berumah tangga, tersampaikan seluruhnya. Dalam segi teori sistem hukum: 1) Struktur hukum yakni KUA belum dapat menerapkan sesuai aturan direktur jenderal bimbinigan masyarakat Islam No. 189 tahun 2021. misalnya dalam ketentuan pelaksanaan, mestinya berlangsung dua hari namun dipadatkan menjadi hanya dua jam, pihak pelaksana berdalih bahwa masyarakat kesulitan meluangkan waktu, KUA pun tak dapat memaksakan; 2) Substansi hukum; sebagaimana termaktub di sema No.2 tahun 2024, menjadikan bimbingan perkawinan sudah memiliki legitimasi 3) Budaya Hukum; masyarakat mengikuti bimbingan perkawinan secara tertib dan patuh, menunjukkan sikap kesungguhan ingin berumah tangga artinya, mereka tersadar bahwa binwin catin ini penting. Suatu intisari bahwa binwin catin tidak dapat dikesampingkan keberadaannya, eksistensi valuenya berimbang dengan perkawinan yang sakral, sebagaimana kaidah Fiqhiyyah :
مالا يتم الواجب إلا به فهو واجب perkara yang menjadi penyempurna dari perkara wajib, hukumnya juga wajib. dan لللوسا ئل حكم المقاصد perantara atau media baginya berlaku pula hukum sebagaimana tujuannya.

ABSTRACT

The concept of marriage guidance for prospective brides is written in the circular letter of the director general of guidance number 2 of 2024. Several studies highlight that the organizers have not been able to implement marriage guidance by the provisions of the marriage guidance rules for prospective brides, this problem is the basis for the researcher to conduct an analysis of the implementation of the Regulation of the Director General of Islamic Community Guidance No. 189 of 2021 concerning the guidelines for the implementation of bin win can in the KUA of Lowokwaru city, the analysis is also reviewed from the perspective of legal system theory, Lawrence M. Friedman. There are two problem formulations: the first is how to implement the marriage guidance of the bride-to-be at KUA Lowokwaru, and the second is how to apply it based on Lawrence M. Friedman's concept of the legal system. The research method in this thesis is based on the type is empirical research, the approach is empirical sociological, written in a descriptive narrative, data acquired from observations, interviews as well and documentation, and then the data is processed through the stages of reduction, display, and verification after which these data are analyzed using legal system theory from Lawrence M. Friedman. The study results show that the implementation of marriage guidance at KUA Lowokwaru is not completely ideal according to the regulation of the director general of Islamic community guidance No. 189 of 2021. Even so, all the substance in the form of scientific provisions for marriage was conveyed in its entirety. In terms of legal system theory: 1) The legal structure, namely KUA, has not been able to implemented according to the rules of the director general of Islamic community guidance No. 189 of 2021. For example, in the implementation provisions, it should have lasted two days but it was condensed to only two hours, the implementing party argued that the community had difficulty taking time, and the KUA could not impose it; 2) Legal substance; as stated in SEMA No.2 of 2024, making marriage
guidance already have legitimacy 3) Legal Culture; The community follows marriage guidance in an orderly and obedient manner, showing an attitude of seriousness in wanting to get married, which means that they are aware that binwin can is important. An essence that bin win action cannot be ruled out of its existence, the existence of its value is balanced with a sacred marriage, as the rules of Fiqhiyyah: بجاو وهف هب ﻻإ بجاولا متي ﻻام the case that is the perfection of the mandatory case, the law is also compulsory . and دصاقملا مكح لئ اسوللل intermediaries or media for him also apply the law as it is intended.
