Fenomena peningkatan Wali Hakim di Kantor Urusan Agama Kecamatan Blimbing

ABSTRAK

Kantor Urusan Agama Blimbing merupakan KUA revitalisasi (percontohan) bagi KUA di seluruh Indonesia, terkhusus di Provinsi Jawa Timur. Di KUA Kecamatan Blimbing selama bulan Januari hingga Juli 2022 terjadi peningkatan pernikahan dengan wali hakim dengan sebab-sebab tertentu. Sedangkan, di bulan yang sama pada tahun sebelumnya, angka pernikahan dengan wali hakim juga meningkat, namun pada tahun 2022 terjadi peningkatan pernikahan dengan wali hakim yang lebih dari tahun 2021. Dengan demikian, penelitian ini bertujuan untuk menjelaskan fenomena penggunaan wali hakim selama bulan Januari hingga Juli 2022 di Kantor Urusan Agama Kecamatan Blimbing dan untuk menganalisis tinjauan Madzhab Syafi’i terhadap fenomena peningkatan wali hakim di Kantor Urusan Agama Kecamatan Blimbing.

Penelitian ini adalah jenis penelitian empiris dengan menggunakan pendekatan kualitatif. Sedangkan metode pengumpulan datanya menggunakan data primer berupa wawancara dengan subjek yang bersangkutan dan data sekunder dari buku-buku yang memiliki keterkaitan dengan penelitian ini yang kemudian data tersebut diedit, diperiksa, dan disusun secara cermat serta diatur sedemikian rupa yang kemudian dianalisis. Adapun rumusan masalah di dalam penelitian ini ada dua, yakni: bagaimana fenomena peningkatan wali hakim selama bulan Januari hingga Juli 2022 di KUA Kecamatan Blimbing, dan bagaimana tinjauan Madzhab Syafi’i terhadap fenomena peningkatan wali hakim di KUA Kecamatan Blimbing.

Hasil penelitian menjelaskan dua kesimpulan. Pertama, fenomena peningkatan wali hakim di KUA Kecamatan Blimbing terjadi peningkatan yakni sebanyak 90 kasus daripada tahun sebelumnya sebanyak 77 kasus dengan sebab adam wali, ba’da dukhul, ghaib, non-muslim, tidak syar’i, dan adhal. Kedua, tinjauan Madzhab Syafi’i terhadap fenomena peningkatan wali hakim di KUA Kecamatan Blimbing sesuai dengan penerapan di KUA Kecamatan Blimbing.

ABSTRACT

The Blimbing Religious Affairs Office is a revitalization KUA (pilot) for KUA throughout Indonesia, especially in East Java Province. At the KUA of Blimbing District from January to July 2022 there was an increase in marriages with judges' guardians for certain reasons. Meanwhile, in the same month in the previous year, the number of marriages with the judge's guardian also increased, but in 2022 there was an increase in marriages with the judge's guardian which was more than in 2021. Thus, this study aims to explain the phenomenon of using the judge's guardian from January to July 2022 at the Blimbing District Religious Affairs Office and to analyze the Syafi'i Madzhab's review of the phenomenon of an increase in the number of guardians of judges at the Blimbing District Religious Affairs Office.

This research is a type of empirical research using a qualitative approach. While the method of data collection uses primary data in the form of interviews with the subject concerned and secondary data from books that are related to this research which are then edited, examined, and carefully arranged and arranged in such a way which are then analyzed. There are two formulations of the problem in this study, namely: how is the phenomenon of increasing guardian judges from January to July 2022 at KUA Blimbing District, and what is the review of the Syafi'i Madzhab on the phenomenon of increasing guardian judges at KUA Blimbing District.

The results of the study explain two conclusions. First, the phenomenon of an increase in the number of guardian judges at the KUA in Blimbing District has increased, namely as many as 90 cases compared to the previous year of 77 cases with the following reasons:adam wali, don't give everything, unseen, non-Muslim, not syar'i, andgo. Second, the review of the Syafi'i Madzhab on the phenomenon of increasing guardian judges at the Blimbing District KUA in accordance with the implementation at the Blimbing District KUA.

هذا البحث هو نوع من البحث التجريبي باستخدام نهج نوعي. بينما تستخدم طريقة جمع البيانات البيانات الأولية في شكل مقابلات مع الموضوع المعني وبيانات ثانوية من الكتب ذات الصلة بهذا البحث والتي يتم بعد ذلك تحريرها وفحصها وترتيبها وترتيبها بعناية بحيث يتم تحليلها بعد ذلك. هناك صيغتان للمشكلة في هذه الدراسة، وهما: ما هي ظاهرة زيادة قضاة أولياء الأمور من يناير إلى يوليو 2022 في مكتب للشؤون الدينية منطقة بليمبينج، وما هي مراجعة المذهب الشافعي لظاهرة زيادة قضاة أولياء الأمور في مكتب للشؤون الدينية منطقة بليمبينج.

نتائج الدراسة تشرح نتيجتين. أولاً، ازدادت ظاهرة زيادة عدد قضاة أولياء الأمور في مكتب للشؤون الدينية بمقدار 90 قضية مقارنة بالعام السابق البالغ 77 قضية بسبب آدم والي ، وبدا دخول ، وغير المرئي، وغير المسلم، وليس السوري. أنا وعذال. ثانياً، مراجعة المذهب الشافعي لظاهرة زيادة قضاة أولياء الأمور في مكتب للشؤون الدينية منطقة بليمبينج وفقًا للتنفيذ في مكتب للشؤون الدينية منطقة بليمبينج.
