Abstract
INDONESIA:
Undang-Undang Republik Indonesia Nomor 11 Tahun 2011 Tentang Otoritas Jasa Keuangan Pasal 1 angka (1) yaitu Otoritas Jasa Keuangan, yang selanjutnya disingkat OJK, adalah lembaga yang independen dan bebas dari campur tangan pihak lain, yang mempunyai fungsi, tugas, dan wewenang pengaturan, pengawasan, pemeriksaan, dan penyidikan sebagaimana dimaksud dalam Undang-Undang ini. Faktor terjadinya Gap Human of Resources dalam Perbankan Syariah terletak pada kesenjangan integritas, kompetensi, remunerasi dan lingkungan yang tidak sesuai dengan prinsip Islam dalam pelaksanaan kerja di Perbankan Syariah, sehingga OJK dalam hal ini berperan dalam menghadapi Gap Human of Resources pada perbankan Syariah.
Penelitian ini, terdapat rumusan masalah yaitu: 1) Apa faktor-faktor terjadinya Gap Human of Resources pada Perbankan Syariah menurut Otoritas Jasa Keuangan pada devisi perbankan syariah? 2) Bagaimana peran Otoritas Jasa Keuangan (OJK) Malang dalam mengatasi Gap Human of Recources pada perbankan syariah menurut Undang - Undang Nomor 11 Tahun 2011 Tentang Otoritas Jasa Keuangan?.
Penelitian ini tergolong dalam penelitian Hukum Empiris yang meneliti fenomena hukum. Pendekatan yang digunakan adalah Pendekatan Yuridis Sosiologis. Metode pengumpulan data adalah dengan metode Data primer dengan cara melakukan wawancara langsung di Kantor Otoritas Jasa Keuangan Malang serta Data Sekunder dari literatur Undang-Undang, buku-buku dan internet. Metode analisis data yang digunakan dalam penelitian adalah Analisis Data Kualitatif.
Hasil penelitian menunjukkan bahwa faktor-faktor yang mempengaruhi adanya Gap Human of Resources pada Perbankan Syariah adalah faktor kompetensi, faktor integritas, faktor remunerasi dan faktor lingkungan. Dan Otoritas Jasa Keuangan berperan dalam menghadapi Gap Human of Resources dalam Perbankan Syariah dan peranan tersebut sesuai dengan pasal 7 huruf a Undang-Undang Nomor 21 Tahun 2011 Tentang Otoritas Jasa Keuangan mengenai pengaturan dan pengawasan Sumber Daya Manusia.

The Law of The Republic of Indonesia Number 11 of 2011 Concerning Financial Services Authority Article 1 point (1), namely the Financial Services Authority, hereinafter abbreviated as OJK, is an independent institution freed from the interference of other parties, which has the functions, duties, and authority of regulation, supervision, investigation and inquiry as referred to in this Law. The factor of Gap Human of Resources in Sharia Banking lies in the gap of integrity, competence, remuneration and environment which are not in accordance with the Islamic principles in the execution of work in Sharia Banking, thus the OJK in this case plays a role in facing the Gap Human of Resources in Sharia banking.
In this study, there were some formulations of problem, namely: 1) What factors caused the Gap Human of Resources in Sharia Banking according to the Financial Services Authority in the division of Sharia banking? 2) What was the role of the Financial Services Authority (OJK) Malang in addressing the Gap Human of Recources in Sharia banking by Law Number 11 of 2011 on the Financial Services Authority ?.
This research belonged to Empirical Law study which examined the phenomenon of law. The approach used was the Sociological Juridical Approach. Data collection method used was by Primary data method by means of conducting direct interviews at the Office of Financial Services Authority Malang and Secondary Data from the literature of Law, books and internet. Data analysis method used in this research was Qualitative Data Analysis.
The results showed that the factors that affected the Gap Human of Resources in Sharia Banking were the factors of competence, integrity, remuneration and environment. And the Financial Services Authority had a role in facing the Gap Human of Resources in Sharia Banking and the role was in accordance with Article 7 paragraph a of Law Number 21 of 2011 on Financial Services Authority regarding the regulation and supervision of Human Resources.
