Abstract

ABSTRAK

Dalam konsep hukum Islam, implementasi akad mudharabah merupakan upaya membangun kerja sama antara pemilik modal (shahib al-mal) dengan pengelola usaha (mudharib) dalam rangka mengelola suatu bidang bisnis tertentu yang dapat menghasilkan keuntungannya, dan hasil dari keuntungan tersebut dibagi sesuai dengan kontrak perjanjian kerja sama (akad mudharabah).

Penelitian ini bertujuan mendeskripsikan implementasi mudharabah pada warung cawan coffe gayo Kota Malang, dan bagaimana implementasi mudharabah pada warung cawan coffe gayo ditinjau hukum Islam. Jenis penelitian ini adalah yuridis empiris, dengan pendekatan yuridis sosiologis dan metode pengumpulan data melalui observasi, wawancara dan studi dokumen.

Hasil penelitian ini menunjukkan bahwa implemtasi akad mudharabah di warung cawan coffe gayo Kota Malang sudah sesuai dengan rukun, dan syarat mudharabah dalam hukum Islam, akan tetapi masih dikatogori fasid (rusak) karena ada beberapa ketentuan syarat mudharabah yang dilanggar menurut ketentuan hukum Islam. Pertama, perjanjian kerja sama (akad mudharabah) sudah terpenuhi rukun, dan syarat akad mudharabah, hanya yang masih dikatorikan fasid (cacat) terkait dengan lupa memasukkan kriteria kelalaian pengelola usaha (mudharib) dalam akad mudharabah, dan pemilik modal (shahib al-mal) masih ikut mengcampuri urusan bisnis usahanya. Kedua, pembagian keuntungan kedua belah pihak sudah sesuai menurut persentase yang ditetapkan dalam perjanjian kerja sama, hanya yang masih dikatorikan fasid (cacat) terkait dengan kesepakatan biaya-biaya yang harus ditanggung oleh pengelola usaha yang mengurangi keuntungannya. Dan ketiga, perjanjian gaji/upah para karyawan sudah terpenuhi rukun dan syarat akad ijarah, hanya masih dikatorikan fasid (cacat) terkait dengan pembayaran gaji/upah belum memiliki standar, dan belum ada batasan wewenang yang jelas antara pengelola usaha dengan para karyawan.

ABSTRACT

In the concept of Islamic law, the implementation of thecontract mudharabahis an effort to build cooperation between the owner of the capital (shahib al-mal)and the business manager (mudharib)in order to manage a certain business sector that can generate profits, and the results of these profits are divided according to the contract agreement. cooperation (mudharabah contract).

This study aims to describe theimplementation of mudharabahin the gayo coffee shop in Malang, and how the implementation of mudharabahin the gayo coffee shop in Islamic law. This type of research is juridical empirical, with aapproach juridicalsociologicaland data collection methods through observation, interviews and document study.

The results of this study indicate that the implementation of thecontract mudharabahin the gayo coffee shop in Malang City is in accordance with the pillars, and therequirements mudharabah in Islamic law, but is still categorized as fasid(damaged) because there are several provisions of theconditions mudharabahwhich are violated according to the provisions of Islamic law. First,the cooperation agreement (mudharabah contract)has been fulfilled in harmony, and the terms of thecontract mudharabah,only those that are still categorized as fasid(defect) are related to forgetting to enter the criteria for business manager negligence (mudharib) in thecontract mudharabah, and the owner of the capital (shahib al-mal)still interfering in the business affairs of his business. Second, the profit sharing of both parties is appropriate according to the percentage stipulated in the cooperation agreement, only those that are still categorized as fasid(disability) are related to the agreed costs that must be borne by the business manager which reduces the profit. And third, the salary / wage agreement for employees has been fulfilled in harmony and the terms of thecontract ijarah, only it is still categorized as fasid(disability) related to the payment of salaries / wages that do not have standards, and there is no clear limit of authority between business managers and employees
