Abstract
INDONESIA:
Terjadi kesenjangan antara jumlah pemberi bantuan hukum, jam kerja layanan dan jumlah perkara yang memberikan dampak kualitas pelayanan yang didapatkan penerima bantuan hukum.Adapun fokus penelitian ini yaitu Bagaimana layanan bantuan hukum Posbakum di Pengadilan Agama Kabupaten dan Kota Malang dan Bagaimana menurut Peraturan Mahkamah Agung Nomer 1 Tahun 2014.
Penelitian ini termasuk kedalam jenis penelitian yuridis empiris. Pendekatan yang digunakan dalam penelitian inipendekatan yuridis sosiologis. Dalam metode pengumpulan data penulis menggunakan metode wawancara dan dokumentasi. Adapun pengolahan data melalui tahap-tahap yaitu pemeriksaan data, klasifikasi, verifikasi, analisis, dan pembuatan kesimpulan.
Hasil penelitian ini adalah pemberian bantuan hukum PA Kota dan Kabupaten Malang tidak seimbang dengan jam layanan terbatas dan jumlah perkara yang tidak sedikit tetapi, bantuan hukum yang diberikan sudah baik diterapkan dari aspek pemberian informasi, konsultasi, advis, membuat surat gugatan maupun permohonan sesuai yang dibutuhkan penerima bantuan hukum.
Kesimpulan ini bahwa menurut PERMA No. 1 Tahun 2014 bahwa layanan bantuan hukum Posbakum PA Kota Malang tersebut telah terpenuhi. Sedangkan tidak denganPA Kabupaten Malang yang berbeda dalam perihal standar operasional prosedur, bahwa yang mendapat bantuan hukum tidak harus kurang mampu secara ekonomi.
ENGLISH:
There is a gap between the number of legal grants, the service hours and the number of cases that provide the impact of service quality that the recipient of legal aid will obtain. The focus of this research is how the service of legal aid Posbakum in the religious court of the District and the city of Malang and how according to the Supreme Court Regulation number 1 year 2014.
This research is included in empirical research. The approach used in this research is the sociological juridical approach. In the method of collecting the authors data using interview methods and documentation. The data processing through the stages is data checking, classification, verification, analysis, and making conclusions.
The results of this research are the provision of legal assistance of PA Kota and Malang district are not balanced with limited service hours and the number of matters not least but, the legal aid given has been well implemented from the aspect of providing information, For consultation, advice, making a lawsuit or application as required by the recipient of legal aid.
This conclusion that according to PERMA No. 1 year 2014 that the legal Aid services Posbakum PA Kota Malang has been fulfilled. While not with PA district Malang different in regard to the operational standards of the procedure, that the legal aid should not be less economically able.
