Efektivitas layanan jemput pihak ambil produk atau JEPRO sebagai implementasi asas Contante Justitie: Studi di Pengadilan Agama Lumajang

ABSTRAK

Program layanan JEPRO (Jemput Pihak Ambil Produk) sebagai inovasi unggulan Pengadilan Agama Lumajang hadir dalam rangka meningkatkan mutu pelayanan kepada para pencari keadilan yang datang di Pengadilan Agama Lumajang, adanya keluhan dari para pihak yang merasa keberatan untuk mengambil produk di kantor Pengadilan karena rumah yang jauh menjadikan layanan ini sebagai jawaban penyelesaian keluhan para pihak, sehingga dalam implementasinya dapat menerapkan asas contante justitie. Layanan Jemput Pihak Ambil Produk dilaksanakan pertama kali di Pengadilan Agama Lumajang pada bulan Juni 2021 dan masih terus berjalan hingga saat ini. Dasar hukum Pengadilan Agama Lumajang membuat layanan JEPRO (Jemput Pihak Ambil Produk) adalah Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik dan Peraturan Menteri Pendayagunaan Aparatur Negara dan Reformasi Birokrasi Nomor 1 Tahun 2015 tentang Pedoman Evaluasi Kinerja Penyelenggara Pelayanan Publik.

Jenis penelitian dalam skripsi ini menggunakan jenis penelitian hukum empiris dengan pendekatan sosiologi hukum. Tujuan dari penelitian ini adalah untuk menganalisis efektivitas layanan jemput pihak ambil produk sebagai implementasi asas contante justitie. Pengumpulan data di lapangan dengan wawancara dan dokumentasi. Sedangkan metode pengelolaan data menggunakan edit, klasifikasi, analisis dan kesimpulan.

Hasil penelitian ini yaitu: dalam pelaksanaan pelayanan Jemput Pihak Ambil Produk sebagai implementasi asas contante justitie di Pengadilan Agama Lumajang.sudah sesuai dengan SOP (Standar Operasional Prosedur), masyarakat yang akan mengambil produk pengadilan seperti akte cerai dan salinan putusan, tidak perlu datang ke kantor Pengadilan melainkan datang ke Kantor Balai Desa terdekat yang sudah dijadwalkan untuk diadakan layanan JEPRO. Kemudian untuk efektivitas pelayanan JEPRO sebagai implementasi asas Contante Justitie atau asas cepat, sederhana, dan biaya ringan di Pengadilan Agama Lumajang sudah dapat dikatakan efektif. Asas cepat dan sederhana sudah terlaksana dengan baik pada layanan JEPRO. Namun, dari asas biaya ringan, walaupun sudah dapat meminimalisir biaya transportasi masyarakat, tetapi bagi petugas JEPRO masih terdapat kekurangan dalam biaya anggaran untuk memenuhi sarana dan fasilitas JEPRO.

ABSTRACT

The JEPRO service program (Pick Up Parties to Take Products) as a superior innovation of the Lumajang Religious Court is present in order to improve the quality of service to justice seekers who come to the Lumajang Religious Court, there are complaints from parties who object to picking up products at the Court's office because the house is far away make this service an answer to the resolution of complaints from the parties, so that in its implementation it can apply the principle of contante justitie. The Pick Up Service for Product Pick Up was first implemented at the Lumajang Religious Court in June 2021 and is still running to date. The legal basis for the Lumajang Religious Court to make the JEPRO service (Pick Up Parties Take Products) is Law Number 25 of 2009 concerning Public Services and Regulation of the Minister of Administrative Reform and Bureaucratic Reform Number 1 of 2015 concerning Guidelines for Evaluation of the Performance of Public Service Providers.

The type of research in this thesis uses empirical legal research with a legal sociology approach. The purpose of this research is to analyze the effectiveness of the pick-up service to take the product as an implementation of the contante justitie principle. Data collection in the field with interviews and documentation. While the method of data management using editing, classification, analysis and conclusions.

The results of this study are: in the implementation of Pick Up Services for Products as an implementation of the contante justitie principle at the Lumajang Religious Court. It is in accordance with the SOP (Standard Operating Procedure), people who will take court products such as divorce certificates and copies of decisions, do not need to come to the office Instead, the court came to the nearest village hall office where the JEPRO service was scheduled to be held. Then, the effectiveness of JEPRO services as an implementation of the principle of Contante Justitie or the principle of fast, simple and low cost in the Lumajang Religious Court can be said to be effective. The fast and simple principle has been implemented well in the JEPRO service. However, from the principle of low costs, even though it has been possible to minimize public transportation costs, for JEPRO officers there is still a shortage in budget costs to meet JEPRO facilities and infrastructure.
