Pendaftaran anggota Kelompok Penyelenggara Pemungutan Suara (KPPS) berdasarkan Undang-Undang Nomor 7 tahun 2017 tentang pemilu perspektif mashlahah mursalah: Studi KPPS Kecamatan Pakis dan Tirtoyudo Kabupaten Malang

Salah satu syarat pendaftaran sebagai KPPS berdasarkan Undang-Undang Nomor 7 Tahun 2017 Pasal 72 (g) “mampu secara jasmani, rohani dan bebas dari penyalahgunaan narkotika” yang diperjelas dalam Surat KPU RI Nomor 241/PP.05/01/KPU/II/2019 bahwa surat keterangan mampu secara jasmani dan rohani dicantumkan dalam bentuk surat keterangan sehat. Di wilayah Kabupaten Malang ada 2 (dua) orang anggota KPPS yang meninggal dunia yaitu dari Kecamatan Pakis dan Kecamatan Tirtoyudo. Permasalahannya adalah bagaimana penerapan persyaratan anggota KPPS berdasarkan Undang-Undang Nomor 7 Tahun 2017 di Kecamatan Pakis dan Tirtoyudo?, bagaimana perlindungan hukum terhadap anggota KPPS yang sakit dan meninggal menurut KPU Kabupaten Malang dan PPS?, dan bagaimana tinjauan hukum fiqh siyasah perspektif mashlahah mursalah terhadap perlindungan hukum anggota KPPS yang sakit dan meninggal?.

Jenis penelitian ini adalah yuridis empiris dengan pendekatan penelitian yuridis sosiologis yang berlokasi di kantor KPU Kabupaten Malang, Kecamatan Pakis Desa Ampeldento dan Kecamatan Tirtoyudo Desa Purwodadi dengan melakukan pengumpulan data dan wawancara kepada anggota KPU Kabupaten Malang dan PPS Desa Ampeldento dan Desa Purwodadi.

Hasil dari penelitian ini adalah implementasi persyaratan tersebut diterapkan dengan baik di Kecamatan Pakis Desa Ampeldento. Tapi dalam hal lain tidak diterapkan dengan baik di Kecamatan Tirtoyudo Desa Purwodadi dalam praktiknya surat keterangan sehat yang dicantumkan dalam pendaftaran dianggap suatu formalitas pendaftaran tanpa dipertimbangkan kondisi kesehatan anggota KPPS.

Implementasi persyaratan pendaftaran anggota KPPS yang tidak diterapkan dengan baik dengan mengesampingkan pentingnya kondisi kesehatan dapat dimaknai bahwa mashlahah dharuriyah yaitu dalam hal memelihara jiwa tidak diterapkan dengan baik yang akhirnya mendatangkan kemudaratan yaitu meninggalnya anggota KPPS.

One of the requirements for registration as a KPPS based on Law Number 7 of 2017 Article 72 (g) "physically, spiritually and free from narcotics abuse" is clarified in the RI KPU Letter Number 241 / PP.05 / 01 / KPU / II / 2019 that the certificate of being able to be physically and spiritually included in the form of a healthy certificate. In Malang Regency, there were 2 (two) KPPS members who died, from Pakis District and Tirtoyudo District. The problem is how to apply the requirements of KPPS members based on Law Number 7 of 2017 in Pakis and Tirtoyudo Subdistricts ?, how is the legal protection for sick and dead KPPS members according to Malang Regency KPU and PPS? legal protection for KPPS members who are sick and dead ?.

This type of research is empirical juridical with sociological juridical research approach located in Malang Regency KPU office, Pakis Subdistrict, Ampeldento Village and Tirtoyudo Subdistrict, Purwodadi Village by collecting data and interviews with KPU members of Malang Regency and PPS Ampeldento Village and Purwodadi Village.

The results of this study are the implementation of these requirements is implemented well in the District of Pakis, Ampeldento Village. But in other cases it is not well implemented in Tirtoyudo Subdistrict, Purwodadi Village, in practice the health certificate included in the registration is considered a registration formality without considering the health conditions of KPPS members.

The implementation of KPPS member registration requirements that are not properly implemented by ignoring the importance of health conditions can be interpreted that the mashlahah dharuriyah, namely in terms of preserving the soul is not implemented properly which ultimately brings harm to the death of KPPS members.

هذا النوع من البحث هو من الناحية القانونية التجريبية مع نهج البحث القانوني الاجتماعي الموجود في مكتب لجنة الانتخابات العامة ، و منطقة السرخس ، و قرية أمبيلدينتو ، و منطقة فرعية ، و قرية بورودادي من خلال جمع البيانات والمقابلات مع أعضاء لجنة الانتخابات العامة من حي مالانج و منظم التصويت.

نتائج هذه الدراسة هي تنفيذ هذه المتطلبات بشكل جيد في منطقة منطقة السرخس ، قرية أمبيلدينتو. ولكن في حالات أخرى ، لم يتم تنفيذها بشكل جيد في منطقة منطقة فرعية ، قرية بورودادي ، في الممارسة العملية ، تعتبر الشهادة الصحية المدرجة في التسجيل إجراءً للتسجيل دون مراعاة الظروف الصحية لأعضاء مجموعة منظم التصويت.

يمكن تفسير تنفيذ متطلبات تسجيل أعضاء مجموعة منظم التصويت التي لم يتم تنفيذها بشكل صحيح من خلال تجاهل أهمية الظروف الصحية على أن المشالحة ، أي من حيث الحفاظ على الروح لم يتم تنفيذها بشكل صحيح مما يؤدي في نهاية المطاف إلى ضرر وفاة أعضاء مجموعة منظم التصويت.
