Abstract
ABSTRACT
Islam maintains and views the importance of wedding, and even suggests it based on the basis of religion, moral, and social. Allah S.W.T creates His creatures in pairs, among them are humans, man and woman. Between man and woman there is an instinct of mutual need, mutual dependent, love and care each other. It is instituted in a wedding. This wedding institution makes their relationship legal, and also the relationship between man and woman among the Creator, family, relatives, and the society as a whole. In this way, it is also created particular limits between a man and other women except his wife, as well as a woman and other men except her husband. Whereas in the wedding establishment it is not detached from cultural social or social culture of the society that sometimes is still cultivated. One of our cultural tradition examples, which still exist, is: The walagara tradition of Moslem society in Jetak Village Sukapura District Probolinggo Regency.
Based on the research, the researcher formulates the problems, which are: How is the walagara tradition of Moslem society in Jetak, Sukapura District Probolinggo Regency? Second, What are the factors that base the walagara tradition of Moslem society in Jetak, Sukapura District Probolinggo Regency? And How is Islamic Law Perspective toward the walagara tradition of Moslem society in Jetak, Sukapura District Probolinggo Regency? And the kind of research used by the researcher is: Qualitative Research. Then, to guarantee the totality and data validity, the researcher uses Documentation and interview method. While, to analyze the data collected, the researcher uses Descriptive Qualitative method.
According to the result of the research, it can be found that the walagara tradition of Moslem society in Jetak, Sukapura, District Probolinggo Regency is: part of tafwidh marriage, which is: one of some marriages that are prohibited by Islam religion. And Tafwidh marriage is: a marriage in which inside the agreement is not mentioned or stated the willingness to pay the bride price by the groom to the bride.
