Jual beli online melalui aplikasi E-Cafe Bhawikarsu di Sekolah Menengah Atas Negeri 3 Kota Malang tinjauan kompilasi hukum ekonomi syariah Jurusan Hukum Bisnis Syariah

Penelitian ini membahas bagaimana mekanisme praktik jual beli online melalui aplikasi di kantin elektronik SMAN 3 Kota Malang dan bagaimana tinjauan Kompilasi Hukum Ekonomi Syariah terhadap praktek jual beli online melalui aplikasi e-café bhawikarsu di kantin elektronik SMAN 3 Kota Malang. Jenis penelitian ini menggunakan jenis penelitian yuridis empiris atau law field research. Metode pendekatan yang digunakan didalam penelitian ini adalah pendekatan yuridis sosiologis. Pendekatan yuridis sosiologis ini digunakan peneliti untuk mendeskripsikan data yang ditemukan dilapangan. Lokasi penelitian berada di kantin elektronik SMAN 3 Kota Malang. Kemudian metode pengumpulan data yang peneliti gunakan adalah dengan metode wawancara, observasi dan dokumentasi. Hasil penelitian ini menunjukan bahwa transaksi jual beli online melalui aplikasi e-café bhawikarsu menggunakan akad salam dengan bentuk transaksi pemesanan yang dilakukan melalui aplikasi android berbasis online. Adapun mekanisme pembayaran dilakukan secara cashless atau nontunai yaitu pemotongan saldo didalam aplikasi. Setelah pesanan sudah jadi konsumen bisa mengambilnya di kantin dengan menunjukan barcode atau bukti pembayaran yang sah. Sistem jual beli online melalui aplikasi menurut tinjauan Kompilasi Hukum Ekonomi Syariah pasal 100, 101, 102, dan 103 semuanya dapat terpenuhi dan dinyatakan sah, dalam perkembangannya transaksi online ini hukumnya boleh, karena barang yang diperjual belikan halal dan juga terhindar dari tindakan penipuan (gharar) yang bisa menimbulkan masalah dikemudian hari.

This research discussed the mechanism of the e-commerce practice on the applications at State High School 3 Malang electronic cafeteria and discussed the Sharia Economic Law Compilation reviews toward the practice of e-commerce on the e-café Bhawikarsu application at the electronic cafeteria of State High School 3 Malang. The research applied empirical juridical research type or law field research. The approach method used in this research was a sociological juridical approach. The sociological juridical approach was utilized by researchers to describe the data found in the field. Electronic cafeteria of State High School 3 Malang was chosen as the research location. The data collection method that the researcher had done was by interview, observation, and documentation. The results of this research indicated that e-commerce activity on the e-café Bhawikarsu application had already applied (akad salam) contracts in the form of transactions order made on the online based android application. The payment mechanism made in a cashless payment by which reducing the balance on the application. After the order has been made, the consumer can have it in the canteen by showing a barcode or valid proof of payment. The e-commerce system on the application according to the review in the compilation of Sharia Economic Law articles 101 to 103. However, the terms and conditions of this e-commerce activity were not fulfilled clearly due to the coercion of the manager to the students. Still, in its development, this e-commerce may be legal, because the goods are traded halal and also avoid fraud (gharar) which can cause problems in the future
