Implementasi pasal 106 ayat 1 undang-undang nomor 22 tahun 2009 tentang lalu lintas dan angkutan jalan terhadap pengendara ojek online yang menggunakan gps prespektif maslahah mursalah (studi kasus di kota Malang)

Latar belakang penelitian skripsi adalah dikarenakan banyaknya pengendara ojek online yang masih menggunakan fitur GPS di handphone dalam berkendara. Padahal penggunaan handphone termasuk mekakukan aktifitas lain yang bisa menimbulkan konsentrasi tidak wajar saat berkendara. Hal tersebut menarik penulis untuk meneliti terkait dengan implementasi Pasal 106 Ayat 1 Undang-Undang Nomor 22 Tahun 2009 terhadap pengendara ojek online yang menggunakan GPS di Kota Malang prespektif maslahah mursalah.

Fokus penelitian dalam skripsi ini adalah: 1) Bagaimana implementasi Pasal 106 Ayat 1 Undang Undang Lalu Lintas dan Angkutan jalan terhadap pengendara ojek online penguna aplikasi GPS ( Global Positioning System ) di Kota Malang? 2) Bagaimana tinjauan Maslahah Mursalah tentang penggunaan aplikasi GPS oleh pengendara ojek online di kota Malang ?

Metode penelitian yang digunakan adalah yuridis empiris dengan menggunakan pendekatan yuridis sosiologis. Data yang dikumpulkan berupa data primer dan data sekunder dengan melakukan wawaancara langsung,studi dokumentasi dan observasi. Analisis data dilakukan dengan cara mengumpulkan dan memveritifikasi data yang diperoleh dari lapangan, editing, klarifikasi, veritifikasi, analisis dan kesimpulan.

Hasil penelitian menunjukkan bahwa pertama implementasi penggunaan GPS oleh pengendara ojek online di Kota Malang masih belum sesuai dengan Pasal 106 Ayat 1 Undang-Undang Lalu Lintas dan Angkutan Jalan karena dalam faktanya dari pengendara ojek online masih banyak yang menggunakan handphone saat berkendara dan menganggap GPS adalah alat utama dalam menjalankan pekerjaannya. Kedua penggunaan GPS termasuk keadaan yang bisa membahayakan diri sendiri dan orang lain tetapi penggunaan GPS juga sangat dibutuhkan bagi profesi pekerjaan ojek online, kondisi darurat tersebut memperbolehkan adanya penggunaan GPS dengan tujuan untuk memenuhi kebutuhan dan memberi kemudahan bagi pemenuhan kebutuhan hidup manusia sesuai hakikat pokok maslahah mursalah.

The background of this thesis research is because many of online motorcycle taxi drivers who still use the GPS (Global Positioning System) feature on mobile phones in driving. Though the use of mobile phones, including carrying out other activities that can cause unnatural concentration when driving. It is interesting for the writer to examine the implementation of article 106 paragraph 1 of Law Number 22 Year 2009 for online motorcycle taxi drivers who use GPS in Malang City, from the perspective of the problematic problem.

The focus of the research in this thesis is: 1) How is the implementation of Article 106 Paragraph 1 of the Law on Road Traffic and Transport to online motorcycle taxi riders who use GPS applications in Malang City? 2) How does Maslahah Mursalah review about using GPS applications by online motorcycle taxi drivers in the city of Malang?

The research method in my thesis is empirical juridical using sociological. Data collected in the form of primary data and secondary data by conducting direct interview, documentation study and observation. Data analysis was carried out by collecting and verifying data obtained from the field, editing, clarification, verification, analysis and conclusions.

The results showed that the first implementation of the use of GPS by online motorcycle taxi drivers in Malang was still not in accordance with Article 106 paragraph 1 of the Law on Road Traffic and Transportation because in fact there were many online motorcycle taxi drivers who used cellphones while driving and considered GPS as a tool major in carrying out his work. Second, the use of GPS includes conditions that can endanger yourself and others, but the use of GPS is also very necessary for the profession of online motorcycle taxi, the emergency condition allows the use of GPS with the aim of meeting the needs and making it easy for the fulfillment of human needs according to the nature of the problem of the masses.
