Implementasi MOU nomor W13-A17/233/Hm.00/SK/4/2021 tentang bimbingan konseling bagi calon pasangan pernikahan dini perspektif Maslahah Mursalah: Studi di Pengadilan Agama Gresik

ABSTRAK

Majelis Ulama Indonesia pada umumnya berperan sebagai lembaga mufti. MUI juga berperan khusus sebagai konselor karena fenomena tingginya kasus dispensasi nikah dan kekhawatiran akan dampak yang ditimbulkannya. Penelitian ini berfokus pada peran MUI dalam memberikan bimbingan konseling bagi calon pasangan pernikahan dini dan pandangan hakim terkait peran mui tersebut berdasarkan teori maslahah mursalah.

Penelitian ini termasuk dalam jenis penelitian hukum empiris dengan pendekatan yuridis sosiologis. Lokasi penelitianya di Pengadilan Agama Gresik. Sumber data yang digunakan ialah sumber data primer berupa wawancara dan sumber data sekunder berupa buku, jurnal, peraturan perundang-undangan, dan sumber dari media elektronik. Adapun metode pengumpulan data penelitian ini menggunakan wawancara dan dokumentasi.

Dalam penelitian ini bertujuan untuk menganalisis peran MUI dalam memberikan bimbingan konseling bagi calon pasangan pernikahan dini. Selain itu, penelitian ini juga bertujuan untuk menganalisis pandangan hakim terhadap peran MUI tersebut berdasarkan teori maslahah mursalah. Majelis Ulama Indonesia memiliki tugas sebagai pembimbing dan pelayan umat, sehingga dengan tingginya angka dispensasi nikah MUI juga ikut serta dalam memberikan bimbingan konseling bagi calon pasangan pernikahan dini. Adanya peran MUI ini sangatlah membantu hakim dalam hal kepenasehatan bagi calon pasangan pernikahan dini. Adapun berdasarkan teori maslahah mursalah, bahwa program bimbingan konseling ini merupakan sesuatu yang mendatangkan kemanfaatan dan menolak kemudharatan, sehingga sesuai dengan tujuan-tujuan syara’.

Penelitian ini menghasilkan kesimpulan bahwa: (1) MUI berperan sebagai pembimbing dan pelayan umat, sehingga ikut serta dalam meminimalisasi tingginya dispensasi nikah. (2) Bimbingan konseling oleh MUI sangatlah membantu hakim dalam hal kepenasehatan dalam perkara dispensasi nikah dan jika ditinjau dari maslahah mursalah program ini sangatlah bermanfaat bagi calon pasangan pernikahan dini meskipun tidak ada dalil atau petunjuk yang memperhatikan maupun menolaknya.

ABSTRACT

The Indonesian Ulama Council generally acts as a mufti, namely giving fatwas, but with the high number of cases of dispensation of marriage and concerns about the impact it will cause. This study focuses on the role of the MUI in providing counseling guidance for prospective couples in early marriage and the views of judges regarding the role of the mui based on the theory of maslahah mursalah.

This research is included in the type of empirical legal research with a sociological juridical approach. The research location is at the Gresik Religious Court. The data sources used are primary data sources in the form of interviews and secondary data sources in the form of books, journals, laws and regulations, and sources from electronic media. The research data collection method uses interviews and documentation.

In this study aims to analyze the role of the MUI in providing counseling guidance for prospective couples in early marriage. In addition, this study also aims to analyze the views of the judges on the role of the MUI based on the maslahah mursalah theory. The Indonesian Ulema Council has the task of being a guide and servant of the people, so that with the high rate of marriage dispensation, the MUI also participates in providing counseling guidance for prospective couples for early marriage. The existence of the MUI's role is very helpful for judges in terms of advisory for prospective couples in early marriage. Meanwhile, based on the maslahah mursalah theory, this guidance and counseling program is something that brings benefits and rejects harm, so that it is in line with syara' goals.

This research resulted in the conclusion that: (1) MUI acts as a guide and servant of the people, so that it participates in minimizing the high dispensation of marriage. (2) Counseling guidance by the MUI is very helpful to judges in terms of advisory in marriage dispensation cases and if viewed from the maslahah mursalah this program is very beneficial for prospective couples in early marriage.

يعمل مجلس العلماء الإندونيسي بشكل عام كمفتي ، أي إعطاء الفتاوى ، ولكن مع ارتفاع عدد حالات الإعفاء من الزواج والمخاوف بشأن التأثير الذي سيحدثه. تركز هذه الدراسة على دور MUI في تقديم التوجيه الإرشادي للأزواج المحتملين في الزواج المبكر ووجهات نظر القضاة فيما يتعلق بدور. يدخل هذا البحث في نوع البحث القانوني التجريبي بمنهج قانوني اجتماعي. موقع البحث في محكمة غريسيك الدينية. مصادر البيانات المستخدمة هي مصادر البيانات الأولية في شكل مقابلات ومصادر بيانات ثانوية في شكل كتب ومجلات وقوانين وأنظمة ومصادر من وسائل الإعلام الإلكترونية. تستخدم طريقة جمع بيانات البحث المقابلات والتوثيق.

تهدف هذه الدراسة إلى تحليل دور MUI في تقديم التوجيه الإرشادي للأزواج المحتملين في الزواج المبكر وتحليل آراء القضاة حول دور MUI بناءً على نظرية المصلحة المرسلة. إن وجود دور MUI مفيد جدًا للقضاة من حيث تقديم المشورة للأزواج المحتملين في الزواج المبكر. وفي الوقت نفسه ، واستناداً إلى نظرية المصلحة المرسلة ، فإن برنامج التوجيه والإرشاد هذا هو ما يجلب الفوائد ويرفض الضرر ، بحيث يتماشى مع أهداف سياسة.

نتج عن هذا البحث استنتاج مفاده أن: (1) MUI تعمل كدليل وخادم للناس ، بحيث تشارك في التقليل من الإعفاء العالي للزواج. (2) الإرشاد الإرشادي من MUI مفيد جدًا للقضاة من حيث تقديم المشورة في قضايا الإعفاء من الزواج ، وإذا تم النظر إليه من مصلحة مرسلة ، فإن هذا البرنامج مفيد جدًا للأزواج المحتملين في الزواج المبكر.
