Hak politik penyandang disabilitas menjadi calon anggota Legislatif (studi peraturan perundang-undangan di Indonesia)

Hak politik menjadi calon anggota legislatif merupakan salah satu hak asasi manusia yang harus dilindungi dan dijamin pelaksanaannya oleh negara. Setiap warga negara, termasuk penyandang disabilitas berhak menjadi calon anggota legislatif jika memenuhi persyaratan. Namun, regulasi yang mengatur persyaratan penyandang disabilitas tentunya tidak bisa sama dengan yang bukan penyandang disabilitas. Harus ada aturan yang khusus yang dapat mengakomodir hak penyandang disabilitas. Dengan regulasi yang lebih jelas maka hak penyandang disabilitas semakin terakomodir dan regulasi persyaratan kelayakan menjadi calon anggota legislatif semakin tegas. Penelitian ini bertujuan mengkaji hal tersebut berdasarkan regulasi yang ada dan konsep Ahl al-Hall wa al-’Aqd. Oleh karena itu, penelitian ini berupaya melakukan penelitian hukum normatif untuk mengkaji hal tersebut. penelitian ini menggunakan pendekatan peratura perundang-undangan dan penelitian konseptual. Peraturan perundang-undangan yang mengatur hak politik penyandang disabilitas menjadi calon anggota legislatif dianalisis dengan konsep Ahl al-Hall wa al-’Aqd. Hasilnya menemukan bahwa penyandang disabilitas berhak menjadi calon anggota legislatif selama memiliki kemampuan intelektual dan kebijaksanaan. Kemampuan tersebut tidak bisa dimiliki oleh semua penyandang disabilitas, terutama disabilitas mental dan intelektual. Oleh karena itu, penyandang disabilitas mental dan intelektual berdasarkan konsep ini tidak memenuhi persyaratan menjadi calon anggota legislatif.

The political right to be a candidate for the Legislature is one of the human rights that must be protected and guaranteed by the state. Every citizen, including people with disabilities, has the right to become a candidate for the legislature if they meet the requirements. However, the regulations governing the requirements for people with disabilities, of course, cannot be the same as for non-disabled people. There must be specific rules that accommodate the rights of people with disabilities. With clearer regulations, the rights of people with disabilities are increasingly accommodated, and the regulation of eligibility requirements to become candidates for legislative seats is becoming more firm. This study aims to assess this based on existing regulations and the concept of Ahl al-Hall wa al-’Aqd. Therefore, this study seeks to conduct normative legal research to examine this. This study uses the approaches of legislation and conceptual research. Legislation governing the political rights of persons with disabilities to become candidates for the legislature was analyzed by the concept of Ahl al-Hall wa al-’Aqd. The results found that people with disabilities have the right to be candidates for legislative seats as long as they have intellectual ability and wisdom. This ability cannot be possessed by all people with disabilities, especially those with mental and intellectual disabilities. Therefore, people with mental and intellectual disabilities based on this concept do not meet the requirements to be candidates for the Legislature.
