Pandangan Ulama NU di desa Ngenep kecamatan Karangploso terhadap jual beli tebu dengan sistem tebasan

Transaksi jual beli sudah bukan menjadi hal yang asing di telinga semua orang. Setiap hari orang-orang melakukan transaksi jual beli. Meskipun setiap hari dilakukan, tetapi belum tentu pelaku mengerti bagaimana hukum, tata cara, dan prinsip-prinsip dari jual beli yang diperbolehkan dalam Islam. Salah satunya adalah jual beli tebu dengan sistem tebasan yang terjadi di Desa Ngenep Kecamatan Karangploso. Hamper setiap tahunnya transaksi jenis ini selalu terjadi. Dalam penelitian ini akan dibahas mengenai bagaimana proses transaksi jual beli tebu dengan sistem tebasan yang terjadi di Desa Ngenep Kecamatan Karangploso? Serta bagaimana pandangan ulama NU setempat menanggapi jual beli tebu dengan sistem tebasan tersebut?. Ulama NU yang dimaksud adalah ulama atau tokoh adat setempat yang dianggap dituakan atau mengerti agama dan beraliran ahlus sunnah wal jamaah atau yang biasa di sebut dengan NU (Nahdlatul Ulama)

Penelitian ini termasuk dalam penelitian empiris, karena peneliti terjun langsung ke lapangan. Selain dari wawancara peneliti juga menggunakan buku sebagai sumber dari analisis, buku yang dimaksud adalah tentang ghoror. Tidak lupa juga hasil dari penelitian di analisis menggunakan kacamata sosiologi hukumYang terakhir adalah analisis menggunakan kaidah-kaidah fiqh.

Dari penelitian yang dilakukan diambil data kalau tebasan jauh lebih mudah dan tidak ribet. Uangnya lebih kontan dan cepat, jadi saat petani membutuhkan uang, juragan dating dan menawari sistem tebasan ini. Sehingga banyak petani yang tergiur untuk lebih memilih sistem tebasan daripada melalui pabrik yang tergolong lebih lama. Selain itu, dengan sistem tebasan petani tidak perlu memikirkan resiko ke depannya. Karena yang menanggung resiko beralih pada juragan (pembeli). Jual beli dengan sistem tebasan sudah mendarah daging.

Tidak hanya di Desa Ngenep saja, tapi hampir di semua daerah sehingga pasti akan susah untuk menghilangkannya. Menurut beberapa tokoh agama yang dimintai informasi, masyarakat beranggapan kalau hal tersebut sah-sah saja, asal penjual dan pembeli sudah mufakat. Mereka tidak memperdulikan kemungkinan resiko yang terjadi di kemudian hari. Jual beli tebu dengan sistem tebasan termasuk jual beli ghoror karena belum jelas barangnya. Tetapi jika dilihat dari macam ghoror, ada ghoror fahisy dan ghoror yasir. Maka, jual beli tebasan tebu ini termasuk dalam ghoror yasir. Yakni, ghoror sedikit yang dianggap tidak apa-apa untuk dilakukan.

Selling and Buying transaction is a mainstream activity for everyone. Everyday people doing that transactions. Nevertheless, the subjects of selling and buying have not understood how the regulation, prdinances, and principles of selling and buying that allowed in Islam. One of the system is sugar cane’s selling and buying with the system of bought before harvesting that occured in the Ngenep Village, Karang Ploso Subdistrict. Over in years, this type of transactions always happens. And it does not only happen in sugarcane crops, but it covers almost everything that is grown by local farmers, be it vegetables, yams, nuts, and others. In this research will be discussed about how the process of selling and buying sugar cane transaction that occurred in the Village Ngenep Karangploso District? And how the opinions of local NU scholar about selling and buying sugar cane with this system? The NU scholar is a local scholar or traditional figure who are considered elder or understands the religion and the ahlus sunnah wal jamaah’s scince or commonly called by NU (Nahdlatul Ulama.

This research is empirical research, because the researchers observe directly to the field to see the sugar cane garden, the researchers also conducted interviews to the farmers, to obtain information related to the transaction process and what are the advantages of bought before harvesting system rather than through the factory. In addition, researchers also conducted interviews with NU scholar or local religious leaders to asked about the selling buying with this system. Then the researcher also uses the book as the source of the analysis, the book in is about ghoror. In the analysis using in the result is using sociology of law. Because according to informants this system has become a tradition and hard to be eliminated. The last one is analysis using fiqh rules.

From the interviews obtained that the bought before harvesting is easier and not complicated. The money is more cash and faster. So many farmers are tempted to prefer a this system rather than through a factory that is older. In addition, with this system is unneeded to think about future risks. Because those who bear the risk is a buyer. Selling and Buying with this system is mainstream.

Not only in Ngenep Village, but almost in all areas so it would be difficult to eliminate it. According to some religious leaders who asked for information, people assume that it is legitimate, as long as the seller and buyer have agreed. They do not care about possible risks that occur in the future. Selling and buying sugar cane with this system is kind of ghoror selling and buying because the goods are not clear. Are all good or some bad ones. But when viewed from the kind of ghoror, there are ghoror fahisy and ghoror yasir. So, this system is included in the yasir ghoror. Namely, a little ghoror that still permitted to do.
