Abstract
INDONESIA:
Perjanjian pendahuluan jual beli diperbolehkan menurut Undang-Undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman apabila pengembang telah memenuhi syarat kepastian atas status kepemilikan tanah, kepemilikan izin mendirikan bangunan induk, ketersediaan prasarana, sarana dan utilitas umum, memenuhi keterbangunan perumahan minimal 20% (dua puluh persen) dan terpenuhinya hal-hal yang diperjanjikan.
Skripsi ini membahas tentang 1. Mengetahui kepastian hukum hak-hak konsumen dalam perjanjian pendahuluan jual beli atas pemasaran “Perumahan The Emerald” dengan sistem pre project selling ditinjau berdasarkan Pasal 42 Undang-Undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman 2. Menganalisa transaksi jual beli “Perumahan The Emerald” dengan sistem pemasaran pre project selling ditinjau dalam perspektif Kompilasi Hukum Ekonomi Syariah (KHES).
Jenis penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan yuridis sosiologis. Sebagian sumber data yang digunakan yaitu wawancara dengan literatur Undang-Undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman.
Hasil penelitian ini yaitu sebagai berikut: 1. Perumahan The Emerald Malang belum menerapkan apa yang terdapat dalam Pasal 42 ayat 2 Undang-Undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan, yaitu terkait dengan belum tersedianya prasarana, sarana dan utilitas umum; belum memiliki keterbangunan paling sedikit 20% (dua puluh persen); belum terpenuhinya hal yang diperjanjikan. 2. Ditinjau dari hukum Islam belum sesuai dengan Pasal 106 dan 107 Kompilasi Hukum Ekonomi Syariah terkait dengan tersedianya fasilitas umum dan keterlambatan pembangunan sesuai dengan waktu yang telah disepakati berdasarkan akad istishna’.
ENGLISH:
The preliminary sale and purchase agreement is permissible according to Law Number 1 of 2011 concerning Housing and Settlement Area if the developer has fulfilled the certainty requirements for land ownership status, ownership of the main building permit, availability of infrastructure, facilities and public utilities, fulfilling housing construction at least 20% ( twenty percent) and fulfillment of the things agreed upon.
This thesis discusses 1. Knowing the legal certainty of consumer rights in the preliminary sale and purchase agreement on the marketing of "The Emerald Housing" with a pre-project selling system reviewed based on Article 42 of Act Number 1 of 2011 concerning Housing and Settlement Area 2. Analyzing transactions buying and selling "The Emerald Housing" with a pre-project selling marketing system is reviewed in the perspective of Sharia Economic Law Compilation.
The type of research used is empirical legal research with a sociological juridical approach. Some of the data sources used are interviews with literature Law Number 1 of 2011 concerning Housing and Settlement Areas.
The results of this study are as follows: 1. Housing of The Emerald Malang has not applied what is contained in Article 42 paragraph 2 of Act Number 1 of 2011 concerning Housing and Regions, which is related to the unavailability of infrastructure, facilities and public utilities; does not have a minimum of 20% (twenty percent) of development; the agreed thing has not been fulfilled. 2. In terms of Islamic law it is not in accordance with Article 106 and 107 Compilation of Sharia Economic Law related to the availability of public facilities and the delay in development in accordance with the agreed time based on the istishna agreement.
