Pekerja sebagai kreditur preferen dalam perusahaan pailit: Tinjauan hukum positif dan hukum Islam

Kepailitan merupakan proses dimana seorang debitur yang memiliki kesulitan keuangan untuk membayar utangnya karena dinyatakan pailit oleh Pengadilan Niaga. Dengan ditetapkannya suatu keadaan pailit berarti kekayaan debitur berada dibawah sita umum dan debitur demi hukum telah kehilangan hak untuk menguasai karena dianggap tidak mampu lagi.

Penelitian ini membahas mengenai pengaturan pekerja sebagai kreditur preferen dalam perusahaan pailit ditinjau dari hukum positif dan hukum Islam. Yang bertujuan untuk mengetahui bagaimana pengaturan pekerja dari segi hukum positif dan hukum Islam jika suatu perusahaan mengalami pailit, apakah hak-hak pekerja dalam perusahaan pailit sudah terpenuhi sesuai dengan ketentuan hukum positif yaitu Undang-Undang dan hukum Islam.

Penelitian ini tergolong dalam jenis penelitian normatif atau penelitian kepustakaan (library research). Pendekatan yang digunakan dalam penelitian ini adalah pendekatan Undang-Undang (Statute Aproach) dan pendekatan konseptual (conceptual aproach) yaitu pendekatan yang dilakukan dengan menelaah semua peraturan perundang-undangan yang bersangkutan dan menelaah pandangan-pandangan hukum Islam yang berkembang khususnya dalam hal kepailitan (taflis).

Hasil dari penelitian ini menunjukkan bahwa: 1. Pekerja yang bekerja dalam suatu perusahaan, jika perusahaan mengalami pailit mereka tetap berhak mendapatkan gaji karena memiliki hak istimewa yaitu sebagai kreditur preferen sesuai Pasal 95 ayat (4) Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, 2. Menurut hukum Islam meskipun perusahaan dalam keadaan pailit, pekerja tetap harus dibayar gajinya meskipun dengan cara dicicil. Karena membayar hutang merupakan kewajban yang harus dipenuhi.

Bankruptcy is the process by which a debtor has financial difficulties to pay off his debt due to being declared bankrupt by the Commercial Court. With the stipulation of a bankruptcy situation, the debtor's wealth is under the general seizure and the debtor for the sake of law has lost the right to control because it is deemed incapable.

This study discusses the regulation of workers as preferred creditors in bankrupt companies in terms of positive law and Islamic law. The aim of the study is to find out how workers are regulated in terms of positive law and Islamic law if a company goes bankrupt, whether the rights of workers in a bankrupt company have been fulfilled in accordance with the positive legal provisions of Islamic law and law.

This study is classified as a type of normative research or library research. The approach used in this study is the approach of the Law (Statute approach) and conceptual approach (conceptual approach) that the approach was taken by examining all the legislation in question and examines the views of the Islamic law that developed in particular in the event of bankruptcy (taflis).

The results of this study indicate that: 1. The workers who work in a company, if the company experiences bankruptcy they have the right to get a salary because they have special rights, namely as the preferred creditor in accordance with Article 95 paragraph (4) of Law Number 13 Year 2003 concerning Labor, 2. According to Islamic law even though the company is in a state of bankruptcy, workers must still be paid a salary even though by installments, because paying a debt is an obligation that must be fulfilled.
