Perlindungan hukum industri minyak kelapa sawit terhadap peredaran produk berlabel Palm Oil Free (POF) pada kemasan pangan olahan prespektif peraturan BPOM Nomor 31 Tahun 2018

ABSTRAK

Industri minyak kelapa sawit Indonesia dalam beberapa tahun terakhir menjadi salah satu isu yang manarik perhatian masyarakat dunia. Menarik perhatian kerena perkembangannya yang sangat cepat, mengubah peta persaingan minyak nabati global. Disisi lain, pembangunan dan pengelolahan industri minyak kelapa sawit menghadapi tantangan yang tidak ringan, salah satunya yaitu tentang isu label Palm Oil Free (POF) pada kemasan pangan olahan. Pencantuman label POF pada kemasan produk pangan olahan secara tidak langsung mendeskreditkan industri minyak kelapa sawit. Hal ini juga berpengaruh terhadap perekonomian negara Indonesia karena minyak kelapa sawit merupakan penghasil minyak kelapa sawit terbesar di Dunia. Maka dari itu tujuan peneliti adalah untuk menganalisis perlindungan hukum industri minyak kelapa sawit terhadap penggunaan label Palm Oil Free (POF) prespektif Peraturan BPOM Nomor 31 Tahun 2018.

Penelitian ini termasuk kedalam jenis penelitian yuridis normatif. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang- undangan (statute approach) dan pendekatan konseptual (conceptual approach). Pengumpulan data yang dilakukan ialah dengan cara melakukan studi kepustakaan dari sumber referensi yang mendukung penelitian.

Hasil penelitian tentang perlindungan hukum industri minyak kelapa sawit terhadap penggunaan label Palm Oil Free (POF) prespektif Peraturan BPOM Nomor 31 Tahun 2018 ada dua yaitu : 1) penggunaan label Palm Oil Free ini memiliki dampak terhadap konsumen, Industri kelapa sawit, serta perekonomian negara. 2)perlu adanya aturan aturan yang lebih tegas sera memberikan sanksi administratif atau pidana terhadap pelaku usaha yang mencantum label POF untuk memberikan perlindungan hukum industri minyak kelapa sawit terkait penggunaan label POF ini, guna untuk melindungi industri kelapa sawit tersebut.

ABSTRACT

This research explores the Legal Protection of Palm Oil Companies against the Use of Palm Oil Free (POF) Labels on Processed Food Packaging from the Perspective of BPOM Regulation Number 31 of 2018. In recent years, the Indonesian palm oil industry has become one of the issues that has attracted the attention of the world due to its rapid development that changes the market share of global oil competition. However, there are some challenges that the palm oil industry faces and the issue of the Palm Oil Free (POF) label on processed food packaging has become a main concern. The inclusion of the POF label on the packaging of processed food products ultimately disrepute the palm oil industry. Furthermore, this dispute also affects the country's economy since Indonesian produce significant amount of palm oil and is the largest producer of palm oil in the world. Therefore, the aim of the researcher is to analyze the legal protection of the palm oil industry against the use of the Palm Oil Free (POF) label from the perspective of BPOM Regulation Number 31 of 2018.

This research is a type of Juridical Normative Research. This research uses Statutory Approach and Conceptual Approach. The data collection is done by conducting a literature study from reference sources that support the research.

There are two conclusion made from this research I.e. the use of the Palm Oil Free label has an impact on consumers, the palm oil industry, as well as the country's economy and it is necessary to design stricter regulation and administrative or criminal sanctions against businesses that attach the POF label in order to provide legal protection for the palm oil industry.

أصبحت صناعة زيت النخيل في إندونيسيا في السنوات الأخيرة واحدة من القضايا التي جذبت انتباه المجتمع الدولي. جذب الانتباه بسبب تطوره السريع، وتغيير خريطة المنافسة العالمية للزيوت النباتية. من ناحية أخرى، وتطوير وإدارة صناعة زيت النخيل تواجه تحديات ليست خفيفة، واحدة منها حول مسألة التسميات Palm Oil Free (POF)على تغليف الأغذية المصنعة. تضمين التسمية Palm Oil Free (POF)المنتجات الغذائية المصنعة المعبأة بشكل غير مباشر تشويه سمعة صناعة زيت النخيل. كما أنه يؤثر على الاقتصاد الإندونيسي لأن زيت النخيل هو أكبر منتج لزيت النخيل في العالم. لذلك، فإن هدف الباحثين هو تحليل الحماية القانونية لصناعة زيت النخيل ضد استخدام التسميات Palm Oil Free (POF) تنظيم وكالة أوبات وتنظيم الأغذية رقم 31 لسنة 2018.

ينتمي هذا البحث إلى نوع البحث القانوني المعياري. النهج المستخدم في هذه الدراسة هو النهج القانوني (Statute Approach)والنهج المفاهيمي (Conceptual Approach).وجمع البيانات التي أجريت من خلال إجراء دراسات أدبية من مصادر مرجعية تدعم البحوث.

نتائج البحوث حول الحماية القانونية لصناعة زيت النخيل ضد استخدام التسميات Palm Oil Free (POF)ينقسم التنظيم المسبق للوكالة التنظيمية للأدوية والمشروبات رقم 31 لسنة 2018 إلى قسمين هما: 1) استخدام هذه العلامات Palm Oil Free (POF)لها تأثير على المستهلكين، وصناعة زيت النخيل، فضلا عن اقتصاد البلاد.2) هناك حاجة إلى قواعد ولوائح أكثر صرامة لفرض عقوبات إدارية أو جنائية على الشركات التي تسمية Palm Oil Free (POF) لتوفير الحماية القانونية لصناعة زيت النخيل المتعلقة باستخدام تسميات Palm Oil Free (POF)، من أجل حماية صناعة زيت النخيل.
