Abstract

INDONESIA:

Iklan merupakan usaha untuk mengenalkan produk ke masyarakat luas. Semakin berkembangnya teknologi informatika, membuat pelaku usaha semakin kreatif dalam mempromosikan produknya. Salah satu media dan strategi yang digunakan adalah menyisipkan iklan di internet. Namun, cara ini mengganggu keleluasaan pengguna internet.

Rumusan masalah penelitian ini adalah (1) bagaimana pengaturan iklan sisipan di internet dalam Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) dan (2) bagaimana tinjauan Yûsuf Al-Qardhâwi mengenai iklan tersebut. Tujuan penelitian ini adalah untuk mendeskripsikan pengaturan di dalam Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) tentang iklan sisipan di internet dan kajiannya menurut pemikiran Yûsuf Al-Qardhâwi.

Jenis penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan konseptual. Pengumpulan bahan hukum menggunakan metode studi pustaka melalui penelusuran terhadap buku-buku maupun perundang-undangan, baik yang bersifat primer dan sekunder.

Penelitian ini menunjukkan bahwa : (1) pengaturan tentang iklan sisipan (intrusive advertising) di internet dalam Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) belum dibahas secara khusus begitupun dalam undang-undang yang lainnya. Pedoman dalam beriklan yaitu Etika Pariwara Indonesia (EPI) yang mengatur iklan di internet. (2) Dalam perspektif Yûsuf Al-Qardhâwi, iklan sisipan di internet ini termasuk kedalam etika dalam bidang sirkulasi yang mana membahas tiga pokok etika ekonomi Islam yaitu kejujuran, amanah dan nasehat. Dan iklan ini cenderung menyalahi etika yang ada sehingga pengguna internet yang menjadi pihak dirugikan dengan adanya iklan tersebut.

Advertisement is an attempt to introduce the product to public. The faster development of informatics technology, that’s one of reason for businessman to more creative to promoting their products. One of the media and strategies used is insert advertising on the internet. However, that was disturbed of internet users.

The formulation of the research problems were (1) how the regulation about intrusive advertising on the internet perspective of Electronic Information and Transaction Act (ITE Act), and (2) how reviews Yûsuf Al-Qardhâwi abaout the ads. The purpose of this study was to describe the regulation about intrusive advertising on the internet perspective of Electronic Information and Transaction Act (ITE Act) and thought its Yûsuf Al-Qardhâwi.

This type of research belongs to normative legal research by using statue approach and conceptual approach. Collection of legal materials using literature study methods that was obtained from libraries trough tracing of literature books and legislation, both primary ang secondary.

The research showed that : (1) the regulation of intrusive advertising on the internet in ITE Act has not been specifically in the field of advertising as well as in another legislation. On another side there is guidelines in advertising, that is Ethics Pariwara Indonesia (EPI) that organizes the advertisement on the internet, but it’s only applicable only to certain parties. (2) In Yûsuf Al-Qardhâwi perspective, intrusive advertising on internet is include into the ethics of sirculation which discusses the 3 (three) ethical issues of Islamic economics, they are honesty, trust, and advice. And this advertising tends to violate the exiting ethics, so that internet users become disadvantaged because of these advertising.
