Pemahaman Tokoh Masyarakat tentang kekerasan terhadap anak ditinjau dari UU No.23 Tahun 2002 dan Fiqh: Studi Kasus di Kelurahan Banjarsugihan Kecamatan Tandes Surabaya

ABSTRAK

Children forces are easily happened even at this moment are often happened. The forces not only happened to the teenage children but also the innocent baby which is sometimes assumed to trigger annoyance of parents. The child forces can be happened every time and its place not only in the public rooms like road, but it is earn happened at home truthfully represent haven most peaceful places for children. The objective of this research is to know the understanding of elite figure about child forces evaluated from the constitution (UU) No 23, 2002 and Fiqih. Here, the researcher uses qualitative research design and uses descriptive qualitative approaches. The analyses uses descriptive technique which is conducted by depicting obtained data with sentence or words. The data collection method in this research uses: a. interview, b. documentation for the purpose of obtaining the complete data. In this research, the researcher holds an interview with the elite figures in Banjarsugihan, Tandes, Surabaya, and also the victims and self-supporting social institute (LSM) as the colleague.

Based on the result of research, this research shows that the understanding of elite figure of children forces is not only physical forces but also psychical forces which is less realized by society, such as angry to child and also hardness to child will not happened if the parents fulfill the 4 (four) based rights from those the child become a kind of fulcrums to other rights. The hardest impact of children forces is physical forces.

There is no element predominate according to section 9 for the elite figure in giving the education to children. The understanding of the elite figure evaluated from fiqih is may not beat and force the children to work with any reason.
