Upaya istri dalam pemenuhan hak-hak anak Pasca Cerai Gugat: Studi di Desa Kaliuntu Kecamatan Jenu Kabupaten Tuban

ABSTRAK

Hak anak merupakan hal yang wajib dipenuhi oleh orang tua. Hak tersebut harus dipenuhi pada saat orang tua dalam keadaan bersama maupun sudah cerai. Hak-hak anak yang wajib dipenuhi telah tercantum dalam fiqh maupun undang-undang. Tingginya cerai gugat Di Desa Kaliuntu Kecamatan Jenu Kabupaten Tuban memberikan dampak negatif terhadap anak. Sebab setelah cerai, ayah tidak lagi melaksanakan kewajibannya sebagai orang tua. Hal tersebut menjadikan istri memiliki peran ganda, yaitu tidak hanya menjadi seorang ibu, tetapi merangkap pula sebagai ayah.

Tujuan dari penelitian ini adalah untuk menjelaskan cara istri dalam memenuhi hak anak setelah cerai gugat di Desa Kaliuntu Kecamatan Jenu Kabupaten Tuban. Penjelasan berikutnya adalah upaya istri untuk memenuhi nafkah anak setelah ayah tidak lagi memenuhi kewajibannya.

Metode penelitian yang digunakan adalah meliputi jenis penelitian empiris dengan pendekatan kualitatif. Pendekatan kualitatif merupakan pendekatan yang menghasilkan data deskriptif. Pengumpulan data menggunakan sumber data primer berupa wawancara dan dilengkapi dengan data sekunder. Melalui wawancara dari beberapa informan untuk memperoleh jawaban sebagai pemecah permasalahan penelitian ini dan diperkuat dengan dokumentasi saat wawancara. Sedangkan data sekunder berasal dari literatur buku dan skripsi. Kemudian data tersebut diolah dengan diedit, diklasifikasi, diverifikasi, dianalisis, dan terkahir disimpulkan.

Hasil dari penelitian ini diperoleh dua kesimpulan bahwa : 1) Meskipun ayah tidak melaksankan kewajibannya, anak merasa tidak kurang kasih sayang dari ibunya. Anak masih bisa bersekolah meskipun kebutuhan sehari hari sepenuhnya belum mencukupi dan sebagian hak anak lainnya telah dipenuhi oleh ibu. 2) Upaya yang dilakukan oleh istri untuk menafkahi anak adalah bekerja, dan sebagian ditanggung keluarga dari pihak ibu.

ABSTRACT

The children’s right is a matter that must be fulfilled by parents. The right must be fulfilled when parents are both shared and divorced. Children's rights that must be fulfilled are stated in the fiqh and the law.The height of divorce in Village of Kaliuntu, District of Jenu, City of Tuban has a negative impact on children. Because after divorce, father no longer perform his duties as a parent. It makes wife has a dual role. which she does not only be a mother, but also as a father

The purpose of this study is to explain how the wife fulfillies the rights of the child after the divorce in the Kaliuntu Village, Jenu District, Tuban Regency. And next explanation is wife's efforts to fulfill the needs of children after father no longer fulfill his obligations.

The research method which is used is an empirical research method with qualitative approach. Qualitative approach is an approach that produces descriptive data. Data collection is using primary data source in the form of interview and completed with secondary data. Through interviews from several informants to obtain answers as a solution to this research problem and reinforced with documentation during the interview. While the secondary data is taken from book literature and thesis. Then the data is processed through editing, classifying, verifying, analyzing, and finally concluding.

The results of this study obtained two conclusions and both are: 1) Although father does not carry out his obligations, child feels no less affection from his mother. Children can still attend school although their daily needs have not been fully met and some of child’s rights have been fulfilled by mother. 2) Effort which is made by wife to support the child is working, and partly covered by the mother’s family.

يجب على والدين أن يحقق حقوق الأطفال عندما والدين معية أو مفارقة. حقوق الطفل التي يجب الوفاء بها واردة في الفقه والقانون. ارتفاع الطلاق في قرية كالييونتو جينو توبان له تأثير سلبي إلى الأطفال. لأنه بعد ما مطلقة، لن يقوم الوالد بموجب. ولذالك يملك الزوجة دورة متعددة. وأخيرا، ليس فقط أن تكون أما ولكن أيضا أبا.

أهداف البحث فهي: لكيفية طريقة الزوجة في تحقيق حقوق الأطفال بعد ما مطلقة في قرية كاليونتو ، مقاطعة جنو ، توبان ريجنسي. الشرح التالي هو يسعى الزوجة ليحقق ريع الأطفال بعد أن لم يحقق الأب التزامه.

استخدام منهج البحث هو البحث النوعي بالمدخل الكيفي. المدخل الكيفي هو مدخل الذي يحصل البيانات الوصفي. يجمع البيانات باستخدام مصادر البيانات الأساسي يعني المقابلة وإكمالها مع البيانات الثانوية. بالمقابلة من المخبرين لينال الأجوبة كحل لمشكلة البحث وتأكيد بالوثيقة خلال المقابلة. وبالبيانات الثانوية من مراجع الكتاب والبحث الجامعي. ثم تتم معالجة البيانات عن طريق التحرير، وتصنيفها، والتحقق منها، وتحليلها، وأخيرا ملخص.

نتائج البحث هي: (1) ولوكان أب لم يقم بالتزامه، يشعر الأطفال باليرحم من الأم. يستطيع الأطفال الذهاب إلى المدرسة ولو احتياجات الأيام لم يحقق و حقق الأم حقوق الأطفال. (2) يسعى الزوجة لدعم الطفل هو تعمل وتحمله جزئيا من قبل الأسرة جانب الأم.
