Sistem gadukan dalam pengelolaan tambak di Desa Permisan, Kecamatan Jabon, Kabupaten Sidoarjo tinjauan Kompilasi Hukum Ekonomi Syariah

ABSTRAK

Desa Permisan Kecamatn Jabon Kabupaten Sidoarjo Gadukan.adalah dimana peminjam modal memberikan modal (pinjaman) kepada pemilik tambak, guna untuk pengoprasian tambak tersebut agar dapat mendapatkan hasil dari tambak, dan hasil panen dari tambak tesebut harus dijual kepada peminjaman modal. Selain mengembalikan modal dan menjual hasil tambak kepada pemberi modal, pemilik tambak juga harus menjual hasil panenya kepada pemilik modal dengan harga dibawah harga pasaran dan akad ini dilakukan di awal perjanjian tersebut dengan adanya saksi.

Penelitian ini mempunyai dua rumusan masalah yang akan dikaji, yaitu mengetahui pelaksanaan sistem gadukan dalam pengelolaan tambak di Desa Permisan, Kecamatan Jabon, Kabupaten Sidoarjo dan mengetahui tinjauan kompilasi hukum ekonomi syariah tentang sistem gadukan dalam pengelolaan tambak di Desa Permisan, Kecamatan Jabon, Kabupaten Sidoarjo. Penelitian ini menggunakan pendekatan deskriptif kualitatif. Sedangkan data yang dikumpulkan berupa data primer dan data skunder yang dilakukan dengan teknik wawancara dan dokumentasi yang kemudian data tersebut diedit, diperiksa dan disusun secara cermat serta diatur sedemikian rupa yang kemudian dianalisis secara deskriptif yang bertujuan untuk mendiskripsikan sistem gadukan dalam pengelolaan hasil tambak di Desa Permisan Kecamatan Jabon Kabupaten Sidoarjo

Dalam penelitian ini diperoleh dua kesimpulan. Pertama, sitem gadukan yang ada di Desa Permisan adalah perjanjian dimana pemilik modal dan pemilik tambak melakukan perjanjian dimana pemilik modal meminjamkan modal kepada pemilik tambak dengan ketentuian pemilik tambak harus menjual hasil panenya kepada pemilik modal dan menjual panenya dengan harga di bawah harga pasar dengan batas sampai pelunasan uang pinjaman modal. Kedua, sesuai dengan kompilasi hukum ekonomi syariah perjanjian ini boleh dilakukan karena tidak ada syarat dan rukun-rukun yang di langgar, akan tetapi perjanjian ini jarang dilakukan pada tahun tahun ini, karena sudah banyak masyarakat yang sudah tahu akan pemasaran dari hasil panen sehingga hasil panen bisa mendapatkan harga maksimal.

This research has two problem formulation which will be studied, that knows the implementation of system of mortar in pond management in Permisan Village, Jabon District, Sidoarjo Regency and to know the compilation of sharia law about the mortar system in pond management in Permisan Village, Jabon District, Sidoarjo Regency. This research use descriptive qualitative approach. While the data collected in the form of primary data and secondary data that is done by interviewing and documentation techniques which then the data is edited, checked and arranged carefully and arranged in such a way that is then analyzed descriptively which aims to describe the system of hunting in the management of ponds in Permisan Village District Jabon Sidoarjo District In this study obtained two conclusions.

Firstly, the hunting system in Permisan Village is an agreement where the (owner) of the capital and the (owner) of the pond make an agreement whereby the (owner) of the capital lends the capital to the (owner) of the pond with the certitude of the (owner) of the pond must sell the harvest to the (owner) of the capital and sell the harvest at a price below the market price with the limit until repayment of capital loan. Secondly, in accordance with the compilation of shariah economic law this agreement may be done because there is no requirement and the pillars are broken, but this agreement is rarely done in the year this year, because already many people who already know the marketing of the harvest so that the harvest can get the maximum price.

غادوكان هو يقرض صاحب المال رأس ماله إلى صاحب الأحواض لتشغيل الأحواض من أجل الحصول على نتاجها، ويجب بيعها وبجب أيضا لصاحب الأحواض بيعها بسعر أقل من ، للمقترض رأس المال .بالإضافة إلى إعادة رأس المال وبيع نتاجها للمقترض سعر السوق للمقترض.

ويتم تنفيذ هذا العقد في بداية الاتفاقية مع الشهود. سيدوهارجو، – جابون – )معرفة تطبيق نظام غادوكان في تشغيل الأحواض في قرية فرميسان ١ يحتوي هذا البحث على مشكلتين؛ – ) معرفة وجهة نظر مجموع القوانين الاقتصادية الإسلامية فيما يتعلق بنظام غادوكان في تشغيل الأحواض في قرية فرميسان ٢ ، جابون - سيدوهارجو .يستخدم هذا البحث المنهج النوعي الوصفي. وتم جمع البيانات في شكل البيانات الأولية والبيانات الثانوية اً والتي تم إجراؤها عن طريق المقابلة والوثائق، ثم يتم تحريرها وفحصها وترتيبها لتكون مرتبة، وتحليلها وصفي بعد ذلك بهدف وصف سيدوهارجو. – جابون – نظام غادوكان لتشغيل منتجات أحواض السمك في قرية فرميسان ً وأظهرت نتائج هذا البحث ما يلي: نظام غادوكان في قرية فرميسان هو العقد الذي تم بين صاحب المال (المقترض) و صاحب ،أولا الأحواض بشرط أن يكون صاحب الأحواض يبيع نتاج أحواضه للمقترض بسعر أقل من سعر السوق بحد يصل إلى أن يسدد قروضه

. اً هذا العقد جائز ،اًثاني اً وفق لمجموع القوانين الاقتصادية الإسلامية لعدم وجود شروط أو أركان يتم انتهاكها، ولكن نادر ما يتم تنفيذ هذا العقد هذا السنوات الأخيرة، لأن معظم الناس يعرف بالفعل عن تسويق نتاج أحواضه لكي يحصل على أقصى سعر.
