Abstract
INDONESIA:
Pengembangan perbankan syariah di Indonesia untuk menyediakan alternatif pelayanan kepada masyarakat baik dalam bentuk penyimpanan dana atau jenis jasa lainnya maupun berupa pembiayaan yang dilakukan berdasarkan prinsip syariah. lembaga keuangan memperoleh kemudahan dalam operasionalnya tanpa mengurangi keuntungan, yaitu dengan mengurangi biaya tenaga kerja dalam pemberian jasa kepada nasabah. Maka demikian dibutuhkan desain kontrak (akad) dalam bentuk yang tidak hanya tunggal, tetapi mengkombinasikan beberapa akad. Setiap akad tentunya melahirkan hubungan hukum antara pihak yang menimbulkan hak dan kewajiban para pihak serta keabsahan hukum Islam dalam sudut pandang Majelis Ulama Indonesia terhadap penerapan multiakad pada pembiayaan multijasa.
Adapun permasalahan yang di bahas dalam penelitian ini adalah: 1) Bagaimana praktik penggunaan multiakad dalam pembiayaan multijasa di BPR Syariah Mitra Harmoni Malang? 2) Bagaimana tinjauan Majelis Ulama Indonesia Kota Malang terhadap penerapan multiakad dalam pembiayaan multijasa di Bank Pembiayaan Rakyat Syariah Mitra Harmoni Malang? Penelitian ini tergolong pada jenis penelitian yuridis empiris. Pendekatan yang di gunakan adalah pendekatan yuridis sosiologis.
Hasil penelitian menunjukkan bahwa Penerapan multiakad dalam produk pembiayaan multijasa di Bank Pembiayaan Rakyat Syariah Mitra Harmoni Malang menggunakan dua akad, yaitu akad ijarah dan wakalah. Penerapan multiakad yang dilakukan oleh Bank Pembiayaan Rakyat (BPR) Syariah Mitra harmoni Malang tidak dibenarkan oleh Majelis Ulama Indonesia Kota Malang, karena dasar dalam segala bentuk operasional perbankan syariah harus sesuai dengan Fatwa DSN-MUI. Multiakad dalam pembiayaan multijasa jika menggunakan akad ijarah, harus mengikuti fatwa DSN-MUI Tentang Ijarah yaitu penyediaan jasa/manfaat dan ujrah yang didapat Bank Pembiayaan Rakyat (BPR) Syariah Mitra Harmoni Malang, sedangkan dengan ditambahnya akad wakalah, nasabah mendapat kuasa untuk melakukan pembiayaan sendiridan masih harus membayar ujrah atas akad ijarah, maka itu disebut riba.

Sharia banking in Indonesia is getting bigger in quantity and becoming a trend in the banking industry, the development of sharia banking in Indonesia is intended, namely, to provide an alternative service to the community either in the form of storage of funds or other types of services or in the form of financing based on sharia principle. Financial institutions obtain ease of operation without reducing profits, by reducing labor costs in providing services to customers. Thus, it takes a contract design (akad) in a form that is not only single, but combines several contracts. Each contract of course creates a legal relationship between the parties that raises the rights and obligations of the parties as well as the validity of Islamic law in the viewpoint of the Indonesian Ulema Council against the application of multi-contract in multi-service financing.
The problems discussed in this study were: 1) How was the practice of multi-contract used in multi-service financing in BPR Sharia of Mitra Harmoni Malang? 2) What is the review of Indonesian Ulema Council of Malang City towards the implementation of multi-contract in multi-service financing in Sharia People’s Financing Bank of Mitra Harmoni Malang? This research belonged to the type of empirical juridical research. The approach used was a sociological juridical approach.
The result of the research showed that the implementation of multi-contract in multi-service financing product in Sharia People’s Financing Bank of Mitra Harmoni Malang used two contracts, namely ijarah and wakalah contracts, while the application of multi-contract by Sharia People’s Financing Bank (BPR) of Mitra Harmoni Malang was not justified by the Indonesian Ulema Council of Malang City, because the basis in all forms of sharia banking operations had to be in accordance with the Fatwa DSN-MUI. Multi-contract in multi-service financing if used ijarah contract, had to follow the fatwa of DSN-MUI about Ijarah that was provision of services / benefits and ujrah obtained by Sharia People’s Financing Bank (BPR) of Mitra Harmoni Malang, while with the addition of wakalah contract, customers received the power to do their own financing but still had to pay ujrah on ijarah contract, then it was called usury.
