Hak istri dalam keluarga modern: Studi komparasi pemikiran Wahbah Al-Zuhaili dan Sayyid Alawi Al-Maliki

ABSTRAK

Pembicaraan tentang istri akan selalu menarik antar golongan–tua atau pun muda. Banyak aspek menyangkut hak-hak istri, dengan menimbulkan perbedaan yang dilatar belakangi oleh kehidupan, kebiasaan masyarakat dan perkembangan zaman. Tak jarang pendapat diantara pemikir, dan ulama sejak dahulu hingga kini berbeda. Aneka tetapi tak jarang dijumpai oknum yang cendrung mentafsirkan konsep-konsep hak-hak istri sesuai dengan keperluannya sendiri. sehingga membiarkan seolah lelaki berjalan sendiri bagaikan tidak membutuhkan perempuan, ada pula yang sebaliknya.faktor inilah kemudian perlu untuk dikaji kembali kaitannya dengan hak-hak istri diera modern supaya tidak terjadi problematika baru dalam konteks hak-hak istri diera modern saat ini.

Adapun metode penelitian ini menggunakan jenis penelitian normatif, dengan pendekatan pustaka. Adapun hasilnya dijabarkan kedalam bentuk data yang bersifat deskriptif kuantitatif. Adapun Data yang digunakan data primer didapatkan melalui pemikiran Wahbah az-Zuhaili dan Sayyid Alwi al-Maliki. Terkait dengan konsep hak-hak istri di era modern. Sedangkan data sekunder didapatkan dari buku, jurnal, skripsi, tesis dan litelatur penunjang lainnya.

Hasil penenelitian ini mengungkapkan bahwa perbedaan dalam pengaturan terhadap hak-hak istri yang dapat dilihat dari beberapa indikator dalam konsep yang dibawa oleh Wahbah az-Zuhaili yang diatur secara rinci terkait dengan hak-hak istri, sedangkan pengaturan terkait hak-hak istri dalam konsep yang dibawakan oleh Sayyid Muhammad Alwi Al Maliki cendrung pengaturan secara umum, bahkan ada beberapa multitafsir dalam pelegalan hadist yang dijadikan oleh masyarakat diera modrnn pada saat ini, sebagai legalitas untuk menintimidasi kaum-kaum permpuan.

Many aspects concern the rights of the wife, by causing a variety of perceptions among thinkers, and scholars from ancient to the present. . This research method uses a normative type of research, with a library approach. The results are described into the form of data that is quantitative descriptive. The data used primary data is obtained through the thoughts of Wahbah az-Zuhaili and Sayyid Alwi al-Maliki. Related to the concept of wife rights in the modern era. While secondary data is obtained from books, journals, thesis, thesis and other supporting litelatur.
