تحدث عن معاملة بيع الشراء،فواجب لمعرفة من أحكام بيع الشراء بالصحيح و المناسسب.إذن، الشخص الذي عمل في التجاري لابد ليعرف بين الحق او الباطل في بيع الشراء. هذه مشكلة معاملة، و الله حدد القانون اللعام و الأصول العام ايضا. تطوير في الزمان الأن ظهر الأعمال التجارية التي استعمال مبدء الشريعة من أحد تجاري العيني يستخدم نظام االشريعة في العملية اللتجارية. هم استعملوا ميثاق الإستصنع يعني بنظام الحجز.لكن المشترى لم يفهم عن ميثاق الإستصنع.

من فوق مشكلة الباحث هدف ليعرف كيفية بيع الشراء في العيني دو بريمه تنغغول وولونغ هونيان الإسلامي منظور الجمع حكم الإقتصاد الإسلامي في الباب104 حتي 108 عن بيع الإستصنع. الباحث أراد معرفة يناسب بنظام بيع الشراء في دو بريمه تنغغول وولونغ هونيان الإسلامي منظور الجمع حكم الإقتصاد الإسلامي. هذا باحث استخدم من نوع بحث نظام حكم التجريبي بتقريب بحث النوعي. لأن ليجد بيانات احتيج بالمقابلة و بالنظرإلى الميدان الحقيقي عن الميثاق يفعل بين المشترى و صانع العيني.

من نتيجة وجدت تبين ان بيع شراء البيت دو بريمه تنغغول وولونغ هونيان الإسلامي منظور الجمع حكم الإقتصاد الإسلامي في الباب104 حتي 108 عن بيع الإستصنع. بعض من بيع الإستصنع لما يتحقق الكامل.لأن كون من بضاعة لا تناسب الحجز او الفساد. الحاجز ملك حق الخيار لإستمرار أو أبطال الميثاق، لكن في القيادته من بريمه تنغغول وولونغ لا يبيح المشترى لأبطل الميثاق لأن موجود فساد على بضاعة.

ABSTRACT

Talking about buying and selling, then you must know the law of sale and purchase correctly and appropriate. Therefore, someone who is directly involved in the business world must understand how buying and selling to be legal or not and things that’s result in the sale and purchase are legal or not. In muamalat case Allah has decided general law and general basics as well. As the time passes, there are many works in business world which appear using sharia principle. One of them is housing business which applies sharia principle in the transaction. They use istishna’ akad (contract) with the ordering system. However, there are still buyers who have not understand istishna’ akad (contract).

Based on the problems above, the researcher want to know how the process of buying and selling houses in De Prima Tunggulwulung Islamic Housing in Malang with the Compilation of Islamic Economic Law perspective subsection 104 until 108 about Istishna’ Bai’. The researcher want to know compatibility of buying and selling system in De Prima Tunggulwulung Islamic Housing in Malang perspective Compilation of Islamic Economic Law. This research using qualitative research approach. Reasons for using method above is in order to get data which are needed from interview and direct observation concerning istishna’ akad implemented by the developer to buyers.

It can be concluded from the research result that istishna’ contract implemented in purchasing De Prima Tunggulwulung Islamic Housing in Malang perspective Compilation of Islamic Economic Law subsection of 104 until 108 there are some unimplemented point, in terms of there are defects in the goods or unsuited with the request of the buyer. The buyer has to khiyar or voting rights to proceed or cancel the contract. But, in the implementation of the developer De Prima Tunggulwulung Islamic Housing in Malang does not allow the buyer to postpone a contract cause of defects in the goods

ABSTRAK

Berbicara mengenai transaksi jual beli, maka harus mengetahui hukum-hukum jual beli dengan benar dan sesuai. Oleh karenanya seseorang yang terjun langsung dalam dunia usaha harus benar-benar mengetahui hal-hal yang mengakibatkan jual beli itu sah atau tidak. Dalam masalah muamalat, Allah telah menetapkan undang-undang yang berlaku umum dan dasar-dasar yang bersifat umum pula. Dengan perkembangan zaman saat ini bermunculan usaha-usaha dalam dunia bisnis yang berprinsip syariah salah satunya bisnis perumahan menerapkan sistem yang berbasis syariah di dalam transaksinya mereka menggunakan akad istishna’ yaitu dengan sistem pemesanan. Masih ada pembeli yang belum memahami tentang akad istishna’.

Dari permasalahan diatas peneliti bertujuan ingin mengetahui bagaimana jual beli rumah di Perumahan De Prima Tunggulwulung Hunian Islami perspektif Kompilasi Hukum Ekonomi Syariah Pasal 104-108 tentang Bai’ Istishna’. Peneliti ingin mengetahui kesesuaian sistem jual beli di De Prima Tunggulwulung Hunian Islami Malang perspektif Kompilasi Hukum Ekonomi Syariah. Penelitian ini menggunakan jenis penelitian hukum empiris dengan pendekatan penelitian kualitatif. Alasan menggunakan metode penelitian di atas adalah untuk mendapatkan data-data yang dibutuhkan melalui wawancara serta pengamatan secara langsung di lapangan mengenai akad yang dilaksanakan oleh pihak developer dengan pembeli.

Dari hasil penelitian dapat disimpulkan bahwa dalam hal jual beli rumah di Perumahan De Prima Tunggulwulung Hunian Islami Malang perspektif Kompilasi Hukum Ekonomi Syariah Pasal 104-108 tentang Bai’ Istishna’ masih terdapat point-point yang belum terimplementasikan, yaitu dalam hal terdapat cacat atau barang tidak sesuai dengan permintaan pemesan, harusnya pemesan memiliki hak khiyar untuk melanjutkan atau membatalkan akad, namun dalam pelaksanaannya pihak De Prima Tunggulwulung tidak memperbolehkan pembeli membatalkan akad karena adanya cacat pada barang
