Disfungsi peran BP4 dalam menangani perceraian di kalangan Aparatur Sipil Negara tahun 2019: Studi kasus: Kementerian Agama Kabupaten Malang

ABSTRAK

Fenomena perceraian di kalangan Aparatur Sipil Negara (ASN) tampaknya masih banyak terjadi, termasuk kasus perceraian yang terdaftar di BP4 Kabupaten Malang. Badan Penasihat, Pembinaan, dan Pelestarian Perkawinan atau yang biasa disebut BP4 sendiri merupakan salah satu lembaga yang berperan meningkatkan kualitas pernikahan masyarakat. Dalam peranya BP4 juga berperan menjadi mediator bagi pasangan ASN yang melakukan perceraian. Namun peran BP4 dalam proses penanganan perceraian ASN masih belum maksimal. Menurut penulis fenomena ini harus diikuti untuk mengetahui apa yang menjadi permasalahan dalam proses penanganan perceraian ASN di BP4 Kabupaten Malang.

Melihat keadaan seperti ini, maka penulis akan melakukan penelitian dengan tujuan (1) Mengetahui peran Strategis BP4 kabupaten Malang dalam menangani perceraian di kalangan ASN (2) Mengetahui disfungsi peran BP4 dalam menangani masalah perceraian di kalangan ASN Kabupaten Malang.

Dalam penelitian ini, penulis menggunakan jenis metode penelitian empiris dengan menggunakan pendekatan kualitatif. Sedangkan untuk Teknik pengumpulan data dilakukan melalui wawancara kepada petugas BP4 kabupaten Malang dan ASN yang berperkara. Selanjutnya, untuk mengolah data yang sudah terkumpul, penulis menganalisis dengan metode analisis deskriptif.

Kabupaten Malang dalam menangani kasus perceraian ASN sepanjang tahun 2019 dengan 31 kasus yang terdaftarkan, tidak ada satu pun dari kasus tersebut yan berhasil dimediasi. Hal ini menandakan bahwa peran yang dilakukan oleh BP4 kementrian Agama Kabupaten Malang masih ada disfungsi peran yang terjadi dalam menangani setiap kasus perceraian ASN. Petugas BP4 Kabupaten Malang tentunya memahami dan berpengalaman baik secara teknik maupun teori dalam menangani kasus perceraian di kalangan ASN, namun titik temu dari masalah yang sulit dipertemukan serta minimnya waktu, tenaga, dan fasilitas dalam proses penanganannya membuat eksekusinya belum berjalan maksimal, sehingga usaha mediasi yang dilakukan terkesan hanya sebagai formalitas.

ABSTRACT

The phenomenon of divorce among the State Civil Apparatus (ASN) seems to still occur a lot, including divorce cases registered at BP4 Malang Regency. The Marriage Advisory, Guidance and Preservation Agency or commonly known as BP4 itself is one of the institutions that plays a role in improving the quality of community marriages. in its role, BP4 also acts as a mediator for ASN couples who divorce. However, BP4's role in the process of handling ASN divorce is still not optimal. According to the author, this phenomenon must be followed to find out what is the problem in the process of handling ASN divorce at BP4 Malang Regency.

Seeing conditions like this, the authors will conduct research with the aim of (1) Knowing the strategic role of BP4 Malang regency in dealing with divorce among ASNs (2) Knowing the dysfunction of the role of BP4 in dealing with divorce problems among ASN Malang Regency.

In this study, the authors used an empirical research method using a qualitative approach. Meanwhile, the data collection technique was carried out through interviews with BP4 officers in Malang district and Civil Servant (ASN) who had litigation. Furthermore, to process the collected data, the authors analyzed the descriptive analysis method.

The results of this study indicate that the effectiveness of BP4 of the Ministry of Religion of Malang Regency in handling Civil Servant (ASN) divorce cases throughout 2019 with 31 registered cases, not one of these cases was successfully mediated. This indicates that the role played by BP4 of the Ministry of Religion of Malang Regency is still not dysfunction in handling every Civil Servant (ASN) divorce case. BP4 officers in Malang Regency certainly understand and are experienced both technically and in theory in handling divorce cases among Civil Servant (ASN), but the common ground of problems that are difficult to meet and the lack of time and energy in the handling process has made the execution not run optimally, so that the mediation efforts carried out are impressed only as a formality.

ظاهرة الطلاق فى الجهاز المدني للدولة كثيرة. خاصة الطلاق الذي يسجل BP4 في مقاطعة مالانج. في الحقيقة تملك الجهاز المدني للدولة قواعد السلوك في التوظيف. لكن ليس فليلا هم الذى يستمرالطلاق.

حقيقة الوظيفة BP4 زيادة تحيين زواج المجتمع، ثم جعل الوسيلة في جهاز المدني للدولة الذى يعمل الطلاق بل في هذا المسألة رأي الكاتب عمالية Bp4 لا يعمل مثل ذالك. نرى واقع الحال في وسائل BP 4 اكثر انتهاء الطلاق في انهاية.

هذا البحث يستعمل الكاتب طريقة البح التجريبية بمنهج الكيفي. و جمع البيانات بمقابلة مع عضوBP4 و جهاز المدني للدولة. ثم لمعالجة البيانات تحليل الكاتب بمنهجية تحليلية الوصفي.
تحصل هذا البحث توجّه فعالية BP4 وزارة الدينية في مقاطعة مالانج عند تنفيد الطلاق جهاز المدني للدولة منذ سنة ٢٠١٩ من ٣١ قضية الذى تسجل فيهم لا أحدا الذى تعمل بوسائلية. في تلك المسألة رأى الكاتب فعالية BP4 تننفيذ مسائل الطلاق لم يعمل في عمالية الطلاق.

ينبغي أعضاء BP4 تفهيما و تجريبة في صناعي و نظري لتنفيذ الطلاق في جهاز المدني للدولة بل نقطة إلتقائهم في هذا المسألة لم يجد. ثم قليل الوقت والتطبيق جعل تنفيذ الطلاق نقص الإحسان. فلهذا الوسيلة كمثل صوريا فقط.
