Abstract
ABSTRAK
Merger Bank Syariah Indonesia menggabungkan tiga perusahaan perbankan BUMN dengan tujuan utama untuk meningkatkan profit perusahaan. Namun disisi lain merger Bank Syariah Indonesia juga menyebabkan adanya persoalan yang dihadapi pegawai terkait dampak merger serta mengakibatkan adanya akibat hukum terhadap kontrak kerjanya. Jenis penelitian yang digunakan dalam penelitian ini menggunakan yuridis empiris, dengan pendekatan konseptual. Sumber data yang digunakan ialah data primer yaitu hasil wawancara dengan narasumber dan sumber data sekunder berupa Peraturan Perundang-Undangan serta dokumen lain tentang merger perusahaan. Untuk teknis pengumpulan data melalui wawancara dan dokumentasi. Dalam pengolahan dan analisis data melewati beberapa tahapan: editing, classifaying, analysing, concluding.
Hasil dalam penelitian ini yaitu Akibat hukum dari merger ketiga Bank Syariah tersebut pada kontrak kerja karyawan diantaranya terdapat perjanjian kerja yang diperbarui dengan penyesuaian perjanjian ketiga bank syariah sebelum merger dan diambil yang paling menguntungkan karyawan serta status pegawai pasca merger yaitu PKWT dan terdapat perpanjangan kontrak bagi pegawai kontrak selama 5 tahun. Persoalan yang dihadapai pegawai Bank Syariah Indonesia di KCP Malang Bululawang terkait pembaruan kontrak kerja pada saat merger salah satunya yakni penurunan kewenangan jabatan. Pembaruan kontrak kerja pasca merger menyebabkan adanya test yang terdapat passing grade dan dapat menyebabkan penurunan kewenangan jabatan. Meskipun demikian pihak Bank Syariah Indonesia tidak mengurangi upah pegawai yang bersangkutan.
ABSTRACT
The Merger Bank Syariah Indonesia merged three state-owned banking companies with the main objective to increase company profits. However, on the other hand, the merger of Bank Syariah Indonesia also caused problems faced by employees related to the impact of the merger and resulted in legal consequences for their work contracts. The type of research used in this study uses empirical juridical, with a conceptual approach. The data source used is primary data, namely the results of interviews with informants and secondary data sources in the form of laws and regulations and other documents regarding company mergers. For technical data collection through interviews and documentation. In the processing and analysis of data through several stages: editing, classifaying, analysing, concluding.
The results in this study are the legal consequences of the merger of the three Islamic banks on employee employment contracts including a renewed work agreement with adjustments to the agreement of the three Islamic banks before the merger and taking the one that is most profitable for employees and post-merger employee status, namely PKWT and there is an extension of the contract for employees. contract for 5 years. One of the problems faced by Bank Syariah Indonesia employees at KCP Malang Bululawang is related to the renewal of work contracts during the merger, one of which is a decrease in position authority. Renewal of post-merger work contracts causes existing testspassing grade and can lead to a decrease in office authority. Even so, Bank Syariah Indonesia does not reduce the wages of the employee concerned.

دﻣﺞ ﺑﻨﻚ اﻻﻧﺪﻣﺎج اﻟﺸﺮﯾﻌﺔ اﻹﻧﺪوﻧﯿﺴﻲ ﺛﻼث ﺷﺮﻛﺎت ﻣﺼﺮﻓﯿﺔ ﻣﻤﻠﻮﻛﺔ ﻟﻠﺪوﻟﺔ ﺑﮭﺪف رﺋﯿﺴﻲ ھﻮ زﯾﺎدة أرﺑﺎح اﻟﺸﺮﻛﺔ. وﻣﻊ ذﻟﻚ، ﻣﻦ ﻧﺎﺣﯿﺔ أﺧﺮى ، ﺗﺴﺒﺐ اﻧﺪﻣﺎج ﺑﻨﻚ اﻟﺸﺮﯾﻌﺔ اﻹﻧﺪوﻧﯿﺴﯿﺔ أﯾﻀﺎ ﻓﻲ ﻣﺸﺎﻛﻞ واﺟﮭﮭﺎاﻟﻤﻮظﻔﻮن ﺗﺘﻌﻠﻖ ﺑﺘﺄﺛﯿﺮ اﻻﻧﺪﻣﺎج وأدى إﻟﻰﻋﻮاﻗﺐ ﻗﺎﻧﻮﻧﯿﺔ ﻋﻠﻰ ﻋﻘﻮد ﻋﻤﻠﮭﻢ. ﻧﻮع اﻟﺒﺤﺚ اﻟﻤﺴﺘﺨﺪم ﻓﻲ ھﺬه اﻟﺪراﺳﺔ ﯾﺴﺘﺨﺪم اﻟﻔﻘﮫ اﻟﺘﺠﺮﯾﺒﻲ ، ﻣﻊ ﻧﮭﺞ ﻣﻔﺎھﯿﻤﻲ. ﻣﺼﺪر اﻟﺒﯿﺎﻧﺎت اﻟﻤﺴﺘﺨﺪم ھﻮ اﻟﺒﯿﺎﻧﺎت اﻷوﻟﯿﺔ ، وھﻲ ﻧﺘﺎﺋﺞ اﻟﻤﻘﺎﺑﻼت ﻣﻊ اﻟﻤﺨﺒﺮﯾﻦ وﻣﺼﺎدر اﻟﺒﯿﺎﻧﺎت اﻟﺜﺎﻧﻮﯾﺔ ﻓﻲ ﺷﻜﻞ ﻗﻮاﻧﯿﻦ وأﻧﻈﻤﺔ ووﺛﺎﺋﻖ أﺧﺮى ﺗﺘﻌﻠﻖ ﺑﻌﻤﻠﯿﺎت اﻧﺪﻣﺎج اﻟﺸﺮﻛﺎت. ﻟﺠﻤﻊ اﻟﺒﯿﺎﻧﺎت اﻟﻔﻨﯿﺔ ﻣﻦ ﺧﻼل اﻟﻤﻘﺎﺑﻼت واﻟﺘﻮﺛﯿﻖ. ﻓﻲ ﻣﻌﺎﻟﺠﺔ اﻟﺒﯿﺎﻧﺎت وﺗﺤﻠﯿﻠﮭﺎ.ﻋﺒﺮ ﻋﺪة ﻣﺮاﺣﻞ:اﻟﺘﺤﺮﯾﺮ ، اﻟﺘﺼﻨﯿﻒ ، اﻟﺘﺤﻠﯿﻞ ، اﻟﺨﺎﺗﻤﺔ.
