Politik hukum pemindahan Ibu Kota Negara dalam masa transisi prespektif Maslahah Mursalah

ABSTRAK:

Pemindahan ibu kota negara memiliki dampak besar dari segi sosial, ekonomi, dan politik negara. Dalam perjalanan pemindahan Ibu Kota di masa transisi, akan banyak sekali produk hukum dan kebijakan hukum dari pemindahan Ibu Kota Negara. Tujuan penelitian ini bertujuan menganalisa dan mendeskripsikan Politik hukum apa saja yang mempengaruhi Pemindahan Ibu Kota Negara dalam masa Transisi ditinjau dari prespektif Maslahah Mursalah.
Jenis Penelitian ini adalah Yuridis Normatif, dengan menggunakan dua pendekatan penelitian yakni Statute Approach ( Perundang-undangan) berupa Undang-undang No 3 tahun 2022 tentang Ibu Kota Negara, dan Pendekatan Konseptual Conceptual Approach dengan mengunakan Maslahah Mursalah. Bahan hukum penelitian ini diantaranya: bahan hukum primer seperti Peraturan Undang-Undang No 3 tahun 2022 dan aturan turunan lainnya, bahan sekunder berupa hasil karya ilmiah yang membahas IKN, dan bahan tersier berupa pendapat ahli tentang IKN. Penelitian ini mengunakan analis yuridis kualitatif.
Hasil penelitian 1). Kebijakan Hukum Pemindahan Ibu Kota Negara pada masa transisi menghasilkan Kebijakan dengan pembuatan regulasi Undang-Undang yang menghasilkan dasar hukum yang kuat dalam pelaksanaan pemindahan ibu kota, selanjutnya Kebijakan terhadap penyelengaraan Ibu Kota Negara seperti pembentukan tim transisi yang memudahkan proses pemindahan, proses pembangunan yang menghasilkan proses dari pembangunan IKN, kebijakan anggaran dan investasi yang cermat menjadi pilar dalam menjaga keberlanjutan proyek ibu kota negara, dan kebijakan yang dilakukan Otorita yang memiliki peranan penting dalam proses pembangunan ; 2) Kebijakan Hukum Pemindahan Ibu Kota Negara pada masa Transisi prespektif Maslahah Mursalah, telah memenuhi aspek kemaslahatan, seperti kemaslahatan pada proses pemindahan dan proses pembangunan yang masih berlanjut.

ABSTRACT:

The relocation of the country's capital has a major impact on the country's social, economic, and political aspects. In the course of relocating the capital city during the transition period, there will be many legal products and legal policies resulting from the relocation of the national capital. The aim of this research is to analyze and describe what legal politics influence the relocation of the National Capital during the Transition period from the perspective of Maslahah Murlah.
This research employs Normative Jurisdiction and utilizes two different approaches: the Statute Approach (Legislation) in the form of Law No. 3 of 2022 concerning the National Capital, and the Conceptual Approach using Maslahah Murlah. The primary legal materials used in this research include Law No. 3 of 2022 and other derivative regulations, while the secondary materials consist of scientific works discussing IKN. Additionally, tertiary materials in the form of expert opinions about IKN are also employed. The research methodology employs qualitative juridical analysis to analyze the data.
Research results 1). The Legal Policy for the Transfer of the National Capital during the transition period resulted in a Policy with the creation of statutory regulations which produced a strong legal basis for implementing the transfer of the capital city, then the Policy for the administration of the National Capital such as the formation of a transition team which facilitated the transfer process, a development process which resulted in a from IKN development, careful budget, and investment policies are pillars in maintaining the sustainability of the national capital project, and policies carried out by the Authority have an important role in the development process; 2) The legal policy for moving the national capital during the transition period from the Maslahah Murlah perspective has fulfilled the benefit aspect, such as the benefit of the transfer process and the ongoing development process.

نقل عاصمة البلاد له تأثير كبير على الاجتماعية والاقتصادية والسياسية. في نقل العاصمة في الفترة الانتقالية، سيكون الكثير من القانونية وللسياسات. يهدف الغرض من هذه الدراسة إلى تحليل ووصف السياسات القانونية التي تؤثر على انتقال عاصمة الولاية في الفترة الانتقالية بالمنظور مصلح مرسلة.

نتائج البحث ١). أسفرت السياسة القانونية لنقل العاصمة لخلال الفترة الانتقالية عن سياسات عن لوائح قانونية أسفرت من أساس قانوني قوي في تنفيذ نقل العاصمة، ثم سياسات بشأن تنظيم العاصمة مثل تشكيل فريق انتقالي يسهل النقل، مما أدى إلى قاعدة قانونية قوية على تنفيذ نقل العاصمة، ثم سياسات تنظيم العاصمة مثل تشكيل فريق انتقالي يسهل النقل, والسياسات التي تقوم بها الهيئة لها دور مهم في التنمية؛ ٢) السياسة القانونية لنقل عاصمة البلاد في الفترة الانتقالية المستقبلية بالمصلحة مرسلة، قد استوفت جوانب المنفعة، كالاستفادة من النقل و التنمية المستمرة
