Pelaksanaan Akad Nikah menurut surat edaran Ditjen Bimas Islam no. 06 tahun 2020 tentang pelayanan nikah menuju masyarakat produktif aman Covid perspektif Sadd Al-Dzari’ah

ABSTRAK

Kehadiran corona virus pada tahun 2020 memberikan dampak perubahan dalam tatanan kehidupan di Indonesia, bahkan seluruh dunia merasakan dampaknya. Bukan hanya berdampak pada aspek kesehatan tapi berbagai aspek kehidupan lainnya, mulai dari ekonomi, sosial. bahkan budaya. Adanya virus corona juga mengakibatkan perubahan pelaksanaan ibadah, tak terkecuali pada pelaksanaan akad nikah. Perubahan itu diatur oleh Surat Edaran Ditjen Bimas Islam No. 06 tahun 2020 tentang Pelayanan Nikah Menuju Masyarakat Produktif Aman Covid. Hal demikian dilakukan untuk mengurangi resiko penularan virus corona. Akan tetapi regulasi yang dibuat kurang substansial. Sehingga masih ada peluang terjadinya penularan.

Metode pendekata penelitian yang dilakukan yaitu dengan pendekatan konseptual atau conceptual approach dan jika dilihat dari jenis penelitiannya, penelitian ini termasuk jenis penelitian normatif atau library research. Adapun sumber data yang digunakan penulis sebagai acuan dalam pembuatan skripsi ini Melalui Surat Edaran Ditjen Bimas Islam No 06 Tahun 2020 tentang Pelayanan Nikah Menuju Masyarakat Produktif Aman Covid. Sumber data lain yang dijadikan sebagai sumber data skunder berupa literatur yang berkaitan dengan topik penelitian.

Hasil penelitian ini terdapat 2 point. Yang pertama, ketentuan pelaksanaan akad nikah menurut Surat Edaran Ditjen Bimas Islam No. 06 Tahun 2020 merubah beberapa tata cara pelaksanaan akad nikah pada sebelumnya. Seperti pendaftaran bisa dilakukan secara online atau calon pengantin tidak harus mendaftar secara langsung datang ke KUA. Adanya batasan orang yang akan menghadiri pelaksanaan akad nikah sebanyak 10 orang. Selain itu, semua peserta yang hadir dalam pelaksanaan akad nikah harus mematuhi protokol Kesehatan. Semua itu dilakukan supaya pelaksanaan akad nikah berjalan dengan aman dan nyaman serta dapat terhindar dari penyebaran virus covid-19. Yang kedua, jika problematika ini ditinjau dari perspektif Saad Al-Dzari’ah maka Surat Edaran Ditjen Bimas Islam No. 06 Tahun 2020 belum sepenuhnya menutup jalan terjadinya suatu keburukan atau masih ada peluang terjadinya penyebaran virus covid-19 disaat pelaksanaan akad nikah berlangsung. Seperti saat pelaksanaan akad nikah jumlah peserta dihadiri sebanyak-banyaknya 10 orang. padahal jumlah peserta yang hadir bisa diminimalisir lagi menjadi 6 orang tanpa melanggar ketentuan hukum dan agama.

يؤثر وجود فيروس كورونا سنة 2020 على التغيرات في نظام الحياة بإندونيسيا، ومذلك في تأدية عقد الزواج. سعت الحكومة إلى تغيير اللوائح في تنفيذ الزواج بحيث يستمر عقد الزواج مع الحفاظ على البروتوكولات الصحية حتى لا تزيد من خطر الإصابة بالفيروس. كان التغيير منظما عن منشور المديرية العامة لبيماس الإسلامي رقم 06 سنة 2020 عن خدمة الزواج من منظور مجتمع المنتج الآمن عن كوفيد. ولكن، كانت اللوائح الموضوعة لم تكن جوهرية تامة. بحيث لم تزال هناك فرصة لحدوث انتقال فيروس كورونا.

طريقة البحث المستخدمة هي طريقة التشريع و المنهج المفاهيمي وعندما ينظر إليه من نوع البحث، يتم تضمين هذا البحث في نوع البحث المعياري أو البحث المكتبي. مصدر البيانات المستخدم بالباحثة كمراجع في إعداد هذا البحث هو منشور المديرية العامة لبيماس الإسلامي رقم 06 سنة 2020. ومصدر البيانات الآخري المستخدم كمصدر البيانات الثانوية هو الأدبيات المتعلقة بموضوع البحث.

سيتم وصف نتائج هذه الدراسة وفقًا لصياغة المشكلة، أولا: أحكام تنفيذ عقد الزواج حسب منشور المديرية العامة لبيماس الإسلامي رقم 06 سنة 2020 تغير عدة الإجراءات عن خدمة عقد الزواج قبله. مثل يمكن محاولة التسجيل عبر الإنترنت. يوجد أن حد عدد المحاضرين في عقد الزواج إلا 10 أشخاص. بالإضافة إلى ذلك، يجب على جميع المحاضرين الذين يحضرون عقد الزواج الامتثال عن بروتوكول الصحية. ثانياً: ينظر إليها من منظور سد الذريعة، فإن منشور المديرية العامة لبيماس الإسلامي رقم 06 سنة 2020 لم يغلق الطريق تمامًا لحدوث شيء سيء أو لا يزال يفتح فرصًا لانتشار فيروس كوفيد -19 أثناء تنفيذ عقد الزواج. على سبيل المثال تنفيذ عقد الزواج وفق المادة 5 ، يحضر عدد المشتركين بحد أقصى 10 أشخاص. على الرغم من أنه يمكن تقليل عدد المشاركين الحاضرين مرة أخرى إلى 6 أشخاص دون إعاقة صحة الزواج سواء وفقًا للشريعة الإسلامية أو قانون الولاية.

ABSTRACT

The presence of the corona virus in 2020 has an impact on changes in the life order in Indonesia, including the implementation of the marriage settlement. The government has sought to change regulations in the implementation of marriage so that the marriage contract can still be carried out while maintaining health protocols so as not to increase the risk of contracting the virus. The change is governed by Circular Letter of Director General for Guidance of the Islamic Community No. 06 Year 2020 On Marriage Service towards a Productive Society Covid-Safe. However, the regulations made are considered not optimal in minimizing the occurrence of crowds. So there is still a chance of transmission.

The research approach method used is a statute approach and conceptual approach and the type of research is a normative research type or library research. The data source used as a reference in making this thesis is Circular Letter of Director General for Guidance of the Islamic Community No. 06 Year 2020. Other data sources that are used as secondary data are literatures related to the research topic.

The results of this study will be described in accordance with the formulation of the problem, first, the terms of the implementation of the marriage settlement according to Circular Letter of Director General for Guidance of the Islamic Community No. 06 Year 2020 change some previous procedures for implementing marriage settlement. Such as the registration can be done via online. There is a limitation for just 10 people who will attend the marriage settlement. In addition, all participants who attend the implementation of the marriage settelment must obey the Health protocol. Second, viewed from the perspective of Sadd al-dzari’ah, so The Circular Letter of Director General for Guidance of the Islamic Community No. 06 Year 2020 has not completely closed the path of badness or there is still an opportunity for the spread of the Covid-19 virus during the marriage ceremony. As in the implementation of the marriage contract according to article 5, the number of participants is attended by a maximum of 10 people. even though the number of participants present can be minimized again to 6 people without hindering the validity of marriages either according to Islamic law or state law.
