Implementasi Program Kartu Prakerja berdasarkan Perpres RI Nomor 76 Tahun 2020 ditinjau dari Konsep Mashlahah: Studi di Kota Malang

Pada masa pandemi COVID-19, kehadiran program kartu prakerja nampaknya telah menyisakan beberapa permasalahan baru, yang pada intinya terkait dengan nasib dan kebutuhan masyarakat miskin, terutama mereka yang terkena PHK, kesulitan ekonomi, dan pendapatan yang menurun, dan sebagainya. Pada prinsipnya, kartu prakerja merupakan jembatan yang menghubungkan masyarakat dengan berbagai pelatihan keterampilan baru. Selain itu, pemerintah juga berharap dapat menciptakan masyarakat yang lebih mampu dan berdaya sekaligus mengurangi ketergantungan yang berlebihan pada orang lain.

Penelitian ini menggunakan metode penelitian Hukum Empiris, dengan melalui pendekatan yuridis sosiologis. Adapun sumber data dari penelitian ini dibagi menjadi 2, yakni; 1) Sumber Data Primer yang diperoleh penelitian ini adalah Peraturan Presiden Nomor 76 Tahun 2020 tentang Pengembangan Kompetensi Kerja Melalui Program Kartu Prakerja, Wawancara dan Observasi. 2) Sumber Data Sekunder yang diperoleh dalam bentuk dokumen, buku-buku hukum islam, kaidah/ushul fiqh, jurnal, skripsi, tesis, atau data lain yang sifatnya tertulis dan berkaitan dengan permasalahan penelitian.

Hasil penelitian menunjukkan bahwa implementasi Program Kartu Prakerja berdasarkan ketentuan dalam Perpres Nomor 76 Tahun 2020 di Kota Malang telah berjalan dengan baik, meskipun masih terdapat hambatan-hambatan dan menyisakan sejumlah persoalan, diantaranya adalah informasi dan sosialisasi Program Kartu Prakerja harus digalakkan lagi, peserta harus ditekankan lagi untuk mengikuti pelatihan dengan baik, dan penerima manfaat harus harus benar-benar tepat sasaran. Adapun tinjauan Mashlahah, yang dalam skripsi ini berfokus pada Mashlahah Mursalah, kebijakan Pemerintah RI melalui Program Kartu Prakerja merupakan suatu bentuk ijtihad yang dinilai sangat vital dalam upaya pengembangan ekonomi islam yang berorientasi kepada pemerintah dalam menyejahterakan ummat.

This thesis is study about the implementation of Pre-employment Program based on Perpres Nomor 76 Tahun 2020 Changes to Perpres RI Nomor 36 Tahun 2020 about Competence Development through Pre-employment Program in Malang. The study aims to describe the implementation of Pre-employment Program based on Perpres Nomor 76 Tahun 2020 in Malang, to observe the implementation of Pre-employment Program by using Mashlahah Mursalah theory, and also the implementation of Pre-employment Program role towards the effect of workers quality in Malang.

During the COVID-19 pandemic, the presence of the pre-employment card program seems to have left several new problems, which are essentially related to the fate and needs of the poor, especially those affected by layoffs, economic difficulties, and declining incomes, and so on. In principle, the pre-employment card is a bridge that connects the community with various new skills training. In addition, the government also hopes to create a more capable and empowered society while reducing excessive dependence on other people.

The study uses Empirical Law research methods, through sociological juridic approach. Besides, the data source of this study has two parts, there are; 1) primary data source which acquired in this study is Peraturan Presiden Nomor 76 Tahun 2020 about Competence Development through Pre-employment Program, interview, and observation, 2) secondary data source which acquired in the form of document, Islamic law books, principle/ushul fiqh, thesis, or the others data source which written data and others data source related to the research problems.

The results showed that the implementation of the pre-employment Program based on the provisions in Presidential Regulation No. 76 of 2020 in Malang has been running well, although there are still obstacles and leaving homework. Among them is the information and socialization of the pre-employment Program should be encouraged again, participants should be emphasized again to follow the training properly, and the beneficiaries must be really on target. As for Mashlahah's review, the Indonesian Government's policy through the Pre-Work Card Program is a form of ijtihad which is considered very vital in the development of an Islamic economy that is oriented towards the government in welfare of the ummah.

تبحث هذه الأطروحة في تنفيذ برنامج بطاقة ما قبل التوظيف بناءً على المرسوم الرئاسي رقم 76 لعام 2020 تعديلات على المرسوم الرئاسي رقم 36 لعام 2020 بشأن تطوير كفاءة العمل من خلال برنامج بطاقة ما قبل التوظيف في مدينة مالانج. تهدف هذه الدراسة إلى وصف تنفيذ برنامج بطاقة ما قبل التوظيف بناءً على المرسوم الرئاسي رقم 76 لعام 2020 في مدينة مالانج ، لمراجعة تنفيذ برنامج بطاقة ما قبل التوظيف باستخدام نظرية المصلحة ، ودور ما قبل التوظيف. تنفيذ برنامج البطاقة على تأثير جودة العمال في مدينة مالانج.
