Pencegahan manipulasi identitas dalam perkawinan oleh Kantor Urusan Agama dalam prespektif Sadd ad-Dzarî’ah: studi di Kantor Urusan Agama Kecamatan Balerejo Kabupaten Madiun

Tugas KUA adalah melayani dan mengawasi peristiwa perkawinan masyarakat yang beragama Islam. Dalam pelaksanaan tugasnya, KUA menghadapi berbagai pelanggaran yang terjadi, salah satunya yaitu pemalsuan identitas. Berdasarkan kejadian tersebut, KUA memiliki berbagai kebijakan sebagai upaya pencegahan manipulasi identitas dalam perkawinan. Terkait untuk mengetahui manipulasi dan kejadiannya dengan berfokus dalam dua rumusan masalah yaitu terjadinya manipulasi identitas dalam perkawinan dan upaya pencegahannya di Kantor Urusan Agama Kecamatan Balerejo serta pencegahan manipulasi identitas dalam perkawinan ditinjau dalam perspektif Sadd Ad-Dzarî’ah.

Penelitian ini adalah penelitian empiris yang menggunakan metode analisis deskriptif dengan pendekatan kualitatif. Sumber data primer dikumpulkan melalui dokumentasi dan wawancara dengan beberapa informan yang terkait dengan kasus yang dikaji yaitu Kepala dan staff KUA Kecamatan Balerejo. Kemudian, didukung dengan data sekunder dalam menganalisis hasil penelitiannya.

Dari hasil penelitian ini menunjukkan bahwa manipulasi identitas yang terjadi di KUA Kecamatan Balerejo adalah memalsukan status dari janda mengaku sebagai perawan yang dilakukan pihak isteri dalam berkas pemeriksaan nikah. Untuk itu KUA Kecamatan Balerejo mengupayakan pencegahan manipulasi identitas dalam perkawinan melalui pemeriksaan nikah dengan memastikan akurasi data dan keaslian dokumen, bimbingan perkawinan untuk memberikan pemahaman hukum perkawinan, penerpan SIMKAH online untuk memudahkan verifikasi data, dan pembinaan pegawai pencatat nikah agar paham dengan hukum perkawinan. Ketika sebuah manipulasi identitas dibiarkan saja, maka akan menimbulkan kerusakan yang semakin parah dalam perkawinan. Sehingga adanya upaya pencegahan ini menjadi sebuah solusi untuk meminimalisir manipulasi identitas dalam perkawinan agar tidak terjadi. Upaya pencegahan ini sejalan dengan metode Sadd Ad-Dzarî’ah, mengupayakan kemaslahatan dalam perkawinan supaya tidak terjadi kerusakan / mafsadah sebagai cara terbaik untuk menghindari batalnya ikatan perkawinan. Dengan adanya upaya pencegahan ini petugas yang berhubungan dengan pencatatan perkawinan, calon pengantin, maupun masyarakat akan lebih teliti dan taat pada hukum sehingga tujuan kemaslahatan akan tercapai.

The task of KUA is to serve and supervise the marital events of the Muslim society. In the performance of it duties, KUA faced a lot of violations that occurred, one of which is identity counterfeiting. Based on the incident, KUA has a lot of policies as an effort to prevent identity manipulation in marriage. Related to the manipulation and occurrence by focusing on two problems of the problem is the occurrence of identity manipulation in marriage and its prevention efforts in the Office of Balerejo District religious Affairs and the Prevention of identity manipulation In marriage are reviewed in the perspective of Sadd Ad-Dzarî’ah.

This research is empirical research using the descriptive analysis method with the qualitative approach. The sources of primary data were collected through documentation and interviews with several informants related to the cases studied, namely the Head and staff of the KUA in the District of Balerejo. Then, be supported with source secondary data in analization of the research result.

From the results of this study shows that the identity manipulation that occurred in the KUA district of Balerejo is falsify the status of widows claiming to be a virgin done by the wife in a file of marriage examination. For that the KUA district Balerejo seeks to prevent identity manipulation in marriage through marriage examination by ensuring the accuracy of the data and the authenticity of the document, marriage guidance to provide understanding of marriage law, aviator SIMKAH online to facilitate the verification of data, and the development of marriage registrar officers to understand the marriage law. When an identity manipulation is left alone, it will inflict increasingly severe damage in marriage. The prevention efforts become the solution to minimize identity manipulation in marriage there will not be collateral. This precautionary effort is in line with the method of Sadd Ad-Dzarî’ah, looking for the benefit for marriage there wil not be collateral damage/Mafsadah as the best way to avoid the stem of marriage. With the prevention efforts of the officers who relates to the registration of marriage, prospective brides, and society will be more thorough and obedient to the law so that the purpose of benefit will be achieved.
