Pemenuhan nafkah keluarga Anak Buah Kapal (ABK) perspektif kitab Fathul Qarib dan undang undang no. 1 tahun 1974:Studi di Desa Kedungrejo Kecamatan Muncar Kabupaten Banyuwangi

ABSTRAK

Desa Kedungrejo merupakan wilayah pesisir yang terdapat di wilayah Kecamatan Muncar. Perekonomian masyarakatnya bergantung kepada hasil laut yang didapatkan. Sedangkan hasil laut sendiri tidak menentu perolehannya, tergantung musim dan tidaknya ikan. acuan musim dan tidaknya ikan ialah Bulan. Suami yang berprofesi sebagai anak buah kapal pada saat tidak musim ikan tidak mendapatkan penghasilan karena kapalnya tidak pergi berlayar. adanya kondisi yang seperti itu membuat istri anak buah kapal turut membantu suaminya dalam memenuhi nafkah keluarga. tujuan dari penelitian ini ialah untuk mengetahui bagaimana upaya pemenuhan nafkah keluarga anak buah kapal di Desa Kedungrejo. Selain itu, bagaimana pemenuhan nafkah keluarga anak buah dalam perspektif kitab fathul Qarib dan Undang Undang No.1 Tahun 1974.

Penelitian ini termasuk dalam jenis penelitian yuridis empiris dengan pendekatan yuridis sosiologis . Lokasinya berada di Desa Kedungrejo Kecamatan Muncar Kabupaten Banyuwangi. Sumber data yang digunakan yaitu sumber data primer berupa wawancara dengan Anak Buah Kapal dan istrinya dan sumber data sekunder berupa buku Psikologi Keluarga Islam Karangan Mufidah, Ch, Fiqhul Islam Wa Adillatuhu Karangan Syekh Wahbah Zuhaili dan Fathul Qarib Al Mujib Karangan Muhammad bin Qasim Al-Ghazi. Adapun metode pengumpulan datanya menggunakan metode wawancara dengan ABK dan Istrinya, dan metode dokumentasi berupa foto serta profil desa kedungrejo.

Hasil dari penelitian ini ditemukan bahwa Upaya suami yang bekerja sebagai ABK dalam memenuhi nafkah keluarga bisa terpenuhi dengan adanya musim ikan. dan Ketika tidak musim ikan pendapatan suami hanya bisa mencukupi biaya makan dan Pendidikan anak. Upaya yang dilakukan istri dalam memenuhi nafkah keluarga dengan bekerja sebagai Karyawan, Pedagang, dan asisten rumah tangga. Pemenuhan nafkah keluarga ABK perspektif kitab fathul Qarib yang sesuai adalah nafkah makanan, pakaian, dan tempat tinggal. yang tidak sesuai adalah nafkah Asisten Rumah Tangga, dan perabot rumah tangga. Dalam perspektif Undang Undang No.1 Tahun 1974 yang sesuai dari aturan nafkah didalamnya adalah nafkah makanan, pakaian, tempat tinggal, biaya Pendidikan anak. Untuk yang tidak sesuai adalah nafkah perabot rumah tangga.

ABSTRACT

Kedungrejo Village is a coastal area located in the Muncar District. The people's economy depends on the marine products they get. While the results of the sea itself are uncertain, depending on the season and whether or not the fish. reference for the season and whether or not the fish is the Moon. A husband who works as a ship's crew during the non-fishing season does not get income because his ship does not go sailing. the existence of such conditions makes the wife of the ship's crew help her husband in fulfilling the family's living. the purpose of this study is to find out how the efforts to fulfill the family livelihood of ship crew in Kedungrejo Village. In addition, how is the fulfillment of the family income of subordinates in the perspective of the book fathul Qarib and Law No. 1 of 1974.

This research is included in the type of empirical juridical research with a sociological juridical approach. The location is in Kedungrejo Village, Muncar District, Banyuwangi Regency. The data sources used are primary data sources in the form of interviews with the ship's crew and their wives and secondary data sources in the form of Islamic Family Psychology books by Mufidah, Ch, Fiqhul Islam Wa Adillatuhu written by Syekh Wahbah Zuhaili and Fathul Qarib Al Mujib written by Muhammad bin Qasim Al-Ghazi . The data collection method uses interviews with crew members and their wives, and documentation methods in the form of photos and profiles of the village of Kedungrejo.

The results of this study found that the efforts of husbands who work as crew members in fulfilling family income can be fulfilled by the fishing season. and when the fishing season is not in season, the husband's income can only cover the cost of food and children's education. Efforts made by the wife to provide for the family by working as employees, traders, and household assistants. Fulfillment of the ABK family's income according to the perspective of the book of fathul Qarib which is appropriate is the maintenance of food, clothing, and shelter. what is not appropriate is the household assistant's living, and household furniture. In the perspective of Law No. 1 of 1974, the rules for subsistence include food, clothing, shelter, and children's education expenses. What is not suitable is household furniture.
