Efektivitas penerapan Peraturan Daerah Nomor 6 Tahun 2008 tentang Pedagang Kaki Lima di RS. Soebandi Kabupaten Jember: Kajian integratif hukum positif dan maslahah mursalah

Peraturan Daerah Kabupaten Jember Nomor 6 Tahun 2008 Tentang Pedagang Kaki Lima ini telah berlaku tetapi belum terlaksana dengan maksimal. Penelitian ini bertujuan untuk mengetahui efektivitas dari Peraturan Daerah Nomor 6 Tahun 2008 Tentang Pedagang Kaki Lima terhadap pelanggaran aturan Pedagang Kaki Lima dan faktor-faktor yang menghambat pemerintah dalam mengatasi penegakan Peraturan Daerah Kabupaten Jember serta ditinjau dari Maslahah Mursalah sebagai perbandingan dalam hukum Islam. Penelitian ini dilakukan di Jalan RS. Dr. Soebandi Jember.

Jenis penelitian ini menggunakan yuridis empiris dengan pendekatan yuridis sosiologis. Lokasi penelitian ini di jalan trotoar RS. Dr. Soebandi Kabupaten Jember. Menggunakan sumber data primer yaitu wawancara Kepala Bidang Penegak Produk Hukum Daerah Satpol PP Kabupaten Jember, Kasubak Kerjasama dan Dokumentasi Bagian Hukum Sekretariat Pemda Jember, para pedagang kaki lima, konsumen dan pengguna jalan, dan data sekunder yaitu data yang diperoleh berupa kata-kata, sumber data tertulis, foto, dan tindakan.

Hasil dari penelitian ini menyimpulkan bahwa, efektivitas Peraturan Daerah Nomor 6 Tahun 2008 Tentang Pedagang Kaki Lima Kabupaten Jember masih belum efektif. Hal tersebut terjadi karena para pedagang kaki lima tidak mentaati peraturan tersebut dan kesediaan alokasi resmi dari pemerintah sangat minim. Faktor hukum, faktor penegak hukum, faktor sarana dan fasilitas, faktor masyarakat dan faktor budaya hukum menjadi hambatan dalam mengatasi pelanggaran pedagang kaki lima di jalan trotoar RS. Dr. Soebandi Jember. Faktor-faktor tersebut mempengaruhi efektivitas penerapan Peraturan Daerah Nomor 6 Tahun 2008 Tentang Pedagang Kaki Lima Kabupaten Jember. Ketidak tersedianya fasilitas lokasi yang memadai dalam hukum Islam termasuk maslahah hajiyah karena adaanya PKL sangat membantu sebagian orang dan membawa kemudhorotan bagi sebagian masyarakat terutama pemerintah, karena sangat mengganggu ketertiban umum. Keberadaan Pedagang Kaki Lima di trotoar jalan RS. Dr. Soebandi Jember adalah bentuk ketidak terpenuhinya maslahah mursalah bagi para masyrakat secara umum.

The Regional Regulation of Jember Regency Number 6 of 2008 concerning Street Vendors is valid but has not carried out yet maximally. This study aims to determine the effectiveness of Regional Regulation No. 6 of 2008 concerning Street Vendors against violations of the rules of street vendors and the factors that inhibit the government in overcoming the enforcement of the Regional Regulation of Jember Regency and viewed from Maslahah Mursalah as a comparison in Islamic law. This research did in Dr. Soebandi Hospital.

This type of research uses empirical juridical with a sociological juridical approach. The location of this study is on the sidewalk of the Dr. Soebandi Hospital, Jember Regency. The primary data source of this study is the result of interview with the Head of the Regional Legal Products Enforcement Section of the Jember Regency Police Unit, the Head of the sub-section of Cooperation, and Documentation of the Legal Section of the Jember Regional Government Secretariat, street vendors, consumers and road users, and secondary data are obtained in the form of words, written data sources, photos, and actions.

The results of this study conclude that, the effectiveness of Regional Regulation Number 6 of 2008 concerning Street Vendors in Jember Regency is still not effective. This happened because the street vendors did not comply with the regulation and the willingness of official allocations from the government was very minimal. Legal factors, law enforcement factors, facilities factors, community factors and legal cultural factors are obstacles in dealing with street vendor violations on the sidewalks of Dr. Soebandi Hospitals Jember. These factors influence the effectiveness of the application of Regional Regulation Number 6 of 2008 concerning Street Vendors in Jember Regency. The unavailability of adequate location facilities in Islamic law including maslahah hajiyah because of the presence of street vendors is very helpful for some people and brings harm to some people, especially the government, because it is very disturbing public order. The presence of street vendors on the sidewalks of Dr. Soebandi Hospital Jember is a form of unfulfilled maslahah mursalah for the community in general.
