Abstract
INDONESIA:
Keberadaan Mahkamah Agung adalah salah satu penyelenggara kehakiman yang memiliki wewenang di antaranya yaitu menguji pengaturan perundang-undangan di bawah Undang-Undang terhadap peraturan perundang-undangan yang lebih tinggi. Beberapa bulan lalu ada enam orang driver taksi online yang mengajukan permohonan Hak Uji Materiil ke Mahkamah Agung untuk membatalkan keempat belas pasal yang dianggap bertentangan dengan UU No.22/2009 tentang Lalu Lintas dan Angkutan Jalandan UU No.20/2008 tentang Usaha Mikro Kecil dan Menengah, karena memberatkan pihak transportasi online. Mahkamah Agung mengabulkan permohonan para pemohon berdasarkan pertimbangan-pertimbangan tersebut, hal tersebut menimbulkan kekosongan hukum beberapa bulan lalu. SehinggaMenteri Perhubungan harus segera merevisi aturan PM No.26/2017 untuk mengisi kekosongan hukum tersebut. Maka penulis ingin mengetahui bagaimana Akibat hukum putusan Mahkamah Agung No. 37P/HUM/2017 terhadap pengaturan angkutan sewa khusus berbasis aplikasi online perspektif Undang-Undang No. 22/2009 tentang Lalu Lintas dan Angkutan Jalan dan Maqashid Syariah. Metode penelitian yang digunakan dalam penelitian ini adalahyuridis normatif dengan menggunakan pendekatan undang-undang, dan pendekatan konsep dalam rangka analisis bahan hukum. Bahan hukum primer dikumpulkan dari undang-undang dan peraturan-peraturan yang terkait dengan penelitian penulis. Dokumentasi dan literatur tentang persoalan yang terkait digunakan sebagai bahan hukum sekunder.
Hasil penelitian inimenunjukanbahwa akibat hukum putusan Mahkamah Agung No. 37 P/HUM/2017 yaitu mengharuskan Menteri Perhubungan membuat peraturan baru agar tidak terjadi kekosongan hukum. Maka dari itu, terbitlah Peraturan Menteri Perhubungan yang baru (PM No. 108/2017) dan harus sesuai dengan Undang-Undang No.22/2009 tentang Lalu Lintas dan Angkutan Jalan. PandanganMaqashid Syariahterhadap Putusan Mahkamah Agung No. 37 P/HUM/2017 yaitu dengan memelihara jiwa, memelihara akal dan memelihara harta. Dikarenakan dengan memelihara atau menjaga tujuan Maqashid Syariah tersebut maka manusia dapat menjalankan usahanya dengan jalan yang diridhai Allah SWT. sehingga terhindar dari kemudharatan seperti riba, gharar dan hal-hal yang dapat mengancam keamanan dan keselamatan jiwa seseorang.
ENGLISH:
The existence of the Supreme Court was one of the organizers of Justice which has the authority of which that is testing the setting of legislation under the law against the legislation. A few months ago there was a six-person taxi driver online that apply the right Test Materially to the Supreme Court to cancel the fourteenth article that is considered contrary to the Act No. 22 of year 2009 about traffic and Road Transport and Act No. 20 Year 2008 of micro, small and medium enterprises, since incriminating transportation parties online. The Supreme Court granted the petition of the applicant on the basis of these considerations, it would give rise to a legal vacuum a few months ago. So that the Minister of transport should immediately revise rules PM number 26 Years 2017 to fill the void the law. Then the author would like to know how the legal consequences of the Supreme Court's verdict No. 37 P/HUM/2017 against special lease based transport settings online applications perspectives of law No. 22 of year 2009 about traffic and Road Transport and Trends The Sharia. Research methods used in this research is the juridical normative approach of using legislation, concept and approach in the framework of the analysis of legal materials. The primary legal materials collected from the laws and regulations related to the research of the author. Documentation and literature on issues related to legal materials used as secondary.
The results of this research show that the legal consequences of the Supreme Court's verdict No. 37 P/HUM/2017 i.e. requires the Minister of transport to make new rules to avoid a legal void occurring. Thus, the terbitlah of the new Minister of Transportation Regulations (regulation of the Minister of transportation Number 108 Year 2017) and must be in accordance with Act No. 22 of year 2009 about traffic and Road Transport. Islamic view of Trends against the ruling of the Supreme Court No. 37 P/HUM/2017 i.e. by keeping soul, nourish and maintain the property. Because by keeping or maintaining the goal of Islamic Trends that humans can run his business with the path that approves of Allah SWT. so avoid losses such as usury, obscurity and matters that may threaten the security and safety of one's soul.
