Abstract

INDONESIA:

Dalam sistem Pembiayaan Hunian Syariah (PHS), hanya Bank Muamalat yang memiliki dua akad yang berbeda, yaitu akad Murâbahah dan akad Musyârakah Mutanâqishah. Rumusan masalah yang diambil dari penelitian ini adalah (a) Perbandingan PHS antara akad Murâbahah dan akad Musyârakah Mutanâqishah di Bank Muamalat Cabang Malang. (b) Keunggulan dan kelemahan PHS antara akad Murâbahah dan akad Musyârakah Mutanâqishah di Bank Muamalat Cabang Malang.

Metode yang digunakan dalam penelitian ini adalah metode deskriptif- komparatif dengan pendekatan kualitatif. Penelitian ini termasuk jenis penelitian hukum empiris. Penelitian ini menggunakan perusahaan perbankan yaitu Bank Muamalat Cabang Malang. Data dalam penelitian ini menggunakan data primer dan sekunder yang diperoleh dari Bank Muamalat Cabang Malang. Data ini diperoleh melalu wawancara atau metode dokumentasi dokumentasi (literatur- literatur tentang akad Murâbahah dan akad Musyârakah Mutanâqishah dalam Pembiayaan Hunian Syariah di kantor Bank Muamalat Cabang Malang).

Hasil dari penelitian ini dalam pembiayaan Murâbahah, yakni pihak bank membeli rumah yang diperlukan nasabah dan kemudian menjualnya kepada nasabah sebesar harga beli ditambah dengan margin keuntungan yang disepakati oleh bank dan nasabah. Sedangkan pembiayaan Musyârakah Mutanâqishah atau biasa disingkat dengan akad MMQ pada Bank Muamalat ini merupakan produk pembiayaan dengan sistem pengurangan porsi kepemilikan dari salah satu mitra ke mitra lainnya akibat pembelian porsi syarik secara bertahap. yang didalamnya terdapat unsur kerjasama (Syirkah) dan unsur sewa (Ijârah). Adapun keunggulan akad Murâbahah secara berturut-turut yaitu: (a) Bank dapat menetapkan margin keuntungan pasti di awal perjanjian, (b) Nasabah mendapatkan barang yang diinginkan dengan cara jual-beli angsur. Sedangkan keunggulan akad Musyârakah Mutanâqishah secara berturut-turut yaitu: (a) Mempererat hubungan antara Bank dan Nasabah karena sama-sama menjaga asset bersama, (b) Ada bagi hasil tambahan (nisbah) bagi Bank dan Nasabah, yakni pembayaran uang sewa atas pemanfaatan rumah. Adapun kelemahan akad Murâbahah adalah: (a) Resiko penjualan kembali atas rumah oleh Nasabah lebih besar karena barang sudah menjadi milik nasabah, (b) Bank tidak bisa mendapatkan keuntungan lebih atau bahkan rugi jika harga sewa pasaran diluar mengalami kenaikan. Sedangkan kelemahan akad Murâbahah adalah: (a) Bagi Bank, ia ikut menanggung bersama terhadap beban pajak dan biaya pemeliharaan atas rumah, (b) Bagi Nasabah, cicilan di tahun-tahun awal terasa memberatkan namun pada tahun-tahun berikutnya terasa lebih ringan.

ENGLISH:

In the Residential Financing Sharia (PHS) system, only Bank Muamalat have a different contract, that is Murabahah and Musharaka Mutanâqishah contract. The formulation of this research are (a) Comparison of PHS between Murabahah and Musharaka Mutanâqishah contract in Bank Muamalat Malang Branch. (b) Superiority and waekness of PHS between Murabahah and Musharaka Mutanâqishah contract in Bank Muamalat Malang Branch.

The method used in this research is descriptive-comparative method of qualitative approach. This research includes empirical legal research. This study used a banking company, Bank Muamalat Malang Branch. The data in this study using primary and secondary data obtained from Bank Muamalat Malang Branch. This data was obtained through interviews or method of documentation documentation (literature of Murabahah and Musharaka Mutanâqishah contract in Residential Financing Sharia in Malang branch office of Bank Muamalat).

The results of this study in Murabahah financing, the bank bought a house that needed customers and then sell it to the customer for the purchase price plus a profit margin agreed by the bank and the customer. While musyarakah Mutanâqishah or commonly abbreviated to contract with Bank Muamalat MMQ is a product of the system of financing the reduction of ownership from one partner to the other partner as a result of the purchase syarik portion gradually. in which there are elements of cooperation (Syirkah) and a lease (Ijara). The advantages of Murabahah, respectively, namely: (a) The Bank may establish definite profit margin at the beginning of the agreement, (b) the Customer obtain the desired goods by way of sale gradually. While the benefits Musharaka contract Mutanâqishah respectively: (a) Strengthen the relationship between the Bank and the Customer due to both maintain joint assets, (b) There is an additional profit sharing (ratio) for the Bank and the Customer, the payment of rent for use of the house . The weakness of Murabahah is: (a) Risk resale by the Customer on a bigger house because the goods belonged to the customer, (b) the Bank is not able to get more profits or even losses if the price of the rental market has increased beyond. While the weakness Mutanâqishah Musharaka contract is: (a) For the Bank, he joined together to bear the tax burden and the cost of maintenance of the house, (b) For Clients, installment in the early years was aggravating, but in subsequent years feels lighter.
