Abstract
INDONESIA:
Saat ini bank BRI Syariah Kantor Cabang Malang dapat memberikan pembiayaan kepada calon debitur dengan menggunakan jaminan SK Pensiun, padahal SK Pensiun tidak memiliki daya eksekutorial ketika debitur mengalami risiko. Sebelum memberikan pembiayaan dengan jaminan SK pensiun, bank syariah tersebut harus menerapkan prinsip kehati-hatian untuk mengurangi terjadinya risiko. Salah satu upaya agar prinsip kehati-hatian tersebut dapat diterapkan adalah kebijakan penerapan Know Your Customer Principles yang mana bank syariah tersebut harus melakukan penilaian secara seksama terhadap character, capacity, capital, collateral dan condition of economic.
Adapun tujuan dari penelitian ini yaitu untuk mengetahui implementasi Peraturan Bank Indonesia No. 5/21/PBI/2003 tentang penerapan Know Your Customer Principles dan fiqih muamalah dalam perjanjian pembiayaan dengan jaminan Surat Keputusan Pensiun di Bank BRI Syariah Kantor Cabang Malang. Penelitian ini merupakan penelitian yuridis empiris dengan pendekatan yuridis sosiologis. Sumber data yang digunakan adalah sumber data primer yaitu wawancara dan dokumentasi, serta sumber data sekunder yaitu literatur yang berkaitan dengan penelitian ini.
Hasil penelitian ini menunjukkan bahwa penerapan Know Your Customer Principles dalam perjanjian pembiayaan dengan jaminan Surat Keputusan Pensiun di Bank BRI Syariah Kantor Cabang Malang sudah diterapkan dan sesuai dengan Peraturan Bank Indonesia No. 5/21/PBI/2003 di mana kriteria penilaiannya lebih difokuskan pada character, capacity, dan collateral. Sedangkan menurut fiqih muamalah secara objektif Surat Keputusan Pensiun di Bank BRI Syariah Kantor Cabang Malang sekalipun tidak memiliki daya eksekutorial, tetapi secara subjektif memiliki nilai yang tinggi dan berharga bagi nasabah dan bagi bank syariah tersebut karena dikeluarkan oleh instansi pemerintah yang tentu legalitas dan integritasnya tidak diragukan lagi.
ENGLISH:
At present the BRI Sharia of Malang Branch Office can provide financing to prospective debtors using the SK Pension pension plan, even though SK Pension does not have executive power when the debtor is at risk. Before providing financing with a SK pension guarantee, the Islamic bank must apply the precautionary principle to reduce the occurrence of risks. One of the efforts so that the precautionary principle can be applied is the policy of implementing Know Your Customer Principles in which the Islamic bank must carefully assess character, capacity, capital, collateral and condition of economic.
The purpose of this study is to determine the implementation of Bank Indonesia Regulation No. 5/21/PBI/2003 concerning the implementation of Know Your Customer Principles and muamalah fiqh in financing agreements with the guarantee of a Pension Decree at BRI Sharia of Malang Branch Office. This research is an empirical juridical research with a sociological juridical approach. Sources of data used are primary data sources, namely interviews and documentation, as well as secondary data sources, namely literature related to this study.
The results of this study indicate that the application of Know Your Customer Principles in the guarantee agreement with a Pension Decree in BRI Sharia of Malang Branch Office has been implemented and in accordance with Bank Indonesia Regulation No. 5/21/PBI/2003 where the assessment criteria are more focused on character, capacity, and collateral. Whereas according to muamalah fiqh objectively the Pension Decree contained in the BRI Sharia of Malang Branch Office even though it does not have executive power, but in subjective has a high value and is valuable for people who retire and for the Islamic bank because it is issued by a government agency whose legality and integrity is undoubtedly.
