Abstract
INDONESIA:
Poligini sampai saat ini masih menjadi kontroversi. Kontroversi mengenai poligini seringkali datang ketika dilakukan oleh tokoh publik, Walaupun sudah dilegitimasi oleh Kompilasi Hukum Islam dan UU No. 1 Tahun 1974 Tentang Perkawinan dengan ketentuan dan syarat-syarat tertentu. Berkenaan dengan itu, berkembang wacana dari seorang pemikir Muslim asal Syria, Muhammad Syahrûr yang dengan metodologi hermeneutiknya menghasilkan satu hasil interpretasi, bahwa dalam poligini, isteri kedua, ketiga, dan keempat haruslah janda dan memiliki anak yatim. Hasil interpretasi Syahrur menarik perhatian di kalangan akdemisi karena hasil tafsirnya yang memberikan porsi simpati yang tinggi terhadap problem social kemasyarakatan. Namun, Syahrur mengesampingkan metode instimbath hukum Islam klasik yang menurutnya sudah tidak relevan. Dalam konteks ini, mengkaji pendapat anggota Majelis Ulama Indonesia sebagai lembaga fatwa cukup menarik karena lembaga ini merupakan jembatan antara teori hukum Islam dan praktik yang terjadi di masyarakat.
Penelitian ini betujuan untuk mengetahui pendapat anggota MUI Kota Malang terhadap pemikiran Muhammad Syahrûr mengenai poligini. Metode Penelitian ini merupakan penelitian Lapangan (field reserch). yang secara spesifik merupakan penelitian terhadap efektifitas praktek hukum islam dengan pendekatan kualitatif.
Hasil penelitian ini menunjukkan bahwa para anggota MUI tidak sepakat dengan pendapat Muhammad Syahrûr yang menyatakan bahwa isteri kedua, ketiga dan keempat dalam poligini haruslah janda dan memiliki anak yatim. Mereka berpendapat bahwa kebolehan poligini merupakan satu hal yang qath’i dan telah disepakati oleh jumhur ulama, dengan syarat adil dan mempunyai kemampuan. Pandangan Syahrur itu sah-sah saja sebagai sebuah wacana. Akan tetapi, tentu akan sulit diterapkan di Negara-negra muslim manapun, termasuk di Indonesia. Ketidaksetujuan MUI Kota Malang terhadap pendapat Syahrur ini pada dasarnya maklum adanya, sebab masing-masing keduanya mempunyai dasar hukum yang berbeda. MUI berpedoman kepada pendapat jumhur ulama yang selama ini disepakati, sementara Syahrur mencoba menawarkan metode pembacaan baru terhadap al-Qur’an dan tidak sepakat dengan metode istinbath hukum Islam yang selama ini dijadikan pijakan. Sebab, produk hukum Islam klasik selama ini seringkali justru bertentangan dengan aspek kemanusiaan dan tidak menyelesaikan problem kemasyarakatan.
ENGLISH:
Poligyny is still being controversy. The controversy often comes up when it is performed by prominent public figure, even though it has been legitimized by the Compilation of Islamic Law and the law no. 1 year 1974, about marriage with the particular terms and conditions. Related to this phenomenon, there is a discussion from a Syrian Muslim thinker, Muhammad Shahrur, with his hermeneutical methodology produces an interpretation, that in Poligyny, the second, third, and fourth wife must be widowers and have a child. The result of Syahrur Interpretation creates an attention among academics because he places social problems by high sympathy in his intrepetation result. However, Shahrur rejected decision method (istimbath) of classical Islamic law because it is irrelevant. In this context, assessing the opinion (fatwa) as a member of the Indonesian Ulama Council (MUI) institution is quite interesting because this institution is a bridge between theory and practice of Islamic law in society.
This research aims to find out the opinions of MUI member of Malang against Muhammad Shahrur thinking about Poligyny. The method of this research is a specific field of research on the effectiveness of the practice of Islamic law with a qualitative approach.
The results of this research indicate that the MUI members disagree with the opinion stated by Shahrur, which is second, third and fourth wife in Poligyny should be widower and have a child. They argue that the Poligyny legitimation is a clear law (qath'i), and has been supported by scholars (jumhur), with fair conditions and having the ability. Shahrur intrepetation is legitimated view as a discourse. However, it would be difficult to apply in any Muslim countries, including Indonesia. The disagreement of Malang MUI members on the Shahrur’s opinion is basically common rejection, because each of them has a different legal basis. MUI members follow the guideline of the scholars that had been agreed upon, while Shahrur trying to offer a new method on intepreting the holy Qur'an, and no agreed with the decision method (istinbath) of Islamic law which has been used as a foothold. moreover, the products of classical Islamic law have been often contrary to the humanitarian aspects of society and do not solve the problem.
