Abstract

INDONESIA:

Peraturan Menteri Pendidikan dan Kebudayaan Nomor 20 Tahun 2019 Pasal 16 Tentang Sistem Zonasi merupakan rangkaian kebijakan utuh, terintegritas, dan sistematik dari upaya restorasi di sektor pendidikan khususnya di sistem sekolah. Peraturan Walikota Malang Nomor 35 Tahun 2019 Pasal 6 Tentang Sistem Zonasi. Peraturan Walikota Malang Nomor 35 Tahun 2019 Pasal 6 Tentang Sistem Zonasi masih banyak kekurangan, yaitu kegelisahan siswa dan Orang tua, Sekolah Swasta terkena akibat sistem zonasi, dan Sekolah Negeri terkena dampak akibat sistem zonasi.

Rumusan masalah dalam penelitian adalah Bagaimana Implementasi Peraturan Walikota Malang Nomor 35 Tahun 2019 Pasal 6 Tentang Sistem Zonasi di Kota Malang, Bagaimana Implementasi Peraturan Walikota Malang Nomor 35 Tahun 2019 Pasal 6 Tentang Sistem Zonasi Perspektif Maslahah Mursalah di Kota Malang. Jenis Penelitian yang digunakan yaitu Yuridis Empiris. Pendekatan Penelitian yang digunakan ialah Pendekatan Yuridis Sosiologis. Lokasi Penelitian SDN terdiri dari 5 Sekolah, SMPN terdiri dari 9 Sekolah, SMAN terdiri dari 1 Sekolah. Metode Penentuan Subjek dilakukan sampling di Sekolah di Kota Malang. Jenis dan Sumber Data yang digunakan adalah Data Primer dan Data Kualitatif.

Hasil penelitian ini adalah Pertama Sistem zonasi sekolah perspektif teori keadilan belum efektif dan adanya kehilangan hak bagi siswa, Orang tua, Guru, Sekolah SD SMP SMA. Kedua Sistem Zonasi Perspektif Maslahah Mursalah yaitu lebih banyak kemadharatan disebabkan kualitas pendidikan di Kota Malang menurun dan banyak masyarakat dirugikan oleh peraturan sistem zonasi. Kesimpulan dari penelitian ini adalah Sistem zoasi di Kota Malang sudah berjalan dengan baik namun masih banyak kekurangan dan masih banyak pihak yang dirugikan diantaranya Siswa, Guru, Orang tua, dan Sekolah.

Minister of Education and Culture Regulation Number 20 Year 2019 Article 16 Concerning Zoning System is a set of integrated, integrated and systematic policies of restoration efforts in the education sector especially in the school system. Malang Mayor Regulation Number 35 Year 2019 Article 6 Regarding Zoning System. Malang Mayor Regulation Number 35 Year 2019 Article 6 Concerning the Zoning System still has many shortcomings, namely the anxiety of students and parents, Private Schools affected by the zoning system, and Public Schools affected by the zoning system.

The formulation of the problem in this research is How to Implement Malang Mayor Regulation Number 35 Year 2019 Article 6 About the Zoning System by Perspective of Maslahah Maslahah in Malang. The used research type is Empirical Juridical. The research approach used is the Sociological Juridical Approach. SDN Research Sites consist of 5 Schools, SMPN consists of 9 Schools, SMAN consists of 1 Schools. Method of Determining Subjects was carried out sampling in Schools in Malang City. Types and Sources of Data used are Primary Data and Qualitative Data.

The results of this research are First the school zoning system perspective of the theory of justice has not been effective and there is a loss of rights for students, parents, teachers, elementary schools, junior high and high schools. Second, the Maslahah Mursalah Perspective in Zoning System is more disadvantage because the quality of education in Malang City is decreasing and many people are disadvantaged by the zoning system regulations.The conclusion of this research is that the zoning system in Malang City has run well but there are still many shortcomings and there are still many disadvantaged parties including Student, Teacher, Parent, and School.
