Jual beli merupakan salah satu jenis perjanjian yang diatur dalam Kitab Undang- Undang Hukum Perdata dan Kompilasi Hukum Ekonomi Syari’ah. Salah satunya Jual beli makanan model all you can eat. All you can eat adalah model penjualan menu di restoran dimana konsumen hanya membayar satu kali untuk dapat menikmati semua menu yang tersedia dengan konsep prasmanan atau buffet dengan batasan waktu tertentu. Penulisan skripsi ini bertujuan untuk mengetahui penerapan dari jual beli makanan model all you can eat ditinjau dari pasal 1320 Kitab Undang-Undnag Hukum Perdata dan Kompilasi Hukum Ekonomi Syari’ah.

Permasalahan di dalam skripsi ini berkisar tentang praktik jual beli makanan dengan model all you can eat di Kedai Sseasoning Korean Bbq Malang ditinjau dari KUHPerdata ? serta jual beli makanan dengan model all you can eat di Kedai Seasoning Korean Bbq Malang ditinjau dari Kompilasi Hukum Ekonomi Syariah?

Lokasi penelitian ini bertempat di kedai seasoning korean bbq Malang.Alasan daerah ini dijadikan tempat penelitian ialah, karena di tempat ini terjadi transaksi jual beli makanan dengan model all you can eat. Penulisan ini menggunakan penelitian lapangan (field research), yaitu dengan cara turun ke lapangan langsung/ lokasi penelitian. Teknik pengumpulan datanya adalah observasi, wawancara, dan studi dokumentasi. Setelah data terkumpul data kemudian dianalisis dengan menggunakan metode deskriptif analisis.

Dengan demikian dari hasil penelitian yang diperoleh di lapangan dapat disimpulkan bahwa pelaksanaan jual beli makanan model all you can eat yang ada di kedai seasoning korean bbq Malangt idak terlepas dari konsep perjanjian secara mendasar yang diatur dalam pasal 1320 KUHPerdata dan dalam kompilasi hukum ekonomi syariah diperbolehkan. Sebagaimana yang tercantum pada pasal 78 KHES telah memenuhi rukun dan syarat dalam jual beli namun ditemukan tidak terpenuhinya salah satu poin syarat ma’qud alaih yaitu barang harus diketahui jumlah, ukuran, dan takarannya. Sehingga diindikasikan terdpat kesamaran (gharar) di dalamnya. Namun gharar yang terdpat dalam pelaksanaan ini termasuk ke dalam gharar yasir (ringan) yang dapat dimaafkan sehingga jual beli ini masih diperbolehkan.

Buying and selling is one type of agreement regulated in the civil code and compication of sharia economic laws. On of them is buying and selling food models all you can eat. All you can eat is a menu selling models in restaurants where consumers only pay once to be able to enjoy all the menus available with the concept of a buffet or buffet with a certain time limit. The purpose of this thesis is to find out the application of all you can eat food buying and selling in terms of article 1320 of the civil code and the complication of sharia ecomic law.

The problem in this thesis revolves around the practice of buying and selling food with the all you can eat model at the Korean BBQ Sseasoning Shop Malang in terms of the Civil Code? as well as buying and selling food with the all you can eat model at the Korean Seasoning BBQ Bbq Malang in terms of Sharia Economic Law Compilation?

The location of this research is at Korean BBQ BBQ seasoning shop. The reason for this area is the place of research, because in this place, there is a transaction of buying and selling food with an all you can eat model. This writing uses field research, namely by going down to the field directly / research location. Data collection techniques are observation, interview, and study documentation. After the data has been collected, the data is then analyzed using descriptive analysis method.

This from the results of the research obtained in the field it can be concluded that the implementation of buying and selling food models of all you can eat in the Korean seasoning shop in Malang Malang can not be separated from the concept of the agreement basically governed in article 1320 of the Civil Code and in the compilation of Islamic economic law is permitted.
