Abstract
INDONESIA:
Permasalahan hukum kewarisan dalam Islam yang mengandung kontroversi adalah masalah radd. Masalah ini terjadi, apabila dalam pembagian harta waris terdapat sisa harta setelah ahli waris ash-hâb al-furûdl memperoleh bagiannya. Cara radd ditempuh untuk mengembalikan sisa harta kepada ahli waris ash-hâb al-furûdl. Diantara ulama yang menyetujui tentang adanya masalah radd dalam pembagian harta waris adalah Muhammad „Alî al-Shâbûnî. Ia berpendapat bahwa apabila dalam pembagian harta waris terdapat sisa harta setelah dibagikan kepada ahli waris ash- hâb al-furûdl menurut bagiannya masing-masing, dan tidak ada ahli waris „ashâbah, maka sisa harta tersebut diserahkan kepada seluruh ahli waris ash-hâb al-furûdl selain suami atau istri. Berbeda dengan Kompilasi Hukum Islam, dengan memperhatikan pasal 193, menurut Kompilasi Hukum Islam sisa harta tersebut diberikan kepada seluruh ahli waris ash-hâb al-furûdl, tanpa terkecuali.
Adapun tujuan dari pembahasan masalah ini, antara lain; (1) Untuk mengetahui konsep ahli waris penerima radd menurut Muhammad „Alî al-Shâbûnî dan cara perhitungannya, (2) Untuk mengetahui konsep ahli waris penerima radd menurut Kompilasi Hukum Islam dan cara perhitungannya, (3) Untuk mengetahui persamaan dan perbedaan antara Muhammad „Alî al-Shâbûnî dan Kompilasi Hukum Islam dalam konsep penerima radd.
Dilihat dari jenisnya, penelitian ini termasuk penelitian kepustakaan (library research) dengan cara mengkaji sumber pustaka sebagai sumber data, adapun sumber data yang penulis perlukan dalam pembahasan ini berupa buku-buku hukum kewarisan Islam tentang masalah radd secara umum dan buku-buku yang ada kaitannya dengan ahli waris yang berhak mendapatkan sisa harta dalam masalah radd menurut Muhammad „Alî al-Shâbûnî dan Kompilasi Hukum Islam.
Dari hasil penelitian ini diperoleh kesimpulan bahwa menurut Muhammad „Alî al-Shâbûnîahli ahli waris ash-hâb al-furûdl yang berhak mendapatkan sisa harta dalam masalah radd ada delapan orang yaitu; Anak Perempuan, Cucu Perempuan dari Anak Laki-laki, Saudara Perempuan Sekandung, Saudara Perempuan Seayah, Ibu, Nenek yang shâhih, Saudara Perempuan Seibu, Saudara Laki-laki Seibu. Cara penyelesaiannya yaitu, bagian suami atau istri diserahkan terlebih dahulu kemudian sisa harta setelah diserahkan kepada suami atau istri dikembalikan kepada ahli waris yang lain. Sedangkan menurut Kompilasi Hukum Islam ada dua belas yaitu suami atau istri, ayah, kakek keatas, Anak Perempuan, Cucu Perempuan dari Anak Laki- laki, Saudara Perempuan Sekandung, Saudara Perempuan Seayah, Ibu, Nenek yang shâhih, Saudara Perempuan Seibu, Saudara Laki-laki Seibu. Adapun cara penyelesaiannya yaitu, asal masalah diambilkan dari pembilangnya kemudian harta waris dibagi dengan pembilang, baru setelah itu diserahkan kepada ahli waris sesuai dengan bagiannya masing-masing.
ENGLISH:
The problem of hereditary law in Islam which contains a controversial is radd. This happens if there is a residuary in the division of the heir after the inheritor ash- hâb al-furûdl receives each part. The radd is taken up for giving the residuary back to the inheritor ash-hâb al-furûdl and is devided equally. Ulama that agrees about radd is Muhammad Ali Al-Shabuni. According to Al-Shabuni, if in there is a residuary in the division of the heir after the inheritor ash-hâb al-furûdl receiving each part, and there is no „ashâbah inheritor, so the residuary is given over to all inheritors ash-hâb al-furûdl except a husband or a wife. It is different from the Islamic Law Complation. By considering the section of 193, residuary is given to all inheritors ash-hâb al-furûdl without no exception.
However, the aim of the discussion are: (1) to know the concept of the receiver of radd Inheritor According to al-Shâbûnî and the calculation, (2) to know the concept of the receiver of radd Inheritor According to Islamic Law Compilation and the calculation, (3) to know the similarity and the difference betwen them.
By seeing the type, this research is included to the library research by examining the bibliography as a data sources. And the data sources which researcher needs in this research are Islamic hereditary law books about radd in general and many books which have relation with the residuary in radd according to al-Shâbûnî and Islamic Law Compilation.
Based on the research, the researcher acquires a conclusion that according to al-Shâbûnî, 8 inheritors ash-hâb al-furûdl who get the residuary in radd are daughters, granddaughters from the son, blood sisters, sisters from the same father, mother, grandmother, sisters from the same mother. The resolution is the heir part for the wife is given first to her and the residuary is given back to the other inheritors. Whereas, according to Law Compilation, there are 12 inheritors. Those are husband or wife, father, grandfather to the up, daughter, granddaughter from the son, blood daughter, daughter from the same father, mother, grandmother, daughter from the same mother, son from the same mother. The resolution is taking the numerator then the heir is divided by the numerator and is given to the inheritor accord with each part.
