Resistensi pedagang kaki lima terhadap pelanggaran hukum di Kabupaten Jember: Tinjauan peraturan Daerah Kabupaten Jember nomor 6 tahun 2008 dan maslahah mursalah

Keberadaan Pedagang Kaki Lima merupakan suatu fenomena kegiatan perekonomian rakyat kecil khususnya pedagang kaki lima di Jalan Gajah Mada dan Jalan Trunojoyo Kabupaten Jember. Kehadiran Pedagang Kaki Lima menimbulkan berbagai persoalan, terkait dengan masalah ketertiban, keramaian, dan kebersihan untuk kemaslahatan bersama.Tindakan penertiban merupakan salah satu sumber terjadinya konflik antara Pedagang Kaki Lima dengan aparat pemerintah. Kekerasan yang dilakukan oleh satpol pp dalam menertibkan pedagang kaki lima sering terjadi sehingga menimbulkan pelanggaran hukum. Dalam menghadapi berbagai tekanan yang dilakukan pemerintah yang dirasa sangat membatasi ruang geraknya, pedagang kaki lima mempunyai beberapa teknik atau strategi yang sengaja mereka kembangkan untuk menghadapi tekanan tersebut.

Penelitian ini menggunakan metode kualitatif.Teknik pengumpulan data melalui metode wawancara, metode observasi, dan metode dokumentasi.Penelitian dilakukan di Jalan Gajah Mada, Jalan Trunojoyo dan Satuan Polisi Pamong Praja Kabupaten Jember.

Permasalahan penelitian ini adalah 1) mengapa Pedagang Kaki Lima menjadi pilihan kerja bagi masyarakat Kabupaten Jember? 2) bagaimana faktor penyebab dan bentuk-bentuk perlawanan Pedagang Kaki Lima di Jalan Gajah Mada dan Jalan Trunojoyo Kabupaten Jember ? 3) bagaimana Maslahah Mursalah melihat maraknya Pedagang Kaki Lima di Kabupaten Jember khususnya di Jalan Gajah Mada dan Jalan Trunojoyo? Tujuan penelitian ini adalah (1) untuk mengetahui pedagang kaki lima menjadi pilihan kerja bagi masyarakat Kabupaten Jember, (2) untuk mengetahui faktor penyebab dan bentukbentuk perlawanan Pedagang Kaki Limadi Kabupaten Jember, (3) untuk mengetahui kemaslahatan dan kemudhorotan Pedagang Kaki Lima di Jalan Gajah Mada dan Jalan Trunojoyo Kabupaten Jember.

Hasil yang diperoleh (1) alasan pilihan kerja menjadi pedagang kaki lima adalah faktor ekonomi dan pendidikan serta banyaknya masyarakat pengangguran di Kabupaten Jember (2) faktor penyebab perlawanan adalah ketidak adilan dan bentuk-bentuk perlawanan Pedagang Kaki Lima adalah tetap berjualan, menolak relokasi, menyembunyikan barang dagangan dan bersembunyi atau kucing-kucingan dengan petugas. (3) Keberadaan Pedagang kaki lima di Jalan Gajah Mada dan Jalan Trunojoyo menimbulkan kemaslahatan bagi para konsumen dan kemudhorotan bagi para pengguna jalan serta aparat pemerintahan.

The existence of street vendors is a phenomenon of economic activities of the masses, especially street vendors in Gajah Mada and TrunojoyoStreet. The presence of Street Vendors causes a many problems, related to the problem of orderliness, densityandcleanness for the common good. The enforcement action is one of thecauses of conflict between the street vendors and the government officials.Theviolence committed by municipal police in disciplining thestreetvendors is often occur, causing a violation of law. Therefore,the existence of the street vendors can be maintained without damaging the aspects of beauty and orderliness in the city.Infacing the pressure of the government whichseems limit theirlatitude, the street vendors have several techniques or strategy which they arranged to deal with the pressure.

This study uses qualitative method. Data collection of this study through interviews, observation and documentation. The study was conducted in Gajah Mada, TrunojoyoStreet and the municipal police Unit of Jember.

This study is undertaken to answer the following questions: 1) why does the Street Vendor becomes the choice of Jember society? 2) howare the causes and forms of resistance of the Street Vendors in Gajah Mada and TrunojoyoStreet of Jember? 3) howdoes Maslahahmursalah see the rising of the street vendors in Jember, especially in Gajah Mada and Trunojoyo Street? Whereas the purposes of this study are: (1) to find out the reason that the Street Vendor becomes the choice of Jember,(2) to determine causes and forms of resistance of the Street Vendors in Gajah Mada and TrunojoyoStreet of Jember,(3) to determine the Maslahahmursalahof the rising of the street vendors in Jember, especially in Gajah Mada andTrunojoyo Street.

The results of this study obtained (1) the reasons to be a street vendor is related to economic and education factorsas well as numerous of people unemployed in Jember (2) causal factor of resistance is the injustice and other forms of resistance by the street vendors that are still selling, resisting the relocation, hide and seek with the officer;(3) The presence of the street vendors in Gajah Mada and TrunojoyoStreet poseswhether advantages and disadvantages for consumers and the road users as well as government officials. Suggestions for the government is that the government must be firm and fair to the street vendors.
