Pemenuhan nafkah keluarga pedagang kambing perspektif Kompilasi Hukum Islam: Studi Kasus Pedagang Kambing di Pasar Hewan Desa Bringin

ABSTRACT

Nafkah merupakan kewajiban seorang suami. Namun, dalam realitas kehidupan, terdapat berbagai macam profesi dan penghasilan yang dimiliki oleh suami-istri. Salah satu profesi yang cukup umum di Indonesia adalah pedagang kambing, yaitu orang yang menjual kambing hidup atau daging kambing di pasar atau tempat lain. Pedagang kambing biasanya memiliki modal yang terbatas, sehingga penghasilan mereka pun tidak menentu dan bergantung pada permintaan pasar. Hal ini tentu berpengaruh pada kemampuan mereka untuk memberi nafkah kepada keluarga. Dalam keluarga pedagang kambing terdapat keunikan dalam pemberian nafkah suami kepada istri.

Fokus dari penelitian ini adalah Untuk Mengetahui mengapa sebagian istri pedagang kambing di Pasar Hewan Desa Bringin tidak cukup dengan nafkah yang diberikan suami dan bagaimana prespektif Kompilasi Hukum Islam pasal 80 tentang kewajiban suami dan pasal 83 tentang kewajiban istri. Penelitian ini merupakan penelitian yuridis empiris menggunakan pendekatan kualitatif. Metode pengumpulan data yang digunakan adalah wawancara dan dokumentasi, kemudian metode pengolahan data dengan tahap edit, klasifikasi, verifikasi, analisis, dan kesimpulan.

Hasil dari penelitian ini menunjukkan bahwa penerapan Kompilasi Hukum Islam pasal 80 tentang kewajiban suami dalam keluarga pedagang kambing sudah diterapkan dengan sebaik mungkin. Tetapi dalam Kompilasi Hukum Islam pasal 83 tentang kewajiban istri ada beberapa istri pedagang kambing belum melaksanakan kewajibanya sebagai istri seperti yang tertuang dalam pasal tersebut.

ABSTRACT

Support is a husband's obligation. However, in the reality of life, there are various kinds of professions and incomes that husband and wife have. One profession that is quite common in Indonesia is goat traders, namely people who sell live goats or goat meat in markets or other places. Goat traders usually have limited capital, so their income is uncertain and depends on market demand. This certainly affects their ability to provide for their family. In the goat trader's family there is a unique way of providing support from the husband to the wife.

The focus of this research is to find out why some of the wives of goat traders at the Bringin Village Animal Market are not sufficient for the living provided by their husbands and what is the perspective of the Compilation of Islamic Law, article 80 concerning the husband's obligations and article 83 concerning the wife's obligations. This research is empirical juridical research using a field approach. The data collection methods used are interviews and documentation, then data processing methods with editing, classification, verification, analysis and conclusion stages.

The results of this research show that the application of the Compilation of Islamic Law article 80 concerning the husband's obligations in the goat trader's family has been implemented as well as possible. However, in the Compilation of Islamic Law, article 83 concerning the obligations of wives, there are several wives of goat traders who have not carried out their obligations as wives as stated in that article.

الدعم واجب على الزوج. ومع ذلك، في واقع الحياة، هناك أنواع مختلفة من المهن والدخول التي يمتلكها الزوج والزوجة. إحدى المهن الشائعة جدًا في إندونيسيا هي تجار الماعز، أي الأشخاص الذين يبيعون الماعز الحي أو لحم الماعز في الأسواق أو أماكن أخرى. عادة ما يكون لدى تجار الماعز رأس مال محدود، لذا فإن دخلهم غير مؤكد ويعتمد على الطلب في السوق. وهذا يؤثر بالتأكيد على قدرتهم على إعالة أسرهم. توجد في عائلة تاجر الماعز طريقة فريدة لتقديم الدعم من الزوج إلى الزوجة.

يركز هذا البحث على معرفة سبب عدم كفاية بعض زوجات تجار الماعز في سوق الحيوانات بقرية برينجين للمعيشة التي يوفرها أزواجهن، وما هو منظور مجمع الشريعة الإسلامية، المادة 80 المتعلقة بنفقة الزوج؟ الالتزامات والمادة 83 المتعلقة بالتزامات الزوجة. هذا البحث هو بحث فقهي تجريبي باستخدام المنهج الميداني. وأساليب جمع البيانات المستخدمة هي المقابلات والتوثيق، ثم أساليب معالجة البيانات بمراحل التحرير والتصنيف والتحقق والتحليل والاستنتاج.

وتشير نتائج هذا البحث إلى أن تطبيق المادة 80 من مجمع الشريعة الإسلامية المتعلقة بالتزامات الزوج في أسرة تاجر الماعز قد تم تنفيذه على أكمل وجه ممكن. إلا أنه في كتاب الشريعة الإسلامية، المادة 83 المتعلقة بالتزامات الزوجات، هناك عدة زوجات لتجار الماعز لم يقوموا بالتزاماتهم كزوجات كما ورد في تلك المادة.
