Konflik keluarga akibat tanah warisan dijual secara sepihak oleh salah satu ahli waris perspektif Kompilasi Hukum Islam: Studi di Desa Belotan Kecamatan Bendo Kabupaten Magetan

ABSTRAK

Konflik keluarga yang kerap terjadi dalam masyarakat, terutama mengenai pembagian tanah warisan, dimana adanya perebutan tanah warisan yang terjadi karena salah satu ahli waris menjual tanah warisan secara sepihak. Padahal hal tersebut dapat diselesaikan secara musyawarah bersama, namun keluarga yang berkonflik lebih memilih jalur hukum dalam penyelesaian permasalahan ini. Dalam hal ini peneliti tertarik untuk meneliti lebih lanjut perkembangan konflik ini, apalagi konflik yang jarang terjadi di masyarakat. Serta cara penyelesaian konflik yang terjadi dapat melalui perspektif Kompilasi Hukum Islam.

Jenis penelitian ini adalah penelitian empiris dengan menggunakan pendekatan penelitian kualitatif. Sumber data yang yang digunakan adalah sumber data primer yang diperoleh melalui wawancara dan sumber data sekunder yang diperoleh melalui buku, artikel, jurnal, dan penelitian terdahulu.

Hasil penelitian menunjukkan bahwa terjadi kesalahpahaman antara para ahli waris sehingga menyebabkan konflik. Berawal dari tanah warisan yang lebih dahulu telah dijual oleh salah satu ahli waris setelah adanya pembagian harta warisan secara sah. Di sisi lain, terdapat salah satu ahli waris yang kemudian mengganti sertifikat tanah warisan tersebut menjadi atas nama istri ahli waris. Selang beberapa tahun, ahli waris yang telah menjual tanah warisan tersebut meminta haknya kembali untuk mendapat harta warisan. Namun, karena telah dibagi rata dan pada awal pembagian beliau tidak mengakui perbuatannya itu, maka dalam hal ini beliau merasa dirugikan. Kemudian, upaya untuk menyelesaikan konflik keluarga akibat salah satu ahli waris menjual tanah warisan secara sepihak yang ditinjau dari Kompilasi Hukum Islam Pasal 185 yang menyatakan bahwa ahli waris yang meninggal lebih dulu daripada pewaris, maka kedudukannya dapat digantikan anaknya. Hal ini kemudian dapat menjadi salah satu alternatif yang dapat dilakukan untuk menyelesaikan konflik keluarga tersebut.

ABSTRACT

Family conflicts that often occur in the community, especially regarding the division of heritage land, where there is a struggle for inheritance land that occurs because one of the heirs sells the inheritance land unilaterally. Although, this can be resolved by mutual deliberation, but conflicted families prefers legal channels in solving this problem. In this case, researchers are interested in further researching the development of this conflict, let alone conflicts that are rare in society. As well as the way conflict resolution occurs can be through the perspective of the Compilation of Islamic Law.

This type of research is empirical research using a qualitative research approach. The data sources used are primary data sources obtained through interviews and secondary data sources obtained through books, articles, journals, and previous research.

The results showed that there was a misunderstanding between the heirs that led to conflict. Starting from the previous heritage land has been sold by one of the heirs after the legal distribution of inheritance. On the other hand, there is one of the heirs who then changes the inheritance land certificate to be in the name of the heir's wife. After a few years, the heirs who had sold the estate asked for his right back to get the inheritance. However, because it had been divided equally and at the beginning of the division he did not admit his deeds, then in this case he felt aggrieved. Then, efforts to resolve family conflicts due to one of the heirs selling the inheritance land unilaterally are reviewed from the Compilation of Islamic Law Article 185 which states that the heir who died earlier than the heir, then his position can be replaced by his son. This can then be one of the alternatives that can be done to resolve family conflicts.

الصراعات الأسرية التي تحدث في كثير من الأحيان في المجتمع، وخاصة فيما يتعلق بتقسيم الأراضي التراثية، حيث يوجد صراع على أرض الميراث التي تحدث لأن أحد الورثة يبيع أرض الميراث من جانب واحد. وعلى الرغم من أن هذا يمكن حله عن طريق التداول المتبادل، إلا أن الأسر المتصارعة تفضل القنواتمجموع الأحكام الإسلامية.
